SB 319: Chronic absenteeism.

Requires the department of education (department) to: (1) study and make recommendations concerning the categorization of student absences; (2) create a list of best practices to reduce student discipline related to student absenteeism and the number of chronically absent students; (3) develop guidelines and requirements for certain intervention strategies and school attendance improvement plans; (4) submit a report concerning attendance to the legislative council; and (5) develop attendance improvement targets for certain schools. Requires a school to implement an early warning system and assemble a school based team to monitor the system. Provides the duties and obligations of a school attendance coordinator and a child study team. Requires the governing authority of a school to adopt an attendance policy and develop an attendance improvement plan aligned with department guidelines and requirements. Requires a school to collect and document certain information concerning absences.

SB 456: Shipshewana food and beverage tax.

Allows the fiscal body of the town of Shipshewana to increase its food and beverage tax from 1% to not more than 2% of the gross retail income received by a retail merchant from a taxable transaction.

SB 467: Landlord-tenant matters.

Provides that a landlord may not sell a residential rental property that is subject to an unexpired written lease unless the landlord gives written notice to the tenant not less than 60 days before the landlord lists the property for sale, unless certain exceptions apply. Requires a buyer of a residential rental property to honor an unexpired written lease between the previous owner and a tenant unless the buyer of the residential rental property: (1) gives to the tenant, not less than 30 days before the lease is terminated, written notice that the buyer intends to terminate the lease; and (2) pays the tenant an amount equal to one monthly rental payment plus the full security deposit. For purposes of a residential rental unit, defines: (1) "essential services" as certain utility services needed for the safe and habitable occupation by a tenant of the tenant's rental unit; and (2) "essential systems" as certain systems used to deliver essential services to a rental unit. Requires a landlord to repair or replace an essential system not later than 48 hours after being notified by a tenant that the tenant's rental unit is without essential services as a result of: (1) a malfunction in the essential system; or (2) the landlord's failure to maintain the system in good and safe working condition. Provides that a tenant may enforce a statutory obligation of a landlord by: (1) providing 30 days notice to the landlord of the landlord's noncompliance with the obligation; and (2) if the landlord fails to make the repairs necessary to remedy the noncompliance, withholding from the next regular rental payment the estimated cost of the repairs and using the amount withheld to make the repairs. Provides that, during the pendency of a court action brought by a tenant to enforce a statutory obligation of a landlord, the court may order the tenant to make the regular rental payments otherwise due to the landlord under the rental agreement to: (1) the clerk of the court; or (2) an attorney trust account; to be held in trust for disbursal to the prevailing party, as ordered by the court.

SB 446: Mental health and substance abuse coverage.

Sets forth certain standards regarding reimbursement rates for providers of mental illness or substance abuse services. Provides that if a provider of health care services that provides both medical or surgical services and mental illness or substance abuse services is credentialed with an insurer or health maintenance organization for purposes of providing medical or surgical services, the provider must be considered automatically credentialed for purposes of providing mental illness or substance abuse services in instances under which the insurer provides coverage of mental illness or substance abuse services through a third party vendor.

SB 455: Newborn tax credit.

Amends the definition of adjusted gross income to remove the additional dependent child exemption of $1,500 in the first taxable year in which an allowed child is claimed. Establishes a refundable tax credit for newborn children, which an eligible taxpayer may claim only in the first taxable year in which a particular newborn child is eligible for the exemption allowed under specified provisions of the Internal Revenue Code. Defines "eligible taxpayer". Provides that the amount of the credit is $500 per newborn child, or $250 per eligible newborn child in the case of a married individual filing a separate return. Prorates the credit in the case of a resident taxpayer residing in Indiana for a period of less than the taxpayer's entire taxable year.

SB 454: Whole home repairs program.

Establishes the whole home repairs program to provide funding to eligible entities to: (1) award grants to local homeowners; and (2) make loans available for small landlords offering affordable units for rent; for certain home repairs.

SB 470: Domestic violence.

Requires inservice training about the seizure and retention of firearms owned by an allegedly dangerous individual. Specifies that the office of judicial administration shall report a conviction for a misdemeanor crime of domestic violence in conviction data it transmits to the Federal Bureau of Investigation for inclusion in the NICS data base. Provides that a court may require a defendant who has at least one conviction for invasion of privacy and is charged with a crime of domestic violence to complete rehabilitative services. Requires a court to conduct an evidence based risk assessment for a defendant who has at least one conviction for invasion of privacy and is charged with a crime of domestic violence. Provides that a court shall require a person to wear a monitoring device as a condition of bail if the person is charged with a crime of domestic violence and has a prior unrelated conviction. Requires a court to order a person convicted of a crime of domestic violence to relinquish any firearms in the person's possession. Requires that if the rightful owner of a firearm has been convicted of murder, a law enforcement agency shall destroy the firearm. Provides that a person who has been convicted of a crime of domestic violence and knowingly or intentionally possesses a firearm commits a Class A misdemeanor. Provides the process for firearm confiscation. Adds a person convicted of two or more offenses under invasion of privacy to the definition of "dangerous" for purposes of the seizure and retention of a firearm. Adds that a violation of a civil protection order under the Indiana Civil Protection Order Act may be used to establish that an individual is dangerous for the purposes of the seizure and retention of a firearm.

SB 474: Food desert grant program.

Establishes the food desert grant program (program) within the Indiana department of health (ISDH) to assist new and existing retail businesses or nonprofit corporations in offering fresh and unprocessed foods within a "food desert" (an underserved geographic area where, as determined by the ISDH, affordable fresh, unprocessed, and healthy foods are difficult to obtain). Provides that a grant awarded under the program may be used to establish a new retail grocery store or to renovate, expand, or upgrade an existing retail business that will increase the availability and quality of fresh produce and other unprocessed and healthy foods. Requires the ISDH to consider certain criteria when determining whether to award a grant and requires the recipient of a grant to abide by certain terms and conditions. Establishes the food desert fund for purposes of awarding grants under the program. Requires the ISDH to report on the program annually to the general assembly. Makes an appropriation.

HB 1344: Indiana vaccination adverse event reporting system.

Requires the Indiana department of health (department) to establish an Indiana vaccination adverse event reporting system (IVAERS) for reporting the occurrence of adverse events relating to childhood vaccines. Provides that IVAERS must enable a health care provider to report the occurrence of an adverse event experienced by a child residing in Indiana who is under the care of the health care provider. Requires the department to create a searchable Internet data base for publishing information reported through IVAERS. Provides that the health information of a particular individual is confidential. Specifies the requirements for releasing health information of a particular individual and who may receive the information. Provides that a person who knowingly, intentionally, or recklessly discloses confidential information received through IVAERS in violation of the statute commits a Class A misdemeanor. Requires the department to adopt certain rules concerning IVAERS. Makes an appropriation.

HB 1338: Employment and vaccinations.

Provides that an employer may require an immunization only if the employer respects the employee's right to refuse an immunization. Provides that an employee shall be free from coercion or an adverse action based on the employee's refusal of an immunization. Requires an employer that offers an immunization at no cost to an employee to provide certain notice to the employee. Provides that a violation may be reported to the department of labor (department). Requires the department to impose a civil penalty of $5,000 per incident. Allows an employee to bring a civil action against an employer to enforce the provisions. Repeals provisions concerning exemptions from COVID-19 immunization requirements. Makes a corresponding change.

HB 1426: Liability shield products.

Defines a "liability shield product" as a certain type of product that has been designated as immune from liability under federal law. Requires a liability shield product to undergo a placebo controlled study before it is distributed, manufactured, marketed, or administered. Requires: (1) the Indiana department of health to monitor and publish certain information; and (2) certain entities to submit documentation and compliance reports; concerning liability shield products. Allows the attorney general or a private individual to bring an action if the requirements concerning liability shield products are not met.

HB 1342: Use of public restrooms.

Makes it a Class B misdemeanor if: (1) a male knowingly or intentionally enters a restroom that is designated to be used only by females; or (2) a female knowingly or intentionally enters a restroom that is designated to be used only by males. Provides certain defenses.
