Establishes the presidential electors apportionment task force (task force) to: (1) study and assess the state of Nebraska law that requires electoral votes for President of the United States to be apportioned between congressional district presidential electors and at-large presidential electors; and (2) make a recommendation as to whether Indiana should pass legislation to adopt the state of Nebraska model. Establishes rules and procedures for the task force. Requires the task force to report its findings and recommendations before November 1, 2025.
Specifies that certain records relating to juvenile delinquency proceedings are accessible to a law enforcement officer acting within the scope of the officer's duties, and requires persons having custody of these records to take steps to ensure that these records are available to the law enforcement officer in a timely manner. Repeals a provision requiring a court to expunge certain records on the court's own motion. Prohibits the expungement of a crime of violence. Allows the expungement of official misconduct if: (1) the person seeking the expungement is not an elected official; and (2) the prosecuting attorney consents.
HB 1484 prohibits public colleges and universities from using state funds to finance speaker series. It restricts the allocation of institutional funds specifically for events featuring outside speakers. The policy applies to all state educational institutions receiving public funding, limiting how they can spend state resources on external speaker programming.
Provides that the attorney general may file an amicus curiae brief only if the governor gives written approval to file the amicus curiae brief. Makes a conforming change.
Establishes entertainment zones within a consolidated city. Provides that the city-county council may establish a public safety plan for all or a designated part of an entertainment zone. Provides that a public safety plan for an entertainment zone may include a restriction on the possession of firearms within the entertainment zone, or within a particular area of the entertainment zone designated by the public safety plan, during certain hours. Establishes procedures for approving the public safety plan.
Prohibits use of public funds by a state educational institution for policies or programs and campus activities outside the classroom that: (1) advocate for campus diversity, equity, and inclusion; or (2) promote or engage in political or social activism. Makes related changes.
HB 1494 removes the requirement for the Bureau of Motor Vehicles to issue paper registration renewal stickers for motor vehicles. This change directly affects vehicle owners who currently receive these stickers when renewing registration. The bill makes technical updates to align state procedures with the removal of this physical sticker requirement. Establishes the administrative rules review committee. Requires: (1) an agency to submit a rule and the latest version of the regulatory analysis with any supporting documents; and (2) the supreme court to submit a rule and any economic impact statement, with supporting documents; to the office of fiscal management and analysis of the legislative services agency to estimate the fiscal impact on state and local government. Provides that if the fiscal impact is estimated to be greater than $300,000, the rule and supporting documents shall be provided to the administrative rules review committee for review. Provides that the rule described may not take effect unless authorized by a bill enacted by the general assembly.
Authorizes a county or municipality to adopt and enforce an ordinance that regulates the use of an automated traffic enforcement safety device (device) to detect certain violations. Provides a civil penalty for a violation. Specifies that a civil penalty must first be applied to defray the cost of the installation, operation, and maintenance of the device. Specifies the manner in which the remaining money from the civil penalty must be distributed. Prohibits: (1) reporting a violation on a driving record; (2) using a violation to determine rates for motor vehicle insurance; (3) assessing points under the point system by the bureau of motor vehicles (bureau) for a violation; and (4) reselling data collected by an agent operating a device. Requires notification to the bureau, and the suspension of the registration of a motor vehicle if a violation is not paid. Makes conforming changes.
Provides that each school corporation must include instruction on fetal development as a part of the health education curriculum for students enrolled in grades 6 through 8.
Allows counties to adopt an ordinance to impose a surcharge of not more than $2 in addition to the fees charged by the department of natural resources (department) for entry into state parks and recreation areas. Requires the department to collect the surcharge and to report and pay the surcharge to each county treasurer. Provides that the revenue collected is to be used for purposes related to first responders.
Establishes a three school year: (1) centralized school facilities pilot program; and (2) student transportation pilot program. Requires school corporations that meet certain criteria to participate in the centralized school facilities pilot program and student transportation pilot program, as applicable. Allows: (1) not more than three school corporations, as selected by the department of education (department), to voluntarily participate in the centralized school facilities pilot program; and (2) not more than three school corporations, as selected by the department, to voluntarily participate in the student transportation pilot program. Establishes a: (1) local centralized school facilities board; and (2) local student transportation board; for each participating school corporation and grants the local boards certain powers and duties. Provides that, after the three year pilot program period, each local centralized school facilities board and local student transportation board maintain the powers and duties of the board and may impose property tax levies. Requires the department of local government finance, in consultation with the department, to prepare recommendations regarding legislation and procedures to ensure the permanent transition of powers and duties to the centralized school facilities boards and local student transportation boards, as applicable.
