Provides that the Indiana utility regulatory commission may not approve an increase in the rates and charges of an electric utility to the extent the increase is related solely to the electric utility's cost of providing electric utility service to: (1) a data center; or (2) a new or existing facility: (A) the electricity demand of which exceeds or will exceed a specified amount; and (B) that employs or will employ fewer than 50 full-time employees on the premises of the facility.
Specifies that an application for a carbon dioxide transmission pipeline certificate of authority must include: (1) a risk assessment; and (2) a carbon dioxide injection estimate. Provides that when determining compensation in certain eminent domain proceedings, the perceived risk of certain hazardous conditions must be taken into account. Establishes a carbon sequestration pilot project fee program, and specifies certain conditions in relation to the fee money. Provides that a transfer of ownership in regard to a carbon sequestration pilot project does not relieve a prior operator from liability for any negligence or willful misconduct that occurred before the transfer. Requires the department of natural resources to inspect a carbon sequestration pilot project. Alters the threshold of consent one must obtain in order to use eminent domain or integration in relation to carbon sequestration.
Provides a refundable child and dependent care tax credit to taxpayers whose adjusted gross income for the taxable year is not more than 250% of the federal poverty level. Provides that the credit is equal to the lesser of: (1) an amount ranging from $200 to $1,000, depending on the extent to which the taxpayer's adjusted gross income exceeds the federal poverty level; or (2) 20% of the taxpayer's employment related expenses.
Establishes the first time home buyer savings program (program) for the purpose of assisting first time home buyers who seek to open a first time home buyer savings account (account) at a financial institution to save money for the purchase of a single family residence. Requires the Indiana housing and community development authority to administer the program, to prepare and supervise the issuance of public information concerning the program, and to prescribe various forms for use by financial institutions that choose to offer accounts. Specifies that: (1) money in an account (including all earnings or interest on an account) is exempt from taxation in Indiana; and (2) withdrawals from an account used for a down payment and allowable closing costs for the purchase of a single family residence; are exempt from state adjusted gross income taxation. Creates a state adjusted gross income tax credit for contributions to an account (credit) in an amount equal to the lesser of: (1) 20% multiplied by the amount of the total contributions made to the account during a taxable year; or (2) $5,000. Requires repayment of all or a part of the credit in a taxable year in which the taxpayer withdraws funds from an account for purposes other than payment of a down payment and allowable closing costs.
Establishes the prescription drug assistance program for the elderly (program) to be administered by the division of aging. Sets forth requirements of the program. Establishes the prescription drug assistance program for the elderly fund. Creates a Class A misdemeanor for fraud under the program.
SB 273 increases two existing 911-related fees for telecommunications customers. It doubles the prepaid wireless charge from $1 to $2 per line and raises the monthly statewide 911 fee from $1 to $2 for all service providers. These changes directly affect wireless customers and all telecommunications users in the state. The bill, introduced by Senator Spencer on January 8, 2026, has been referred to the Committee on Homeland Security and Transportation. It represents a straightforward policy change to fund 911 services without altering service requirements.
Provides that disannexation of certain property is effective upon filing a disannexation petition with the county auditor and recording the petition with the county recorder. Requires the property owner to file a petition requesting a municipality to annex the property not more than 48 months after the disannexation is effective.
Provides that, under certain circumstances, an employer who takes an adverse action against an employee commits an infraction. Specifies that, under certain circumstances, an adverse employment action is prima facie evidence of an unlawful retaliation. Provides that, under certain circumstances, an employer who knowingly or intentionally fails to pay an employee or former employee commits an infraction. Increases the amount of worker's compensation and worker's occupational diseases compensation benefits available for injuries and disablements: (1) in fiscal year 2027; (2) in fiscal year 2028; (3) in fiscal year 2029; (4) in fiscal year 2030; (5) in fiscal year 2031; and (6) in fiscal year 2032 and thereafter. Amends the definition of "wage credits". Specifies the rate for unemployment insurance benefits for initial claims filed by an individual who is totally unemployed for any week beginning after June 30, 2026. Specifies, for initial claims filed for any week beginning after June 30, 2026: (1) the maximum weekly benefit amount; and (2) an additional weekly benefit for eligible and qualified individuals with dependents.
Provides that in a base rate proceeding that is filed with or pending before the Indiana utility regulatory commission (IURC) after December 31, 2025, for an increase in an electricity supplier's basic rates and charges, the IURC shall do the following: (1) Consider whether the requested increase would result, upon full implementation, in an average monthly residential bill that would represent more than 6% of a representative low income customer's monthly income. (2) Consider and compare the following: (A) The total amount of the electricity supplier's actual return that was distributed to shareholders in the form of dividends, or reinvested by the electricity supplier in its own stock, during the period extending back to the IURC's last order approving the electricity supplier's basic rates and charges (relevant period). (B) The sum of the total amount of the electricity supplier's actual return for the relevant period that was invested in infrastructure or improvements to the electricity supplier's system, plus the amount of capital investments that are associated with a set of discrete and identifiable capital spending projects that will be placed in service within a reasonable time after the end of the electricity supplier's 12 month test period in the proceeding. (3) Hold at least two public hearings in the electricity supplier's service area. Provides that in the IURC's final order in the proceeding, the IURC shall include: (1) the IURC's findings with respect to the considerations required under the bill; and (2) a discussion of how the IURC took those findings into account in reaching the decisions set forth in the order.
Provides for various tax increment financing neutralization procedures for certain tax increment financing areas. Specifically, provides that for certain tax increment financing districts, in an appeal of the assessed value of a property: (1) the county or township assessor in conjunction with the preliminary informal meeting; or (2) the county board in conjunction with an appeal hearing by the county board; may request a taxpayer to provide income data necessary to determine the assessed value under the income capitalization approach. If requested, a taxpayer shall provide income data within 60 days of the request. Provides that an adopting body must annually, on or before November 10, report to the department of local government finance (DLGF), in a manner determined by the DLGF: (1) the total amount of debt outstanding; (2) the annual amount of debt due for each remaining year the debt will be outstanding; and (3) the estimated payoff year for all debt backed by the local income tax. An adopting body shall provide an indication of all debt obligations outstanding that are not supported by any secondary backing source. Provides that the DLGF shall post the information required on the DLGF's computer gateway. Redefines "residential property" for certain tax increment financing districts. Provides that the DLGF may require a redevelopment commission (and other tax increment financing bodies) to submit required documentation to neutralize the base assessed value. Any supporting documentation the redevelopment commission is required to submit to support the base assessed value neutralization calculation must be completed and submitted to the DLGF by July 15 of each year. Provides that if the redevelopment commission does not submit the required documentation by the deadline in a given year, then 5% of the excess assessed value shall be allocated to the respective taxing units in the year the deadline is missed. Provides that the original owner of each nonowner-occupied residential property subject to the 2% tax cap, that is located in the tax increment financing area and is excluded from the base assessed value, shall upon completion of construction enter into a written agreement with the redevelopment commission indicating the owner shall be obligated to pay the property tax for the portion of outstanding bonds in the tax increment financing district attributable to the property until the term length of the original outstanding bond is retired. Provides that the written agreement with the redevelopment commission shall be considered a lien on the property and shall be included as part of the residential real estate sales disclosure. Provides that if the property is subsequently sold as a homestead property and becomes subject to the 1% tax cap, the new owner shall be responsible for the lien on the property attributable to the written agreement with the redevelopment commission, and the new homestead property owner shall be obligated to fulfill the terms of the written agreement including the payment of the property tax liability included in the agreement. Provides that, notwithstanding any other law, for taxing districts that include multiple tax increment financing districts, the original tax increment financing district does not expire and stays active only for the purpose of satisfying outstanding bonds issued by the subsequent tax increment financing district, only if the redevelopment commission completes the following requirements: (1) Provides written appeals to and receives the approval of the DLGF. (2) Provides written notice to the state board of accounts of the appeal.
Provides that provisions establishing a statewide mobile retail food establishment license may not be construed to prohibit an owner or operator of a mobile retail food establishment from complying with: (1) the collection and reporting requirements relating to food or beverage taxes; or (2) obtaining applicable municipal business permits or complying with municipal ordinances or requirements regulating the business operations of mobile retail food establishments.
Allows qualified organizations to conduct contest based raffles for charity gaming. Specifies the manner in which contest based raffles must be conducted. Provides that a sport horse competition may be used to determine the winners of a contest based raffle.
