S 2222: Protect Taxpayers’ Privacy Act

Protect Taxpayers' Privacy Act This bill increases to $250,000 the criminal penalty for unauthorized disclosures of taxpayer information by federal employees and tax return preparers. It also lowers the evidentiary requirements for removal of employees from federal service who disclose tax return information without authorization.

S 2231: 504 Modernization and Small Manufacturer Enhancement Act of 2021

504 Modernization and Small Manufacturer Enhancement Act of 2021 This bill modifies the Small Business Administration (SBA) 504 Loan Program, which provides a small business with SBA financing—through a certified development company (CDC) intermediary—for expansion or modernization. Specifically, the bill adds policy goals, at least one of which a CDC must demonstrate to be eligible for assistance. These include (1) enhancing the ability of a small business to reduce costs by using energy efficient products and generating renewable energy, and (2) aiding the revitalization of any area for which a disaster has been declared or determined. The bill also authorizes a CDC to take specified actions to facilitate the closing of a 504 loan, such as correcting borrower or lender information on loan documents or reallocating up to 10% of the cost of a project. For small manufacturers, the bill (1) increases the maximum loan amount from $5.5 million to $6.5 million, (2) reduces the amount that they must contribute to project costs, (3) increases job retention requirements, and (4) revises collateral requirements and debt refinancing considerations. Further, each SBA district office must partner with a resource partner to provide certain training for small manufacturers.

S 2228: DISCOURSE Act

Disincentivizing Internet Service Censorship of Online Users and Restrictions on Speech and Expression Act or the DISCOURSE Act This bill limits federal liability protections for a user or provider of an interactive computer service (e.g., a social media company) related to content provided by third parties. It also requires a provider that offers its service through a mass-market offering to the public to disclose information about its content moderation activities. The bill removes liability protections (sometimes referred to as section 230 protection) for a provider with a dominant market share if the provider promotes or suppresses a viewpoint through its content moderation, including by affecting a content creator's revenue; uses automated processes (e.g., algorithms) to target and amplify content provided to a user who has not requested or searched for the content; or solicits, funds, modifies, or otherwise contributes to content. Currently, a provider retains liability protections even when it restricts access to materials that it considers objectionable. Under this bill, a provider retains protections if restricted materials fall, based on an objectively reasonable belief, into a prescribed list of harmful or unlawful categories. Additionally, the liability protections shall not apply to providers that (1) restrict access to content in a manner that burdens the exercise of religion, or (2) fail to comply with an existing requirement to notify customers of options for limiting a minor's access to harmful online content (e.g., parental controls). The bill also changes legal procedures related to the liability protections, including by specifying that the protection serves as an affirmative defense.

S 1860: Lead-Safe Housing for Kids Act of 2021

Lead-Safe Housing for Kids Act of 2021 This bill requires the Department of Housing and Urban Development (HUD) to issue regulations regarding lead-based paint in certain federally assisted housing that was constructed prior to 1978 and in which a child younger than age six will reside. Specifically, HUD must require owners of such housing to (1) conduct, within specified time frames, risk assessment for lead-based paint hazards; (2) control the hazards; and (3) provide certain notice to residents. If a family with a child younger than age six occupies such housing in which lead-based paint hazards are identified but not controlled, HUD must allow the family to relocate on an emergency basis to another dwelling without any wait, penalty, or lapse in assistance.

S 1251: Growing Climate Solutions Act of 2021

Growing Climate Solutions Act of 2021 This bill authorizes the Department of Agriculture (USDA) to establish a voluntary Greenhouse Gas Technical Assistance Provider and Third-Party Verifier Certification Program to help reduce entry barriers into voluntary environmental credit markets for farmers, ranchers, and private forest landowners. A voluntary environmental credit market is a market through which agriculture and forestry credits may be bought or sold. Entities eligible to participate in the program are (1) providers of technical assistance to farmers, ranchers, or private forest landowners in carrying out sustainable land use management practices that prevent, reduce, or mitigate greenhouse gas emissions, or sequester carbon; or (2) third-party verifiers that conduct the verification of the processes described in the protocols for voluntary environmental credit markets. Among other requirements, USDA must publish (1) a list of protocols and qualifications for eligible entities; (2) information describing how entities may self-certify under the program; (3) information describing how entities may obtain the expertise to meet the protocols and qualifications; and (4) instructions and suggestions to assist farmers, ranchers, and private forest landowners in facilitating the development of agriculture or forestry credits and accessing voluntary environmental credit markets. USDA must also establish an advisory council to make recommendations regarding the list of protocols and qualifications, best practices, and voluntary environmental credit markets. The bill also rescinds certain funds provided in the American Rescue Plan Act of 2021 and makes the funds available for the certification program.

S 1061: Israel Relations Normalization Act of 2021

Israel Relations Normalization Act of 2021 This bill requires the Department of State to take certain actions promoting the normalization of relations between Israel, Arab states, and other relevant countries and regions. Specifically, the State Department must develop a strategy on expanding and strengthening the Abraham Accords (the term used to refer collectively to agreements between Israel and the United Arab Emirates and between Israel and Bahrain marking the public normalization of relations between the two Arab countries and Israel). The strategy must include a description of how the U.S. government will encourage further normalization of relations with Israel. The State Department must report on the status of efforts to promote normalization of relations with Israel and other countries, including information on (1) laws that punish individuals for people-to-people relations with Israelis (i.e., anti-normalization laws), and (2) instances of the use of state-owned or state-operated media outlets to promote the prosecution of citizens or residents of Arab countries calling for peace with Israel.

S 14: Combating Global Corruption Act of 2021

Combating Global Corruption Act of 2021 This bill requires the Department of State to develop a program to combat corruption in foreign countries. The State Department must annually report to Congress a tiered list of all foreign countries. The first tier shall contain countries that meet minimum standards for combating public corruption, while the second tier shall contain countries that do not yet meet these standards but are making significant efforts to do so. Third-tier countries do not meet the minimum anti-corruption standards and are not making significant efforts to do so. Factors for assessing efforts to address corruption include a country's compliance with specified relevant international agreements. The State Department must report on whether, for purposes of potential sanctions, foreign persons are engaged in significant corruption in third-tier countries or in relation to the planning, construction, or operation of the Nord Stream 2 pipeline. The State Department must also designate an anti-corruption point of contact in the U.S. diplomatic post in each second- or third-tier country and where the State Department determines that such a point of contact is necessary. The point of contact shall be responsible for enhancing coordination and promoting the implementation of a whole-of-government approach to enhancing the ability of foreign countries to combat public corruption.

HR 4141: Promotion and Expansion of Private Employee Ownership Act of 2021

Promotion and Expansion of Private Employee Ownership Act of 2021 This bill expands tax incentives and federal assistance for employee stock ownership plans (ESOPs) that are sponsored by S corporations. The bill provides additional tax incentives for ESOPs by (1) extending to all domestic corporations, including S corporations, provisions allowing deferral of tax on gain from the sale of employer securities to an ESOP; and (2) allowing a tax deduction for 50% of the interest received by a bank on loans to S corporation-sponsored ESOPs for the purchase of employer securities. The Department of the Treasury must establish the S Corporation Employee Ownership Assistance Office to foster increased employee ownership of S corporations. The bill defines an ESOP business concern for purposes of the Small Business Act as a business concern that was eligible for a loan, preference, or other program under such Act before more than 49% of the business concern was acquired by an ESOP.

HR 4150: Minor League Baseball Relief Act

Minor League Baseball Relief Act This bill establishes a program for the relief of certain minor league baseball clubs and independent professional baseball clubs that experienced large business losses. The bill provides funding for the Small Business Administration to make grants to such clubs that experienced decreases in gross revenue in 2020 of at least 75%, as measured against revenues in 2019 (or, if revenues were negatively affected by a natural disaster or weather disruption in 2019, by the average of revenues over the prior three-year period). The source of funding for the grants shall be funds appropriated under enacted COVID-19 relief legislation that have not been obligated and are no longer being used to carry out activities authorized under those laws. Grant amounts provided to any club may not exceed $10 million.
