Amends the Consumer Fraud and Deceptive Business Practices Act. Provides that it is an unlawful practice for a high-impact social media company in the State to fail to make available to its customers, at no cost, a customer support service for customers to notify the company of any harmful content that the customer believes is illegal or violates the high-impact social media company's terms of service. Provides that the customer support service must timely respond to customers within one business day after a customer initially contacts the company. Provides that the customer support service must take active steps to resolve the customer's issue or complaint and communicate the steps taken to resolve the issue or complaint with the customer by mail, telephone, or email, as requested by the customer, within 3 business days after a customer initially contacts the company. Provides that the customer support service shall communicate with the customer at least once every 3 business days until the issue has been resolved or until the issue has been determined to be unsolvable. Provides that the Attorney General may bring an action against a high-impact social media company that does not comply with these provisions. Provides that any company that violates these provisions shall be fined $1,000 per day per violation. Provides that fines collected under these provisions shall be deposited into a fund to support mental health awareness in Illinois. Effective January 1, 2027.
Amends the Consumer Fraud and Deceptive Business Practices Act. Provides that a consumer may opt out of the processing of personal data for the purpose of targeted advertising by submitting a request using the methods specified in a data processing controller's privacy notice. Sets forth the requirements of a controller's privacy notice. Provides that, if a controller processes personal data for purposes of targeted advertising or sells personal data to third parties for targeted advertising, the controller shall disclose the processing or sale in a privacy notice and provide access to a clear and conspicuous method outside the privacy notice for a consumer to opt out of the processing or sale. Makes other changes. Effective January 1, 2028.
Creates the Fair Online Pricing Act. Provides that a price offered to a consumer through the consumer's online device shall not be generated in whole, or in part, based on the following input data: (1) the hardware or hardware state of the online device; (2) the presence or absence of any software on the online device; and (3) geolocation data of the online device. Sets forth exemptions. Provides that a violation of the provisions of the Act is an unlawful practice under the Consumer Fraud and Deceptive Business Practices Act. Amends the Consumer Fraud and Deceptive Business Practices Act to make conforming changes.
Amends the Consumer Fraud and Deceptive Business Practices Act. Provides that the owner, licensee, or operator of a generative artificial intelligence system shall conspicuously display a warning on the system's user interface notifying users of the limitations of generative artificial intelligence systems. Provides that each day the required warning is not displayed by the owner, licensee, or operator of a generative artificial intelligence system constitutes a separate violation of the Act. Provides that a violation of the provision constitutes an unlawful practice within the meaning of the Act.
Amends the Consumer Fraud and Deceptive Business Practices Act. Provides that a social media company shall make available to account holders a 24-hour toll-free telephone number through which an account holder may contact a live customer service representative of the social media company to report fraudulent activity on an account holder's social media account, including, but not limited to, unauthorized access. Provides that a social media company shall include the telephone number and an explanation of the purpose of the telephone number in any email notification concerning account security sent to an account holder and post the telephone number and explanation in a prominent location on the homepage or help page of the social media platform. Provides that a violation of the provision constitutes an unlawful practice within the meaning of the Act.
Amends the Consumer Fraud and Deceptive Business Practices Act. Provides that a person shall not use artificial intelligence while engaging in trade and commerce to communicate with a consumer in a manner that may mislead or deceive a reasonable consumer into believing that the consumer is engaging with a human, unless the consumer is notified in a clear and conspicuous manner that the consumer is not engaging with a human. Provides that a person shall not use artificial intelligence to sell or offer to sell goods or services unless the consumer is notified in a clear and conspicuous manner that artificial intelligence is being used to sell or offer to sell goods or services and the consumer is given an option to request more information regarding the specific use of the artificial intelligence. Provides that a business entity that uses artificial intelligence while engaging in trade and commerce to communicate with a consumer shall give the consumer the option to communicate with a human during the business entity's ordinary business hours. Provides that a violation of the provisions constitutes an unlawful practice within the meaning of the Act.
Amends the Consumer Fraud and Deceptive Business Practices Act. Provides that it is an unlawful practice for a seller of a digital good to offer for sale or advertise a digital good to a consumer using the terms "buy" or "purchase" or any other term that a reasonable person would understand to confer an unrestricted ownership interest in that digital good unless specified disclosures are made by the seller. Sets forth exemptions to the provision.
Amends the Consumer Fraud and Deceptive Business Practices Act. Provides that a business providing customer support that uses an automated telephone answering system or an automated text interface that simulates conversation shall, during the normal hours of operation of the business, provide the customer with the option of communicating with a human representative at the beginning of the phone call or text interaction.
