SB 2914: SCH CD-REMOVE/DISMISS TEACHERS

Amends the Employment of Teachers Article of the School Code. In a provision requiring a school board, before setting a hearing on charges stemming from causes that are considered remediable, to give a teacher reasonable warning, in writing, stating specifically the causes that, if not removed, may result in charges, allows a teacher to grieve the issuance of such warning pursuant to the applicable collective bargaining agreement to determine whether the board had just cause in issuing the warning. Requires the written warning to narrowly specify the nature of the alleged misconduct that needs to be remedied. Provides that under no circumstances may the written warning remain effective for longer than 4 years from the date of the issuance of the written warning. Requires the school district to use reasonable efforts to remove the written warning from the teacher's personnel file after the 4 years have elapsed or sooner if agreed to through the exclusive bargaining representative, with an exception. Effective immediately.

SB 2913: SCH CD-TEACHER EVALUATION PLAN

Amends the Evaluation of Certified Employees Article of the School Code. Provides that, beginning July 1, 2026, if a school district and its teachers cannot reach agreement over the decision on whether to incorporate the use of data and indicators on student growth as a factor in rating teaching performance into a teacher evaluation plan and there is no collective bargaining agreement that includes or incorporates by reference the teacher evaluation plan, then the student growth component shall be removed from the teacher evaluation plan. Effective immediately.

SB 2906: TRANSPORT NETWORK LABOR

Creates the Transportation Network Driver Labor Relations Act. Defines "transportation network driver" as an individual who operates a motor vehicle that: (i) is owned, leased, or otherwise authorized for use by the individual; (ii) is not a taxicab or for-hire public passenger vehicle; (iii) is used to provide transportation network company services; and (iv) operates under the license of a transportation network company. Provides that transportation network drivers have the right of self-organization, to form, join, or assist transportation network driver organizations, and to bargain collectively. Sets forth provisions concerning unfair work practices; the prevention of unfair work practices; the designation of bargaining representatives; administrative fees; bargaining, impasse resolution procedures, and final determinations by the Department of Labor; applicability of other labor standards; rulemaking; and public records. Amends the Freedom of Information Act and the Labor Dispute Act to make conforming changes. Effective immediately.

SB 2971: DHS-DEMENTIA TRAINING

Amends the Rehabilitation of Persons with Disabilities Act. Requires direct service workers employed by the Department of Human Services, or an agency contracted with the Department, to provide services under the Home Services Program to complete at least 2 hours of dementia training at the start of their employment and annually thereafter. Requires the training to cover subjects concerning Alzheimer's disease and dementia, safety risks, and communication and behavior. Requires the Department to provide contractors with dementia training curriculum on the required subjects. Provides that any other laws or rules that impose more rigorous dementia training for direct service workers under the Home Services Program shall apply. Exempts from the training requirements direct service workers who provide proof that they obtained equivalent dementia training in compliance with another law or rule. For personal assistants covered by a collective bargaining agreement, requires the Department to establish, in consultation with the joint training committee created under the collective bargaining agreement, different parameters and specific topics for curriculum covering dementia training.

HB 4565: FREEDOM TO WORK-HEALTH CARE

Amends the Illinois Freedom to Work Act. Provides that any covenant not to compete or covenant not to solicit entered into after the effective date of the amendatory Act shall not be enforceable with respect to individuals employed by health care facilities as health care professionals in the State regardless of whether an individual is covered by a collective bargaining agreement. Effective immediately.

SB 223: CD CORR-DOC SAFETY COMMITTEE

Amends the Unified Code of Corrections. Provides that the Act may be referred to as the Christopher James Act. Amends the Unified Code of Corrections. Provides that the Department of Corrections shall establish a Safety Committee comprised of bargaining unit and non-bargaining unit Department employees. Provides that at least 40% of committee members shall be bargaining unit employees. Provides that the Committee shall assess the Department's compliance with the Occupational Safety and Health Act and any other applicable workplace health and safety laws and shall make recommendations for improvements to processes and procedures to improve workplace safety. Provides that the Committee shall prepare an annual report on the Department's workplace safety efforts and plans for the future to further promote safety in the workplace. Provides that the Director of Corrections shall appoint the non-bargaining unit members of the Safety Committee. Provides that the exclusive collective bargaining representative of the majority of the Department of Corrections employees shall appoint the remaining 40% of the Safety Committee. Provides that the Director of Corrections shall appoint the chairperson of the Committee. Provides that the appointed chairperson of the Committee shall have a professional background and training in an environmental health and safety field. Provides that the chairperson of the Safety Committee, or the chairperson's designee, may conduct a workplace safety inspection of any property, equipment, or workplace under the control or supervision of the Department at any time and shall conduct random unannounced inspections as often as deemed necessary. Provides that the jurisdiction of the Safety Committee is strictly limited to the Occupational Safety and Health Act and any other applicable workplace health and safety laws. Provides that these provisions are subject to appropriations.

SB 2162: ARBITRATION-VARIOUS

Amends the Uniform Arbitration Act. Exempts from the definition of "employer" any person who is covered by a collective bargaining agreement. Allows a party to serve upon another party a demand for arbitration or a notice of intention to arbitrate, specifying the agreement under which arbitration is sought and the name and address of the party serving the notice and stating that unless the party served applies to stay the arbitration within 20 days after service the party shall be precluded from objecting that a valid agreement was not made or has not been complied with and from asserting in court the bar of a limitation of time. Provides that in an arbitration brought by a consumer or employee that requires the drafting party to pay certain fees and costs before the arbitration can proceed, if the fees or costs to initiate an arbitration proceeding are not paid within 30 days after the due date, the drafting party is in material breach of the arbitration agreement, is in default of the arbitration, and waives its right to compel arbitration. Sets forth various actions a party may take if the drafting party materially breaches the arbitration agreement. Includes sanctions an arbitrator or court may impose for materially breaching the agreement. Provides that, if a party is represented by an attorney, papers to be served on the party shall be served upon the attorney for that party, and any agreement which discriminates against or penalizes a party for retaining the services of counsel in an arbitration is null and void. In a provision regarding venue, provides that: if the name of the county is not specified, the application shall be brought in the county where the party seeking arbitration resides or is doing business, and other proceedings affecting arbitration are to be brought in the county where at least one of the parties resides or is doing business or where the arbitration was held or is pending; if there are multiple parties seeking arbitration against the same party or parties, the proceeding may be brought in any court and county where any of the parties seeking arbitration resides or is doing business or where the arbitration was held or is pending; and if there is no county in which the proceeding may be brought, the proceeding may be brought in any county.

HB 3483: FAMILY & MEDICAL LEAVE PROGRAM

Creates the Paid Family and Medical Leave Insurance Program Act. Creates the Division of Paid Family and Medical Leave within the Department of Labor. Requires the Division to establish and administer a paid family and medical leave insurance program that provides benefits to employees. Provides that the program shall be administered by the Deputy Director of the Division. Sets forth eligibility requirements for benefits under the Act. Provides that a self-employed individual may elect to be covered under the Act. Contains provisions concerning disqualification from benefits; compensation for leave; the amount and duration of benefits; payments for benefits under the Paid Family and Medical Leave Insurance Program Fund; employer equivalent plans; annual reports by the Department; hearings; penalties; notice; the coordination of leave provided under the Act with leave allowed under the federal Family and Medical Leave Act of 1993, a collective bargaining agreement, or any local county or municipal ordinance; rulemaking; and other matters. Amends the State Finance Act. Creates the Paid Family and Medical Leave Insurance Program Fund. Amends the Freedom of Information Act. Exempts certain documents collected by the Division of Paid Family and Medical Leave from the Act's disclosure requirements. Effective immediately.
