Amends the Criminal Code of 2012. Creates the offense of unlawful restraint for civil immigration enforcement. Provides that a person commits the offense when he or she knowingly and without express legal authority from an immigration agent: (1) detains another for the purpose of civil immigration enforcement; (2) by force or threat of imminent force transfers another person from one place to another with the intent to detain the other person for civil immigration enforcement; (3) by deceit or enticement induces another person to transfer from one place to another with intent to detain the other person for civil immigration enforcement; or (4) uses a deadly weapon while detaining or transferring another person from one place to another with the intent to detain the other person for civil immigration enforcement. Provides that a violation does not apply to an immigration agent. Provides that a violation is a Class 4 felony unless a deadly weapon is used while detaining or transferring another person from one place to another with the intent to detain the other person for civil immigration enforcement, in which case the violation is a Class 3 felony.
Urges the 119th United States Congress to abolish U.S. Immigration and Customs Enforcement (ICE). Urges Congress to implement an orderly and just transfer of essential and basic legally required functions in a manner that upholds values of due process, equality under the law, and family unity upon or before the abolition of ICE.
Creates the Prohibited Hiring of Federal Immigration Officers Act. Provides that a law enforcement agency may not hire as a law enforcement officer any person who was hired as a federal immigration officer by the U.S. Department of Immigration and Customs Enforcement between January 20, 2025 and January 20, 2029. Defines "federal immigration officer", "law enforcement agency", "law enforcement officer", and "local law enforcement agency". Limits the concurrent exercise of home rule powers.
Amends the Department of Commerce and Economic Opportunity Law of the Civil Administrative Code of Illinois. Provides that the Department of Commerce and Economic Opportunity shall establish and administer a Small Business Restoration Grant Program to assist small businesses in the State that have been affected by the actions of the United States Immigration and Customs Enforcement (ICE) during Operation Midway Blitz. Provides for the transfer of $50,000,000 from the General Revenue Fund to the Small Business Restoration Fund. Amends the State Finance Act to create the Small Business Restoration Fund. Effective immediately.
Amends the Personal Information Protection Act. Provides that a data collector shall not own, maintain, license, store, or disclose records that contain immigration or citizenship status information concerning an Illinois resident. Provides that the provision shall not apply to government agencies, public and private universities, or financial institutions. Provides that the definition of "personal information" includes immigration or citizenship status information. Defines "immigration or citizenship status information".
Amends the Illinois Insurance Code. Requires a group or individual policy of accident and health insurance or a managed care plan that is amended, delivered, issued, or renewed on or after January 1, 2027 to cover up to 12 mental health provider visits per plan year, with no visitation restrictions, if a local or State emergency is declared due to immigration enforcement activity and the insured has experienced loss, trauma, or displacement due to such activity. Provides that the coverage shall not be subject to deductibles, copayments, or other forms of cost sharing. Effective immediately.
Creates the ICE and CBP Tracker Act. Requires the Attorney General to create and maintain a statewide incident reporting system related to unlawful activity in Illinois by personnel employed by U.S. Immigration and Customs Enforcement and Customs and U.S. Border Protection. Makes legislative findings. Authorizes the Attorney General to adopt rules to implement the Act.
Amends the Department of Human Services Act and the State Finance Act. Creates the Operation Midway Blitz Recovery Fund, a special fund in the State treasury, to receive and disburse funds to community-based organizations to provide mental health services and mobilize rapid response networks for Illinois residents affected by immigration enforcement activities. Provides for the transfer of $10,000,000 from the General Revenue Fund to the Operation Midway Blitz Recovery Fund on July 1, 2026 and on July 1, 2027. Effective July 1, 2026.
Amends the Illinois State Police Law. Provides that, if a noncitizen is convicted of a crime that results in death or great bodily harm, then the Illinois State Police shall deport the noncitizen to the noncitizen's country of origin after the noncitizen is released from a term of incarceration, unless the Illinois State Police cannot determine the noncitizen's country of origin. Provides that, if the Illinois State Police cannot determine the noncitizen's country of origin, then the Illinois State Police shall deport the noncitizen to the noncitizen's country of entry. Provides that, if the noncitizen was not sentenced to a term of incarceration, then the Illinois State Police shall deport the noncitizen after the noncitizen is sentenced. Defines "country of entry" and "country of origin". Amends the Illinois Administrative Procedure Act. Grants the Illinois State Police emergency rulemaking powers. Effective immediately.
Amends the Illinois TRUST Act. Provides that law enforcement may not: (i) retain information regarding the citizenship or immigration status or place of birth of any individual; (ii) give any immigration agent access, including by telephone or other communication medium (rather than only including by telephone), to any individual who is in that agency's custody; (iii) permit immigration agents' use of agency facilities or equipment, including any agency electronic databases not available to the public (rather than permit immigration agents use of agency facilities or equipment, including any agency electronic databases not available to the public, for investigative interviews or other investigative or immigration enforcement purpose); or (iv) provide information to any immigration agent regarding any individual in the agency's custody (rather than provide information in response to any immigration agent's inquiry or request for information regarding any individual in the agency's custody). Provides that law enforcement may not enter into or maintain any agreement regarding direct access to any electronic database or other data-sharing platform maintained by a law enforcement agency, or otherwise provide such direct access to a federal entity enforcing civil immigration law or any third parties unless such third parties certify that the information will not be used for civil immigration purposes or knowingly disseminated for any purpose related to civil immigration enforcement. Adds provisions from the Keep Illinois Families Together Act to the Illinois TRUST Act. Changes reporting requirements. Removes certain provisions from the legislative purpose. Changes definitions. Repeals the Keep Illinois Families Together Act. Effective immediately.
