Immigration (Detention)

Creates the Immigration Enforcement Act. Provides that a State entity, local entity, or law enforcement agency may not adopt or maintain a law, ordinance, resolution, rule, regulation, policy, directive, order, practice, or procedure, formal or informal, written or unwritten, that prohibits or materially restricts the State entity, local entity, or law enforcement agency from complying with or assisting in the enforcement of immigration laws. Includes mandatory duties of law enforcement agencies regarding immigration detainers. Requires a county jail, municipal jail, and the Department of Corrections to enter into an agreement with the U.S. Immigration and Customs Enforcement or other federal agency for temporarily housing persons who are the subject of immigration detainers and for the payment of the costs of housing and detaining those persons. Requires implementation of the Act in a manner consistent with federal laws and regulations governing immigration and discrimination, protecting the civil rights of all persons, and respecting the privileges and immunities of United States citizens. Limits home rule powers by providing that regulation of immigration enforcement is an exclusive power and function of the State. Repeals the Illinois TRUST Act. Makes corresponding changes in various other Acts. Repeals provisions in the Illinois Public Aid Code and the Illinois Administrative Procedure Act relating to medical services for certain noncitizens. Amends the Department of Human Services Act. Creates the Asylum Travel Expense Program in the Department of Human Services to provide noncitizens seeking asylum who are residing in Illinois transportation and travel expenses for travel to another state that prohibits law enforcement or other governmental agencies from assisting the United States Immigration and Customs Enforcement or other federal government agency with immigration enforcement or to the country of origin of the noncitizen seeking asylum. Requires the method of transportation selected by the Department to be by the cheapest means to transport the noncitizen seeking asylum to the noncitizen's desired destination. Provides for the transfer of $10,000,000 from the General Revenue Fund into the Asylum Travel Expenses Fund to fund the Program. Amends the State Finance Act to create the Fund. Effective immediately.

Amends the Illinois Municipal Code. Provides that a detention center facility may not be located, constructed, or operated within 1,500 feet of the property boundaries of any school, day care center, day care home, cemetery, public park, forest preserve, public housing, private residence, or place of religious worship, regardless of address. Defines "detention center facility" and "federal immigration authority". Effective immediately.

Affirms voting is a protected civic activity that must be free from intimidation, fear, or the appearance of law enforcement surveillance unrelated to election administration. Declares immigration enforcement activity at or in the immediate vicinity of polling places, early voting locations, ballot drop boxes, voter registration sites, and election offices undermines public confidence in elections and the democratic process. Urges all federal agencies, including U.S. Immigration and Customs Enforcement, to refrain from conducting civil immigration enforcement operations at or near locations where voting or election administration is taking place. Affirms the authority of the State of Illinois to administer elections without interference from unrelated federal enforcement activity. Encourages election authorities, in coordination with the Illinois State Board of Elections, to promote voter education and clear guidance to ensure voters understand their rights and feel safe participating in the electoral process.

Amends the Illinois TRUST Act. Provides that certain limitations under the Act regarding actions that may be taken by law enforcement agencies and officials do not apply with respect to an individual who is not a citizen of the United States and who has been charged or convicted of a criminal offense under Illinois law. Directs a law enforcement agency or official to immediately notify an immigration agent whenever it has in its custody such an individual. Effective immediately.

Amends the Criminal Code of 2012. Creates the offense of unlawful restraint for civil immigration enforcement. Provides that a person commits the offense when he or she knowingly and without express legal authority from an immigration agent: (1) detains another for the purpose of civil immigration enforcement; (2) by force or threat of imminent force transfers another person from one place to another with the intent to detain the other person for civil immigration enforcement; (3) by deceit or enticement induces another person to transfer from one place to another with intent to detain the other person for civil immigration enforcement; or (4) uses a deadly weapon while detaining or transferring another person from one place to another with the intent to detain the other person for civil immigration enforcement. Provides that the offense does not apply to any immigration agent. Provides that a violation is a Class 4 felony, except when the person uses a deadly weapon while detaining or transferring another person from one place to another with the intent to detain the other person for civil immigration enforcement, a violation is a Class 3 felony.

Urges the 119th United States Congress to abolish U.S. Immigration and Customs Enforcement (ICE). Urges Congress to implement an orderly and just transfer of essential and basic legally required functions in a manner that upholds values of due process, equality under the law, and family unity upon or before the abolition of ICE.

Creates the ICE and CBP Tracker Act. Requires the Attorney General to create and maintain a statewide incident reporting system related to unlawful activity in Illinois by personnel employed by U.S. Immigration and Customs Enforcement and Customs and U.S. Border Protection. Makes legislative findings. Authorizes the Attorney General to adopt rules to implement the Act.
