HB 4434: CD CORR-END OF LIFE CARE

Amends the Unified Code of Corrections. Creates the End-of-life Care Peer Support Program. Provides that the program is available to terminally ill persons committed to the Department of Corrections. Provides that the program shall be administered by the Department of Corrections in partnership with certain health care providers. Provides that individual patients may accept or decline care or participation in the program. Provides that individual patients shall define the scope of peer support, including the option to opt out of certain aspects of support. Provides that patient care plans shall be developed with the individual patient, the patient's peer support attendants, and the interdisciplinary team. Provides that participating patients shall be subject to the least restrictive security measures possible, with access to comfort items such as blankets, memorabilia, music, and books. Provides that participating patients shall have the following rights: (1) the right to dignity, privacy, respect, and culturally competent care; (2) the right to request peer support services; (3) the right to refuse services; and (4) the right to request family visitation. Provides that all participants in the program, including patients and peer support attendants, shall have access to grief counseling and mental health care services as needed. Provides that the program shall be funded through: (1) the Individual Benefit Fund; (2) direct appropriations from the General Revenue Fund; and (3) federal appropriations if applicable.

HB 4739: SCH CD-SCHOOL VENTILATION

Amends the School Code. Provides that, subject to appropriation, the State Board of Education, in consultation with the Department of Public Health, shall develop an educational document explaining, at a minimum, the values of good indoor air quality and shall supply the document to school districts. Provides that, subject to funding from the State Board, a school district shall ensure that all active classrooms are equipped with an air quality monitor.

HB 5302: JAIL RELEASE-OPIOID ANTAGONIST

Amends the County Department of Corrections Division of the Counties Code, the Unified Code of Corrections, and the County Jail Act. Provides that, upon the release of a prisoner or committed person from a county correctional institution, county jail, or Department of Corrections correctional institution or facility, the sheriff, warden, or Department shall provide the prisoner or committed person with an opioid antagonist if the prisoner was incarcerated for drug-related charges or was identified as having a substance use disorder.

HB 4708: CD CORR-OPIOID USE DISORDERS

Amends the Unified Code of Corrections. Provides that the Department of Corrections shall create and implement, on January 1, 2027, a pilot program to establish the effectiveness of long-acting injectable medications for opioid use disorders for persons committed to its custody who suffer from opioid use disorders. Provides that the pilot program shall require long-acting injectable medications for opioid use disorders to be used in at least one Department of Corrections facility. Provides that the Director may expand the pilot program to include an additional facility or facilities as he or she deems appropriate. Provides that a minimum of 4,000 administrations of long-acting injectable medications for opioid use disorders shall be included in the pilot program. Provides that the Department shall develop a plan to facilitate access to continued treatment for opioid use disorders in the community following the release of a person participating in the pilot program, including, but not limited to, a referral to a harm reduction provider. Provides that the Department must report to the General Assembly on the effectiveness of the program by January 1, 2028. Effective immediately.

HB 1598: OPERATING ROOM SAFETY ACT

Creates the Operating Room Patient Safety Act. Provides that each surgical technologist hired or contracted by a health care facility on or after January 1, 2027 shall meet specified educational, certification, or experiential requirements. Provides that nothing in the Act prohibits an individual from performing surgical technology services if the individual is acting within the scope of the individual's license or registration or is a student or intern under the direct supervision of a licensed health care provider.

HB 5329: MENTAL HEALTH-COURT ORDERS

Amends the Mental Health and Developmental Disabilities Code. Provides that whenever psychotropic medication or electroconvulsive therapy is refused under a specified provision at least once that day, the psychiatrist or advanced practice psychiatric nurse (instead of the physician) shall determine and state in writing the reasons why the recipient did not meet the criteria for the administration of medication or electroconvulsive therapy and whether the recipient meets the standard for administration of psychotropic medication or electroconvulsive therapy under a provision concerning the administration of psychotropic medication and electroconvulsive therapy upon application to a court. Provides that a petition requesting that the court authorize treatment with psychotropic medication shall specify the full names of the medications and anticipated range of dosage that comprise such treatment. Provides that no administration of psychotropic medication or electroconvulsive therapy without the informed consent of the recipient may be authorized unless at least one psychiatrist or advanced practice psychiatric nurse who has examined the recipient testifies in person at the hearing. Makes other changes to definitions and provisions concerning administration of psychotropic medication and electroconvulsive therapy upon application to a court.

HB 5468: MENTAL HEALTH 9-1-1 CALLS

Amends the Community Emergency Services and Support Act. Replaces all references to the Division of Mental Health of the Department of Human Services with the Department of Human Services throughout the Act. Provides that 9-1-1 public safety answering points shall screen specific types of law enforcement calls and follow approved protocols and processes under the Act to identify callers experiencing behavioral health crises and to refer them for a behavioral health response. Provides that 9-1-1 public safety answering points shall open and follow the emergency medical dispatch protocols established under the Emergency Medical Services (EMS) Systems Act at the start of all emergency calls to ensure the protocols are used and applied consistently and uniformly to ensure that information related to behavioral health emergency calls is available for data collection and can be used to determine which calls should be referred for a behavioral health response. Provides that, among other things, each Regional Advisory Committee or subregional committee must (1) review regional and subregional crisis response system capacities and resources to inform planning and implementation and to foster collaboration across all sectors of the system and (2) determine the need for and make a plan to support local communities to develop and use other resources to create additional mobile mental health relief provider services to expand the capacity to provide more immediate service coverage. Amends the Emergency Telephone System Act. Provides that, beginning July 1, 2027, all public safety answering points shall use the protocols established under the Community Emergency Services and Support Act to identify behavioral and mental health-related emergencies that do not require a law enforcement response. Amends the Illinois State Police Law. Amends the Illinois Police Training Act. Provides that Crisis Intervention Team (CIT) training programs shall include, among other things, community response options including, the community response options under the Community Emergency Services and Support Act. Makes other changes.

HB 5313: MEDICAID-READMISSION DATA

Amends the Medical Assistance Article of the Illinois Public Aid Code. Removes provisions requiring the Department of Healthcare and Family Services to: (i) establish benchmarks for hospitals to measure and align payments to reduce potentially preventable hospital readmissions, inpatient complications, and unnecessary emergency room visits; (ii) publish provider-specific historical readmission data and anticipated potentially preventable targets 60 days prior to the start of the program; and (iii) adopt policies and rates of reimbursement for readmission services and other payments.

HB 4039: HOPE ACT

Creates the Holistic Overdose Prevention and Equity Act. Creates the Harm Reduction Program Board, with certain requirements. Provides that the Department of Public Health shall issue grants to harm reduction providers, with certain requirements. Establishes a Chief Harm Reduction Officer within the Department. Provides for a place-based approach to harm reduction pilot program. Provides for local government training and continuing education. Provides that naloxone shall be made readily available to all staff and individuals in prisons and jails, with certain requirements. Provides for medication for opioid use disorder and fentanyl testing. Restricts the use of abstinence-only or sobriety requirements to housing, with certain requirements. Limits home rule powers. Makes findings. Defines terms. Amends the Department of Professional Regulation Law of the Civil Administrative Code of Illinois, the Counties Code, the County Jail Act, the Unified Code of Corrections, the Hospital Licensing Act, and the Overdose Prevention and Harm Reduction Act to make conforming changes.

HB 2929: DHS-OVERDOSE PREVENTION SITES

Amends the Substance Use Disorder Act. Requires the Department of Human Services to establish a mechanism to collect research and data regarding overdose prevention sites (OPSs) and prepare a report for the General Assembly within 12 months after the effective date of the amendatory Act. Provides that the report shall contain information on (1) current research on the effectiveness of an OPS as an overdose prevention strategy; (2) OPS best practices for staffing, placement, and activities; and (3) the benefits and challenges of different OPS models - structures and settings. Requires the Department, in collaboration with people with lived experience, to develop a pilot service, subject to available funding, aimed at saving the lives of people who use substances that shall include the establishment of at least one OPS. Requires the pilot OPSs to offer people, who are most likely to use drugs in public, unobserved, high-risk, and unsanitary locations, a safe space to use pre-obtained substances and connect to community supports or other existing treatment and recovery programs, harm reduction services, and health care. Contains provisions concerning certain principles pilot OPSs must abide by; OPS staffing and location requirements; pilot OPS services; and other matters. Permits the Department to approve an entity to operate a pilot program in one or more jurisdictions. Grants criminal and civil immunity to persons who use pilot OPSs services; pilot OPS staff; and any real property owner upon which the OPS site is located or operates. Contains provisions on public awareness outreach; OPS reporting requirements; home rule exemption; and other matters. Effective immediately.
