HB 2955: EPA-PFAS WASTEWATER

Creates the PFAS Wastewater Citizen Protection Act. Creates the PFAS Wastewater Citizen Protection Committee for specific purposes. Provides that the Committee shall submit a PFAS Action Plan to the Governor's Office, the General Assembly, and the Environmental Protection Agency no later than one year after the effective date of the Act. Provides that the Committee shall continue to periodically meet and shall annually update the PFAS Action Plan and submit annual reports with certain requirements. Provides for membership of the Committee. Provides that the Prairie Research Institute's Illinois Sustainable Technology Center shall provide technical assistance to the Committee. Makes findings and declares policy. Defines terms. Provides that the Act is repealed on December 31, 2044. Effective immediately.

SB 3772: EPA-ENVIRONMENTAL JUSTICE

Amends the Environmental Protection Act. Provides that, beginning January 1, 2027, upon receipt of certain air pollution control construction permit applications, the Environmental Protection Agency shall evaluate (i) whether the applicable source falls within an area of environmental justice concern and, if so, notify specified persons; (ii) whether emissions can be reduced or limited; (iii) whether additional air quality modeling is needed; and (iv) whether specified permit enhancements are needed. Requires the Agency's permitting decisions to be informed by the applicant's history of violations of environmental laws and other factors. Allows the Agency to adopt rules. Amends the Environmental Justice Act. Establishes the Office of Environmental Justice within the Environmental Protection Agency to coordinate the integration of environmental justice into Agency programs and for other purposes. Requires the Director of the Environmental Protection Agency to appoint an Environmental Justice Officer to administer the Office of Environmental Justice. Effective immediately.

SB 3037: DARK SKY ACT

Amends the Responsible Outdoor Lighting Control Act. Changes the short title of the Act to the Dark Sky Act. Provides that, beginning December 1, 2026, except for any lighting that a State agency has installed or is using on the effective date of the amendatory Act, all new or renovated luminaires that are purchased or rented with State funds for the purpose of outdoor illumination and any lighting that is installed on land or easements owned, leased, or managed by the State for the purpose of outdoor illumination, including, but not limited to, on roadways, facilities, properties, nonhabitable structures, monuments, and public right-of-way spaces shall comply with specified responsible outdoor lighting requirements. Makes exceptions to the requirements. Provides that a State agency may send a request to the Department of Central Management Services to seek an exemption when planning to install, purchase, or rent lighting under one or more of the listed exceptions to the requirements in the Act. Requires the Department of Central Management Services, within 30 days of receipt, to (i) grant the exemption by memorandum, (ii) deny the exemption by memorandum, or (iii) grant the exemption by failing to issue a memorandum. Makes conforming changes to provisions that apply to the Department of Natural Resources. Changes a definition. Makes technical changes. Effective immediately.

SB 3917: EPA-WASTE DISCHARGE PERMIT

Amends the Environmental Protection Act. Provides that all National Pollutant Discharge Elimination System permits authorizing a discharge from a facility designated by the Environmental Protection Agency and the United States Environmental Protection Agency as a major facility, shall, at a minimum, require for publicly owned treatment works, periodic sampling of influent, effluent, and biosolids for all perfluoroalkyl and polyfluoroalkyl substances for which there are accredited wastewater analytical methods and, for all other facilities, periodic effluent sampling for all perfluoroalkyl and polyfluoroalkyl substances for which there are accredited wastewater analytical methods. Provides that the Agency shall require any NPDES permit application for a discharge of wastewater that has potential to contain perfluoroalkyl and polyfluoroalkyl substances to fully characterize the discharge through sample results for all perfluoroalkyl and polyfluoroalkyl substances for which there are accredited wastewater analytical methods. Provides that the Agency shall not issue any permit under specified provisions for the land application of a sludge or biosolids unless the application includes sample results for the sludge or biosolids for all perfluoroalkyl and polyfluoroalkyl substances for which there are accredited wastewater analytical methods. Provides that any permit issued under specified provisions for the land application of a sludge or biosolids shall require, at minimum, periodic sampling of the sludge or biosolids for all perfluoroalkyl and polyfluoroalkyl substances for which there are accredited wastewater analytical methods.

SB 4025: EPA-LEAD SERVICE LINE REPLACE

Amends the Environmental Protection Act. Provides that an owner or operator of a community water supply may, by an additional method approved by the State, give written notice of the existence of lead service lines that are connected to buildings. Provides that an owner or operator of a community water supply that performs at least 4,000 lead service line replacements per year or exceeds a statutorily prescribed lead service line replacement rate is exempt from a provision that prohibits partial lead service line replacements. Provides that, in a municipality with a population of more than 1,000,000 inhabitants, the owner of a private property upon which there is located a renter-occupied building, a building that is used as a day care, or a multi-dwelling building must allow the community water supply access to replace the lead service line on the private side of the property.

HB 3739: EPA-WATER SUPPLIES

Amends the Environmental Protection Act. Specifies that the Act shall not apply to non-community water supplies, except for purposes of: (1) the Environmental Protection Agency's implementation of the Safe Drinking Water Act; (2) the Pollution Control Board's adoption of rules that expressly pertain to non-community water supplies or all public water supplies; or (3) any provisions of the Act or rules adopted by the Board under the Act that are referenced in, or applicable to, non-community water supplies under the Illinois Groundwater Protection Act and rules adopted by the Department of Public Health under that Act. Amends the Illinois Groundwater Protection Act. Authorizes the imposition of administrative and civil penalties. Effective immediately.

HJR 55: FARMLAND-DEVELOPMENT

States that it is of vital importance to protect Illinois farmland from irreversible conversion and fragmentation due to solar, industrial, and other large-scale developments. Affirms that farmland protection is consistent with and complementary to the goals of the Climate and Equitable Jobs Act and should be considered in clean-energy planning and implementation. Urges State agencies, local governments, and developers to prioritize renewable-energy and infrastructure projects on non-agricultural lands whenever practicable and to minimize impacts on prime farmland and farmland of statewide importance. Supports renewable-energy siting practices that protect soil health, drainage infrastructure, and long-term agricultural productivity, including appropriate decommissioning and land-restoration standards. Encourages transparent decision-making and meaningful community engagement to ensure that agricultural landowners and rural communities are protected from unintended long-term harm.

HB 3278: EPA-PLASTIC PELLET FREE WATERS

Specifies that the amendatory Act may be referred to as the Plastic Pellet Free Waters Act. Amends the Environmental Protection Act. Requires the Environmental Protection Agency to adopt rules establishing effluent limitations for wastewater, spills, and runoff associated with the production, transport, and packaging of plastic pellets and other preproduction plastic materials. Amends the Illinois Administrative Procedure Act to grant the Agency emergency rulemaking powers. Effective immediately.

HB 2419: EPA-LOCAL SITING REVIEW

Amends the Environmental Protection Act. Provides that, when determining whether certain local siting review criteria have been met, the county board of the county or the governing body of the municipality, as applicable, shall consider, among other things, vehicle emissions and the potential cumulative impacts created by the addition of the facility to the existing pollution sources, the disparate impacts created by the addition of the facility to existing pollution sources, and the potential disparate impacts on nearby communities. Requires the local siting decisions of the Pollution Control Board to include a written statement describing whether the procedures were conducted by the county board or governing body in a manner that is accessible to the public, including individuals with disabilities and individuals who are not native speakers of English.

SB 1697: CARBON CAPTURE-COMPENSATION

Amends the Carbon Dioxide Transportation and Sequestration Act. Provides that the Illinois Commerce Commission shall not issue any certificate of authority under the Act before July 1, 2026. Removes language providing that if, after July 1, 2026, the Pipeline and Hazardous Materials Safety Administration has not adopted final revisions to specified pipeline safety rules, the Commission may only approve a certificate of authority if it finds that the applicant has met all of the requirements of the Act, has already acquired all of its other necessary approvals, and is compliant with any requirements or conditions adopted by the Commission. Provides that a nonconsenting pore space owner's compensation shall include just compensation and any operations term or injection term payments made upon or after the initiation of injection provided to consenting pore space owners in consideration of allowing use of their pore space for sequestration of carbon dioxide. Provides that a nonconsenting pore space owner's compensation shall be no less than the average total payment package, considered as a whole with respect to an individual owner, provided in agreements to similarly situated consenting pore space owners for use of their pore space by the same sequestration operator for the same sequestration project (instead of provided in agreements during the previous 365 days to similarly situated consenting pore space owners). Amends the Safety and Aid for the Environment in Carbon Capture and Sequestration Act. Provides that an affected landowner is entitled to reasonable compensation from an applicant that has been granted a certificate of authority under this Act for damages resulting from access to the landowner's property for required activities taken to construct the pipeline, including, but not limited to, compensation for specified damages. Sets forth provisions concerning payment of the compensation; attorney's fees; and an applicant entering into an agreement with the Department of Agriculture that governs the mitigation of agricultural impacts associated with the construction of the proposed pipeline. Makes other changes.
