Criminal Justice (Firearms)

Amends the Code of Criminal Procedure of 1963 and the Illinois Domestic Violence Act of 1986. Provides that a person commits the crime of violation of an order of protection under the Criminal Code of 1961 or the Criminal Code of 2012 if the person, in violation of an order to surrender the person's firearms and firearm parts, knowingly transfers a firearm or firearm parts to the respondent or otherwise allows the respondent access to a firearm or firearm parts. Provides that, if the law enforcement agency seeks to correct or negate the warrant for the seizure of the respondent's firearms and firearm parts, it shall take reasonable steps to notify the petitioner before appearing before the court. Makes technical changes.

Amends the Firearm Owners Identification Card Act. Provides that the Illinois State Police shall not deny an application for a Firearm Owner's Identification Card or revoke a Firearm Owner's Identification Card on the basis of: (1) any conviction, adjudication, or delinquency finding that has been vacated, reversed, or set aside by a court; or (2) any record that has been expunged, sealed, or otherwise ordered removed under the Criminal Identification Act or Juvenile Court Act of 1987. Provides that the Illinois State Police shall eliminate from all internal databases any of these records within 45 days after receipt of the court order. Provides that use of any such record in connection with a Firearm Owner's Identification Card determination is prohibited. Provides that when a circuit court issues a final order directing the Illinois State Police to issue or reinstate a Firearm Owner's Identification Card of a person whose application for a card has been denied or whose card has been revoked, the Illinois State Police shall comply with the order and issue the card within 30 days after receipt of the order, unless the Illinois State Police files a petition for review in the Appellate Court within that 30-day period. Provides that if the Illinois State Police fails to comply with that provision, the person's application for a Firearm Owner's Identification Card shall be automatically granted by the Illinois State Police by operation of law or the person's Firearm Owner's Identification Card shall be automatically restored by operation of law on the 31st day after receipt of the order. Provides for the submission of certain quarterly reports by the Illinois State Police to the General Assembly and to the Governor. Effective immediately.

Amends the Criminal Code of 2012 and the Unified Code of Corrections. Provides that the 15-year penalty enhancement for committing various offenses with a firearm, applies only if the person committed the offense while personally armed with the firearm.

Provides that the Act may be referred to as the Responsible Gun Manufacturing Act. Amends the Criminal Code of 2012. Provides that a person commits the offense of unlawful possession of weapons when the person knowingly manufactures, sells, or offers to sell, purchases, receives, manufactures, imports, or transfers a convertible pistol. Establishes penalties. Provides exemptions. Provides that a machine gun also includes any convertible pistol equipped with a switch. Defines "convertible pistol", "switch", and "common household tool". Contains a severability provision.

Amends the Unified Code of Corrections. Provides that the Illinois Law Enforcement Training Standards Board and the Director of Corrections shall approve and shall issue concealed carry cards to all current and retired correctional officers that shall authorize the current or retired correctional officer to carry a concealed firearm off duty. Provides that the Director shall implement annual range qualification days for retirees to maintain their concealed carry cards. Provides that these range dates shall be offered no less than once per month, every month and may include weekends. Provides that the Director may charge a range fee of no more than $30 from each retiree for annual qualification. Provides that the proceeds from these fees shall be used to improve institutional firearms range facilities and training Department correctional officers. Provides that the Department of Corrections shall issue a retiree identification card to all employees at the conclusion of their employment at the Department of Corrections. Establishes information that must be placed on the cards. Effective immediately.

Amends the Criminal Code of 2012. Creates the offense of criminal firearm negligence. Provides that a person commits the offense when: (1) the person owns, possesses, or controls a firearm; (2) the person knows or reasonably should know that a prohibited person resides in or regularly accesses the premises; (3) the person fails to securely store the firearm as required by law; and (4) the prohibited person gains access to the firearm. Establishes penalties for violation. Provides that the provision does not apply to (1) firearms secured in compliance with applicable safe storage laws; or (2) circumstances in which the firearm was accessed through unlawful entry or theft. Provides that the provision shall be construed in conjunction with existing civil penalties under the handgun safety devices statute and does not preclude the imposition of civil fines if applicable. Defines "prohibited person".

Urges the Illinois State Board of Education (ISBE) to identify and publish a list of evidence-based, decision-making, and impulse-control curricula that have been demonstrated to reduce violence involvement, make at least one free or low-cost curriculum available statewide for optional integration into existing Social and Emotional Learning (SEL) instruction, encourage districts to implement these programs using existing resources and staff development, and develop, pilot, and rigorously test new school-based decision-making and violence-prevention curricula that can be easily adopted by ISBE and schools statewide if proven effective in reducing violence. Urges the Administrative Office of the Illinois Courts (AOIC), the Department of Juvenile Justice (DJJ), and county probation and diversion programs to identify and approve evidence-based, decision-making curricula appropriate for minors under supervision, diversion, or detention, to encourage their integration as standard early interventions, and to implement these initiatives within existing budgets and structures. Urges the Illinois Department of Human Services (IDHS) and the Illinois Criminal Justice Information Authority (ICJIA) to coordinate with ISBE, AOIC, DJJ, and local partners to align violence-prevention curricula and community-based interventions across settings. Recognizes Professor Jens Ludwig for his groundbreaking research, leadership, and publication of Unforgiving Places. Acknowledges the contributions of other scholars and organizations advancing behavioral approaches to violence prevention.

Amends the Stalking No Contact Order Act. Changes the short title of the Act to the Stalking or Harassment No Contact Order Act. Defines "harassment" as violence or threats of violence or death, including a single act, directed at a specific person that would cause a reasonable person to (i) fear for the person's safety, the safety of a workplace, school, or place of worship, or the safety of a third person or (ii) suffer emotional distress. Changes the term "stalking no contact order" to "stalking or harassment no contact order". Makes conforming changes in the following Acts: the Criminal Identification Act; the Firearm Owners Identification Card Act; the Criminal Code of 2012; the Code of Criminal Procedure of 1963; the Rights of Crime Victims and Witnesses Act; the Unified Code of Corrections; the Code of Civil Procedure; the Civil No Contact Order Act; the Crime Victims Compensation Act; the Illinois Domestic Violence Act of 1986; the Address Confidentiality for Victims of Domestic Violence, Sexual Assault, Human Trafficking, or Stalking Act; the Domestic Violence Fatality Review Act; and the Illinois Human Rights Act. Makes other changes.
