SB 3901: MARRIAGE ACT-EVIDENCE

Amends the Illinois Marriage and Dissolution of Marriage Act. Provides legislative intent that the misuse of artificial intelligence involves the fabrication of evidence that can be fake, manipulated, or non-existent that can have a profound effect in family law cases. Provides that its misuse can be particularly harmful in family law proceedings because of the emotion involved. Requires that on the request of either party, the court must review evidence under Supreme Court Rule 901 to evaluate proposed evidence that may have been generated by artificial intelligence as that term is defined in the Illinois Human Rights Act.

SB 3701: SCH CD-FULL FUNDING LEVELS

Amends the School Code. Provides that all mandated categorical programs under the Code and the School Breakfast and Lunch Program Act shall be funded at 100% of their required levels as calculated by the State Board of Education, without proration. Provides that, beginning with Fiscal Year 2027, the General Assembly shall appropriate funds for each fiscal year sufficient to fully reimburse school districts for all services and costs under mandated categorical programs, as required under the Code. Requires the State Board to annually provide to the General Assembly, no later than May 1 of each year, the appropriation levels needed to fully fund mandated categorical grant funding for the upcoming fiscal year. With respect to the evidence-based funding formula, provides that the State shall increase annual new State funds to ensure full funding of the formula beginning with Fiscal Year 2027. Requires the State Board to annually determine and report the amount necessary to bring all Tier 1 and Tier 2 organizational units to 100% of their adequacy targets, and requires the General Assembly to appropriate sufficient funds to meet this requirement no later than Fiscal Year 2027. Provides that no organizational unit may receive less than the amount determined under the formula in any fiscal year. Effective immediately.

SB 3761: DATA CENTERS-VARIOUS

Amends the Illinois Power Agency Act. Establishes the data center self-direct program to allow for customers taking service under the data center tariff to receive a reduction in the charges collected for the procurement of renewable energy resources. Provides that the reduction in charges available to the customer shall increase based on the energy or capacity value of the new additive clean energy generation's contribution pursuant to the specified requirements. Provides that the Illinois Power Agency may require that participating customers provide annual reports related to facility operation and performance, customer electricity consumption and load profiles, and other information as necessary. Amends the Public Utilities Act. Provides that, on or after January 1, 2027, at least 180 days prior to commencing any construction activities, the data center operator of a proposed data center shall submit a data center disclosure to the Illinois Commerce Commission. Establishes publication and open meeting requirements concerning the data center disclosures. On and after January 1, 2027, requires all data centers operating within the State to maintain water consumption data to submit annual disclosures of the data center's water usage to the Department of Natural Resources. Requires the Department of Natural Resources to make an aggregated and anonymized form of data disclosed to it available on a publicly accessible website. Provides that data centers that fail to comply with any disclosure requirements under the Act may be subject to fines of up to $10,000 per violation. Requires the Department of Natural Resources and the Illinois Commerce Commission to adopt implementing rules. Requires a specified electric utility to, no later than 90 days after the effective date of the amendatory Act, make a filing with the Commission that proposes revenue-neutral tariff changes, which shall present the Commission with an opportunity to suspend the tariffs and consider revenue-neutral tariff changes related to rate design. Makes other changes. Effective immediately.

SB 3257: VEH CD-ALPR-RECORD RETENTION

Amends the Illinois Vehicle Code. Changes the definition of "automated license plate reader" or " ALPR" to mean a camera or system of cameras using computer algorithms to convert images of license plates into automated computer-recognized searchable alphanumeric data (rather than an electronic device) that is mounted on a law enforcement vehicle or positioned in a stationary location and that is capable of recording data on or taking a photograph of a vehicle or its license plate and comparing the collected data and photographs to existing law enforcement databases for investigative purposes. Allows a law enforcement agency to retain ALPR system detection records for 5 years after the date of the creation of the records. Requires the detection records to be archived 90 days after the creation of the records unless the information is relevant to an ongoing investigation or pending criminal trial. Provides that any detection records that are older than 90 days shall only be accessed with the written approval of the law enforcement agency head. Prohibits all detection records archived after 90 days from being searchable by out-of-state agencies. Requires all detection records to be destroyed 5 years after the records were created unless the information is relevant to an ongoing investigation or pending criminal trial. Requires the Illinois State Police to retain ALPR detection records for a period that is consistent with the provisions of the Expressway Camera Act and the State Records Act.

SB 3654: LIQUOR-ELECTRONIC NOTICE

Amends the Liquor Control Act of 1934. Requires an applicant for a retail license to provide the applicant's primary and supplementary email address to which all license-related notices may be served. Provides that certain licenses shall not be revoked or suspended except after a hearing by the State commission with reasonable notice to the licensee served by electronic or other reasonable means (instead of by registered or certified mail with return receipt requested) at least 10 days prior to the hearings at the last known place of business of the licensee or to the licensee's primary or supplemental email address and after an opportunity to appear and defend.

SB 3735: EDUC-TECH RTS/BIOMETRIC INFO

Creates the Student Educational Technologies Rights Act. Provides that it is the policy of the State that a student and the student's parent have the right to: opt out of school-issued personal electronic devices, electronic textbooks, electronic required reading, or electronic or online assignments; request a human teacher review any automated scored grade or scored grade generated by artificial intelligence; and opt out of predictive analytics systems without academic penalty. Amends the School Code. Removes language allowing school districts that collect biometric information from students to adopt specified policies. Prohibits a school district from purchasing or otherwise acquiring biometric systems to use on students. Establishes prohibitions for a school district with respect to biometric systems and biometric information of its students. Sets forth requirements on the destruction of biometric information in the possession of a school district. Makes other changes. Amends the Student Online Personal Protection Act. Prohibits an operator from selling or renting any other person's information collected by the operator for K through 12 school purposes or permitting artificial intelligence to train on covered information unless for K through 12 school purposes or in furtherance of improving operability and functionality of the operator's service. Provides, with exceptions, that an operator's artificial intelligence model shall not train on a student's covered information and retain the training data indefinitely. Makes other and conforming changes.

SB 4019: VIDEO GAMING TERMINAL PAYOUTS

Amends the Video Gaming Act. Makes changes to defined terms. Provides that each licensed establishment, licensed truck stop establishment, licensed large truck stop establishment, licensed fraternal establishment, and licensed veterans establishment at which video gaming terminals are available shall have a payout device approved by the Board. Removes provisions requiring a player to turn in the player's ticket to the appropriate person at those establishments. Provides that no cash award for the maximum wager on any individual hand shall exceed the W-2G reporting requirements set by the Internal Revenue Service (instead of $1,199). Requires cash awards to be awarded in denominations rounded to the nearest 5 cent credit.

SB 3830: DATA CENTERS-VARIOUS

Amends the Illinois Power Agency Act. Establishes the data center self-direct program to allow for customers taking service under the data center tariff to receive a reduction in the charges collected for the procurement of renewable energy resources. Amends the Public Utilities Act. On and after January 1, 2027, requires all data centers operating within the State and discharging water to a wastewater treatment plant to identify likely pollutants in the data center's water discharges to monitor the data center's water discharges for the likely pollutants and to maintain data on the pollutant levels in water discharges. Requires the Environmental Protection Agency to analyze and assess all data center water pollutant discharge level disclosure data. On and after January 1, 2027, requires all data centers operating within the State to maintain water consumption data to submit annual disclosures of the data center's water usage to the Department of Natural Resources. Requires the Department of Natural Resources to make an aggregated and anonymized form of data disclosed to it available on a publicly accessible website. Provides that data centers that fail to comply with any disclosure requirements under the Act may be subject to fines of up to $10,000 per violation. Requires the Department of Natural Resources and the Illinois Commerce Commission to adopt implementing rules. Requires a specified electric utility to, no later than 90 days after the effective date of the amendatory Act, make a filing with the Commission that proposes revenue-neutral tariff changes, which shall present the Commission with an opportunity to suspend the tariffs and consider revenue-neutral tariff changes related to rate design. Amends the Water Use Act of 1983. Makes changes in provisions concerning water conflict resolution and groundwater emergency restrictions. Sets forth requirements for data centers under the Act. SB 3919: REGULATING HEMP

Amends the Cannabis Regulation and Tax Act. In the definition of "cannabis", provides that "cannabis" does not include hemp, industrial hemp, or Illinois hemp for human consumption as defined and authorized under the Industrial Hemp Act, but includes intoxicating hemp as defined under the Industrial Hemp Act. Amends the Industrial Hemp Act. Revises definitions to conform to federal law. Adds definitions of "Illinois hemp for human consumption", "intoxicating hemp", and "synthetic hemp product". Directs the Department of Agriculture to adopt rules to conform to federal law. Directs the Department to also adopt rules regarding hemp products intended for human consumption that (1) require testing, (2) establish labeling requirements, (3) require child-resistant packaging, and (4) prohibit branding attractive to children. Prohibits the sale, offer for sale, delivery, or furnishment of a hemp product intended for human consumption to a person who is under 21 years of age. Prohibits the manufacture, distribution, sale, offer for sale, delivery, or furnishment of synthetic hemp products. Provides for civil penalties for violations to be deposited into the Industrial Hemp Regulatory Fund. Provides that the exception in the Cannabis Control Act for the Industrial Hemp Act does not apply to synthetic hemp products. Amends the Cannabis Control Act. Changes the definition of "cannabis".

SB 3631: ETHICS-FACULTY TIME SHEETS

Amends the State Officials and Employees Ethics Act. In provisions regarding personnel policies and work time requirements, specifies that State employees of public institutions of higher education classified as faculty and those not eligible for overtime pay may satisfy the time sheets requirement by complying with the terms of their contract with the public institution of higher education. Effective immediately.

SB 3870: ELEC CD-FOREIGN CONTRIBUTIONS

Amends the Election Code. Provides that a foreign-influenced business entity shall not make a contribution or donation to any person or entity with the express or implied condition that the contribution or donation, or any part of the contribution or donation, be used for specified political purposes. Sets forth certification requirements. Provides that the provisions shall not be construed to establish liability on the part of any candidate, political committee, or other recipient of certification. Provides for enforcement of the provisions. Defines terms. Effective July 1, 2026.

SB 3558: PROCUREMENT-MARKET BASKET

Amends the Illinois Procurement Code. In provisions concerning competitive sealed bidding, provides that a contract for supplies may be awarded using a market basket analysis to evaluate the lowest price a vendor can offer for a representative sample of supplies.
