Creates a Task Force on Ethics to examine and recommend improvements in ethics legislation enacted in 2003 by the 93rd General Assembly.
Amends the Chicago Firefighter Article of the Illinois Pension Code. Compounds the automatic annual increase in retirement annuity. For firemen born on or after January 1, 1945 and before January 1, 1960, increases the automatic annual increase in retirement annuity to 3%, removes the 30% maximum, and permits the initial increase at age 55. Amends the State Mandates Act to require implementation without reimbursement. Effective immediately.
Amends the Criminal Code of 1961. Makes a technical change in a Section concerning the unlawful sale of public conveyance travel tickets to a minor.
Amends the School Code. Makes a technical change in a Section concerning children with disabilities.
Amends the Illinois Insurance Code. Requires an insurer to establish and maintain a procedure for dealing with appeals of the insurer's administrative determinations and complaints regarding its administrative decisions. Provides that an appeal may be filed by an insured or his or her designee or guardian, physician, or health care provider. Requires an insurer to designate a clinical peer to review appeals. Provides that if an appeal is denied, the person who requested the appeal may request an external independent review of the denial. Provides procedures for external independent review.
Amends the Illinois School Student Records Act. Makes a technical change in a Section concerning the nondisclosure of records.
Amends the Workers' Compensation Act. Provides that no compensation is payable if an injury was caused solely by the intoxication of the employee or by the influence of alcohol or any narcotic drugs, barbiturates, or other stimulants not prescribed by a physician or by the combined influence of alcohol and any other drug or drugs that affected the employee to a specified extent. Contains provisions regarding evidence, presumptions, and measurement.
Creates the Dog and Cat Overpopulation Control Act. Establishes the Dog and Cat Population Control Program to reduce the population of unwanted and stray dogs and cats by encouraging the owners of dogs and cats to have them sexually sterilized. Provides guidelines for participation in the Program by dog and cat owners and veterinarians. Grants rulemaking power to the Department of Agriculture. Provides that violation of any provision of this Act may result in an administrative fine not to exceed $1,000 for each violation. Creates the Dog and Cat Animal Population Control Fund. Provides that each county board shall, in addition to the individual animal and litter registration fee, impose a $2 dog and cat population control fee on each registered dog and cat beginning January 1, 2005. Preempts home rule powers. Amends the State Mandates Act to require implementation without reimbursement. Effective immediately.
Amends the Code of Criminal Procedure of 1963. Provides that in a criminal case tried by a jury in which eyewitness testimony has been admitted into evidence, the court shall instruct the jury to consider certain factors in weighing the identification testimony of the eyewitness.
Amends the Illinois Historic Preservation Act. Makes technical changes in the short title Section.
Amends the Clinical Psychologist Licensing Act. Makes technical changes in a Section concerning the short title and policy.
Creates the State Facility Modification Review Act. Provides that the Department of Human Services, the Department of Corrections, or the Department of Veterans' Affairs may not close a facility operated by that department or reduce the use of a facility operated by that department by more than a specified amount without approval by the General Assembly. Provides that a proposal for such a closure or reduction must be submitted to the General Assembly and must include certain supporting documents. Effective immediately.
