HB 2630: RETAILERS OCCUPATION TAX

Amends the Counties Code and the Illinois Municipal Code. Provides that, on and after July 1, 2003, neither a county board nor the corporate authorities of a municipality may enter into or renew any agreement with a retailer to share or rebate any portion of retailers' occupation taxes generated by retail sales of tangible personal property if: (1) the tax on those retail sales, notwithstanding the agreement, has previously been paid to another unit of local government; and (2) the retailer continues to maintain a retail location or warehouse, within that other unit of local government, from which the tangible personal property is delivered to purchasers. Provides that any unit of local government denied retailers' occupation tax revenue because of such an agreement may file an action in circuit court against the municipality or the county, as the case may be, or against the retailer, or both. Provides that if the unit of local government prevails in the circuit court action, it is entitled to damages in the amount of the tax revenue it was denied as a result of the agreement, statutory interest, costs, reasonable attorneys' fees, and an amount equal to 50% of the tax. Effective immediately.

HB 2917: GOVERNOR-END OF TERM HIRING

Creates the Gubernatorial End of Term Employment Act. Provides that any employee of the executive branch under the control of the Governor who is hired, promoted, or granted any form of protected employment status during the final 6 months of a Governor's term of office may be discharged or demoted or may be removed from protected employment status, all without cause, by the succeeding Governor within the first 60 days of that succeeding Governor's term of office. Contains provisions concerning applicability. Provides that neither the State nor any officer or employee of the State has any liability whatsoever to an employee who is sanctioned under this Act.

HB 5069: CD CORR-AGG DISCH FIREARM

Amends the Unified Code of Corrections. Provides that a person convicted of aggravated discharge of a firearm, whether or not the conduct leading to conviction for the offense resulted in great bodily harm to the victim, may only receive a maximum of 4.5 days of good conduct credit for each month of his or her sentence of imprisonment. Effective immediately.

HB 4259: CRIM CD-SEX OFFENDERS-SCHOOLS

Amends the Criminal Code of 1961. Provides that provisions prohibiting child sex offenders from being present in school buildings and from residing within 500 feet of the school also apply to institutions of higher education.

HB 4948: PENCD-ART 7-ADMINISTRATIVE

Amends the IMRF Article of the Illinois Pension Code. Provides that any moneys received by an elected official from the State of Illinois for service in that capacity shall be deemed earnings unless specifically excluded. Changes the provisions defining and specifying the manner of designating a beneficiary. Removes obsolete language relating to the payment of federal social security contributions to the Fund. Makes a change in the required contribution for transfer of credits to IMRF from a downstate police pension fund for certain police chiefs who participate in IMRF. Provides that an employee whose disability determination or medical examination results are at issue before the Board may request that the portion of the Board meeting or committee hearing concerning the disability determination or medical examination be closed to the public. Provides that if a retiring employee has accumulated nonconcurrent service with more than one participating municipality or participating instrumentality, aggregate municipality charges shall be prorated among all nonfinal employers based on service credit and projected earnings with those employers and, for the final employer, municipality charges shall be based on the remaining cost of the employee's pension. Makes a technical correction. Amends the State Mandates Act to require implementation without reimbursement. Effective immediately.
