SB 2825: MUNI CD-SOLID WASTE DISPOSAL

Amends the Illinois Municipal Code concerning solid waste disposal service, except in counties with more than 250,000 inhabitants where the majority of the municipal sewerage system users are located outside the municipality. Authorizes discontinuance of solid waste disposal service to a premises within a sanitary district when payment of the rate or charge for solid waste disposal service to the premises has become delinquent. States that the provider of solid waste disposal service shall not request discontinuation of solid waste disposal service before sending a notice of the delinquency to the user and affording the user an opportunity to be heard. Defines "solid waste". Effective June 1, 2004.

HB 4054: $DOC-CNTY JUV DT CTRS

Appropriates the amount of $1, or so much of that amount as may be necessary, from the General Revenue Fund to the Department of Corrections for the purpose of grants to provide funding to fully staff county juvenile detention centers. Effective on July 1, 2004.

SB 2800: CRIM PRO-VIDEO CAMERA

Amends the Code of Criminal Procedure of 1963. Provides that a law enforcement agency or law enforcement officer may not use a video camera or other device, openly or secretly placed, to record visual images of public streets or highways and pedestrians or motor vehicle drivers on those streets or highways for the purpose of enforcing the criminal laws of this State or the criminal ordinances of a unit of local government. Provides that video camera images recorded in violation of this provision are inadmissible in any criminal proceeding as evidence against a pedestrian or driver shown in those images and may not be used as a basis for an arrest of any person shown in those images to be violating the criminal laws of this State or the criminal ordinances of a unit of local government.

SB 3391: VEH CD-LOCAL GOVT-MOTORCYCLES

Amends the Illinois Vehicle Code. Provides that a unit of local government, including a home rule unit, that enforces against any person an ordinance that (i) applies only to motorcycles and restricts their access to certain highways, (ii) requires motorcycle riders to wear protective headgear, or (iii) regulates motorcycles in a manner inconsistent with the Code, in addition to being liable to that person for the actual damages sustained, is liable to that person for punitive damages in an amount not less than $10,000 and not greater than $25,000 and for reasonable attorney's fees.

HB 2197: CLEAN INDOOR AIR-LOCAL GOVT

Amends the Illinois Clean Indoor Air Act. Provides that units of local government may regulate smoking in public places; provides that this regulation must be no less restrictive than the regulation in the Act. Changes the home rule limitation from an absolute preemption (with an exception for units having pre-existing ordinances) to a limitation on the concurrent exercise of home rule power. Effective immediately.

HB 5128: CRIM CD-TRESPASS AGRI FAC

Amends the Criminal Code of 1961. Creates the offense of criminal trespass to an agricultural facility. Defines the offense as entering upon lands or buildings owned by any other person without the license of the owner or legal occupant, where signs forbidding trespass are displayed, and where cattle, goats, pigs, sheep, fowl, or any other animal is being raised, bred, fed, or held for the purpose of food for human consumption; or injuring, gathering, or carrying away any animal being housed on any of those lands, without the license of the owner or legal occupant; or damaging, destroying, or removing, or causing to be removed, damaged, or destroyed, any stakes, marks, fences, or signs intended to designate the boundaries and limits of any of those lands. Provides that criminal trespass to an agricultural facility is a Class B misdemeanor.
