SB 886: LOC GOV-CABLE TELEVISIONS

Amends the Counties Code and the Illinois Municipal Code concerning community antenna television systems. Provides that within 20 days after a county or municipality issues a permit or other authorization for the construction of residential buildings within any residentially-zoned subdivision created through a plat recorded after July 1, 2003, the county or municipality must notify any community antenna television system franchised to serve all or a portion of the subdivision of the issuance of the permit or other authorization. Provides that the notice must identify the owner of record of the property and the party to whom construction authorization has been granted.

SB 1168: PARK DIST-POPULATION

Amends the Park System Civil Service Act. Increases the number of residents within the territorial limits of a park district for purposes of determining how offices and places of employment within the district shall be classified and filled. Effective immediately.

SB 423: CRIM ID-EXPUNGE

Amends the Criminal Identification Act and the Unified Code of Corrections. Provides that if a conviction or sentence has been set aside on direct review or on collateral attack and the court determines by clear and convincing evidence that the defendant was factually innocent of the charge, then the court shall enter an order expunging the record of arrest from the official records of the arresting authority and order that the records of the clerk of the circuit court and Department of State Police be sealed until further order of the court upon good cause shown and the name of the defendant obliterated from the official index kept by the circuit clerk. Amends the State Appellate Defender Act. Provides that the State Appellate Defender shall establish, maintain, and carry out an Expungement Program to provide information and assistance to persons eligible to have their arrest or criminal history record information ordered expunged, sealed, or impounded. Provides that the State Appellate Defender shall develop brochures, pamphlets, and other materials in printed form and through the agency's World Wide Web site that include at a minimum the following information: (1) an explanation of the State's expungement process; (2) the circumstances under which expungements may occur; (3) the criminal offenses that may be expunged; (4) the steps necessary to initiate and complete the expungement process; and (5) directions on how to contact the State Appellate Defender. Provides that the State Appellate Defender shall establish and maintain a statewide toll-free telephone number that a person may use to receive information or assistance concerning the expungement or sealing of arrest or criminal history record information. Provides that the State Appellate Defender shall compile a statewide list of volunteer attorneys willing to assist eligible individuals through the expungement process. Provides that the Program shall be implemented from funds appropriated to the State Appellate Defender for this purpose. Effective immediately.

SB 1075: RURAL BOND BANK-ISSUANCE

Amends the Rural Bond Bank Act. Increases the Bank's bond authorization to $500,000,000 outstanding at any time. Increases the maximum amount used to purchase securities issued by certain units of local government to $87,500,000. Effective immediately.

HB 1089: ANIMAL FIGHTING-FORFEITURE

Amends the Criminal Code of 1961. Provides for the forfeiture to the State of real property used in the conduct of animal or dog fighting and of moneys, profits, and proceeds acquired by the conduct of animal fighting or dog fighting in violation of the Humane Care for Animals Act or the dog fighting provisions of the Criminal Code of 1961. Provides for hearings on forfeiture. Provides for the distribution of the proceeds from the sale of the property seized to the various units of government that investigated and prosecuted the violations. Effective immediately.

HB 1632: CONSUMER FRAUD-FREE TRIALS

Amends the Consumer Fraud and Deceptive Business Practices Act. Provides that a person or entity that, by means of telemarketing, offers free goods or services to an Illinois consumer on a trial basis and assesses a periodic fee or charge for the goods or services after the end of the free trial period, must send a consumer who accepts the free goods or services a form the consumer may use to indicate his or her agreement to pay the periodic fee or charge after the end of the free trial period. Prohibits a person or entity from assessing a fee or charge for the goods or services after the end of the free trial period if the person or entity does not receive a signed form from the consumer in which the consumer agrees to pay the periodic fee or charge after the end of the free trial period. Provides that a violation constitutes an unlawful practice under the Act.

HB 362: CAPITAL DEV BD-ENERGY CODE

Amends the Capital Development Board Act. Requires the Board by January 1, 2004, to adopt an energy code for the construction or repair of facilities funded by General Assembly appropriations. Effective immediately.

HB 548: PEST CONTROL-PENALTIES

Amends the Structural Pest Control Act. Provides that a person convicted of a second or subsequent violation of specific provisions concerning licensure requirements is guilty of a Class 4 felony. Amends the Illinois Pesticide Act. Provides criminal penalties for retailers or wholesalers distributing or selling a pesticide not registered with the United States Environmental Protection Agency and the Illinois Department of Agriculture. Effective immediately.

HB 2317: LOC GOVT-ASSESSMENTS-BILLING

Amends the Special Assessment Supplemental Bond and Procedure Act. Provides that an amount for bond discount, as provided for in a special assessment ordinance, is the difference between the face amount of a bond and the price at which the bond is to be sold, exclusive of original issue discount (now, the difference between the face amount of a bond and the price at which the bond is to be sold). Removes a provision requiring that the date upon which interest shall begin to accrue on the assessments shall be not earlier than 60 days after the date that the notice of the due date of the first installment and the date from which interest shall accrue on the assessments was filed with the clerk of court. Provides that Supplemental Act Assessment Bonds may be issued in lieu of vouchers at any time after the date of the judicial order of final confirmation of the assessment roll and report. Provides that the owner or issuer of those bonds may rely on any waiver of the statutory appeal period executed by a municipality, county, or other issuer of the bonds and the owners and parties interested in land taken, damaged, or assessed therein, as conclusive evidence of the non-appealability of the final judgment or order. Provides that parties interested in land taken, damaged, or assessed for purposes of waiver and appeal shall include only the owners of record and contract purchasers of the land taken, damaged, or assessed. Contains provisions concerning when a county clerk or a governing body may mail assessment billing. Contains provisions concerning the use of surplus to: (i) declare a rebate upon lots, blocks, tracts, or parcels of lands assessed; (ii) to credit the surplus amount to each lot, block, tract, or parcel of land assessed, or a pro rata proportion, to reduce payment due; or (iv) to retire bonds. Effective immediately.
