Amends the School Code. Provides that in order to be eligible for election to a school board (or in Chicago to be eligible for appointment), a person must not be a child sex offender.
Creates the Facility Planning Area Rules Act. Requires the Illinois Environmental Protection Agency to propose rules and procedures for facility planning area amendments. Gives guidelines for the proposed rules and procedures. Repeals the Act on January 1, 2007. Effective immediately.
Amends the Illinois Insurance Code. Provides that if the Illinois Life and Health Insurance Guaranty Association elects to succeed to the rights of an insolvent insurer arising after the date of an order of liquidation or rehabilitation under a contract of reinsurance to which the insolvent insurer was a party, the Association must pay all unpaid premiums due under the contract for coverage relating to periods before and after the date of the order of liquidation or rehabilitation (now the Association must pay premiums for coverage relating to periods after the date of the order of liquidation or rehabilitation).
Amends the Unified Code of Corrections. Requires the court, at the sentencing hearing of the defendant, to afford certain persons affected by any of the following offenses committed by the defendant an opportunity to make a statement concerning the impact of the offense on the victim and to offer evidence in aggravation or mitigation: Class 4 felony violations of prostitution, soliciting for a prostitute, keeping a place of prostitution, patronizing a prostitute, patronizing a juvenile prostitute, or pimping.
Amends the State Fire Marshal Act. Allows the Office of the State Fire Marshal to create an equipment exchange program under which fire departments and fire protection districts can donate equipment to the State Fire Marshal which the Marshal can re-certify as safe and distribute to other departments and districts. Limits the liability of fire departments and fire protection districts that donate equipment. Effective immediately.
Amends the Illinois Educational Labor Relations Act to provide that an academic employee of a community college who provides less than 3 (now, 6) credit hours of instruction per academic semester is not an "educational employee" within the meaning of the Act. Amends the State Mandates Act to require implementation without reimbursement.
Amends the Elder Abuse and Neglect Act. Extends the responsibilities of the Department on Aging to include education and warning programs about elder abuse in conjunction with other State departments, banks and other financial institutions, and utility companies. Provides that professionals who are mandated reporters who willfully fail to report suspected elder abuse shall be referred to the appropriate professional disciplinary board and that other mandated reporters who willfully fail to report are guilty of a misdemeanor. Extends the period of review by a provider agency of services provided to elders from up to one year to up to 2 years.
Creates the Data Security on State Computers Act. Contains only a short title provision.
Amends the Illinois International Port District Act. Provides that the District may police its property and exercise police powers, may enforce any rule or regulation provided by the ordinances of the District, including regulation of vehicular traffic and commercial maritime traffic, and may employ and commission police officers and other qualified persons. Provides that members of the Illinois International Port District Board shall not be prevented from receiving non-salary benefits of the type received by employees of the District. Effective immediately.
Amends the Juvenile Court Act of 1987. Provides that persons 17 years of age and older who have a petition of delinquency filed against them may (rather than shall) be confined in an adult detention facility.
Amends the Sale of Tobacco to Minors Act to provide that the sale or distribution at no charge of cigarettes from a lunch wagon engaging in any sales activity within 1,000 feet of any public or private elementary or secondary school grounds is prohibited.
Amends the Counties Code. Provides that the fees collected by the county board of any county for filing instruments, papers, or notices of record may be used to defray the cost of providing access to records through the Internet. Provides that a special fund set up by the treasurer may be used for a system to provide electronic access to a document records system. Provides that the county board of any county that maintains a countywide map through a Geographic Information System may use the fee charged for filing of instruments, papers, or notices of record to defray the cost of providing electronic access to the county's Geographic Information System records. Effective immediately.
