Amends the Illinois Workforce Investment Board Act. Requires the Illinois Workforce Investment Board to implement a benchmarking system for the State's workforce development system, establish a mechanism to collect data and track the benchmarks on an annual basis, and then use the results to set goals for each benchmark, to inform planning, and to ensure the effective use of State resources.
Amends the Unified Code of Corrections. Provides that a prisoner serving a sentence in a Department of Corrections facility for a crime committed as a result of the use of, abuse of, or addiction to alcohol or a controlled substance and committed on or after the effective date of the amendatory Act shall receive no good conduct credit until he or she participates in and completes a substance abuse treatment program. Provides that if treatment is not available, the prisoner shall be placed on a waiting list and may be required by the Department to attend a substance abuse education class or attend substance abuse self-help meetings. Provides that a prisoner may not lose good conduct credit as a result of being placed on a waiting list. Effective September 1, 2003.
Amends the Criminal Code of 1961. Creates the offense of dismembering a human body. Establishes exceptions. Provides that the penalty is a Class X felony. Effective immediately.
Amends the Illinois Vehicle Code regarding the reclassification of a vehicle's registration during a current registration period. Provides that, when an owner is reclassing the registration of a vehicle from a flat rate plate to an apportioned plate, a refund may be issued if the applicant was issued the wrong plate originally and the credit for the unused portion of the registration fee amounts to an overpayment. Effective immediately.
Amends the Emergency Evacuation Plan for People with Disabilities Act. Provides that an evacuation plan must be established even if the owner has not been notified of a need for evacuation assistance by a disabled occupant of the building. Provides that the building owner (rather than the plan) must provide for a means to notify the occupants of the building that the owner maintains a list identifying persons with a disability in need of emergency evacuation assistance and those occupants can place their names on that list. Effective immediately.
Amends the Child Care Act of 1969. Provides that DCFS must take certain steps to keep track of its wards who have been placed in foster care by private child welfare agencies. Provides that if a child who is a ward of the Department is placed or transferred by a private child welfare agency, the Department must verify that the child resides at the site of the initial or transferred placement. Requires private child welfare agencies to ascertain whether other children have been placed in a foster family home. Requires private child welfare agencies to make periodic visits to placement sites; provides for suspension of payments to an agency if the agency fails to make the required visits. Provides for revocation of the license of a foster parent or private child welfare agency if the foster parent or agency fails to promptly report a missing child. Effective immediately.
Amends the School Code. Provides that if a teacher is elected to serve as an officer of a State or national teacher organization that represents teachers in collective bargaining negotiations, then the school board shall grant the teacher a leave of absence of up to 6 years or the period of time the teacher serves as an officer, whichever is longer (now, the leave may only be for up to 6 years). Amends the State Mandates Act to require implementation without reimbursement.
Amends the School Code. Provides that each member of the General Assembly may annually nominate 2 students for scholarships at any State supported university (now one of the 2 must be to the University of Illinois). Makes related changes. Effective immediately.
Amends the Illinois Public Aid Code. Requires the Department of Human Services to develop and implement a program to provide cash assistance, equivalent to that provided under the TANF program, to children or adults who have been victims of domestic violence or extreme cruelty committed within the United States and who are legal immigrants to the United States and would be eligible for TANF assistance except that they have not been present in the United States for 5 years as otherwise required under the Code. Effective July 1, 2003.
Amends the Criminal Code of 1961. Provides that when the victim is under 18 years of age at the time of the commission of the offense and the accused was a member of the clergy, a prosecution for criminal sexual assault, aggravated criminal sexual assault, predatory criminal sexual assault of a child, or aggravated criminal sexual abuse may be commenced at any time. Effective immediately.
Amends the State Universities and General Provisions Articles of the Illinois Pension Code. Amends the QILDRO provisions to provide for benefits payable under the SURS self-managed plan. Changes provisions relating to calculating the contribution for certain military service credit; also allows these contributions to be considered separately for purposes of refunds and to be used in calculating a retirement annuity under Rule 2. Specifies the allocation of moneys received from the repayment of a refund by a person under the portable benefit package. Specifies that employer contributions and interest are not included in any refund payable to a person who loses his or her pension benefits due to a felony conviction. Clarifies language relating to guardianship. Deletes obsolete provisions; makes other changes. Effective immediately.
Amends the Illinois Marriage and Dissolution of Marriage Act. Sets forth factors to be considered in a proceeding to review, modify, or terminate maintenance after the entry of the judgment of dissolution of marriage, judgment of legal separation, or judgment of declaration of invalidity of marriage. Removes the showing of substantial change in circumstances requirement for a modification of maintenance.
