Amends the State Finance Act. Provides for the transfer of specified amounts from various special funds to the Audit Expense Fund for use by the Auditor General in auditing those special funds. Effective immediately.
Amends the Criminal Code of 1961. Provides that the penalty provisions of the offense of unlawful purchase of a firearm apply to attempting to purchase firearms in violation of the statute. Effective immediately.
Amends the State Finance Act. In provisions concerning the Tobacco Settlement Recovery Fund, provides that in any civil litigation under any legal theory in which a judgment is entered against a signatory or a successor to a signatory of the Master Settlement Agreement, the appeal bond that the signatory or successor or another defendant may be required to post to stay execution on the judgment during the time that an appeal or discretionary review of the judgment is pending shall be set in accordance with the law and the rules of the court, except that in no case may the total amount of the appeal bond exceed $25,000,000, regardless of the total amount of the judgment. Authorizes a court order to prevent an appellant's dissipation or diversion of assets. Provides that these changes apply to any action pending on or after the effective date of this amendatory Act. Effective immediately.
Amends the State Finance Act. Provides that upon a State employee's retirement or resignation, his or her vacation, overtime, and sick leave need not be payable in a single lump sum if otherwise provided for in a collective bargaining agreement entered into under the Illinois Educational Labor Relations Act. Effective immediately.
Amends the Illinois Vehicle Code. Prohibits excessive use of the left lane of controlled access and other multilane highways except when certain conditions exist. Provides that a vehicle may not be driven to the left of another vehicle on those highways for a distance exceeding one-half mile. Provides that the prohibition does not apply to authorized emergency vehicles while using emergency lighting or to law enforcement vehicles engaged in official duties.
Amends the Criminal Code of 1961. Prohibits a person other than a licensed physician or dentist from performing tongue splitting. Provides that a physician or dentist authorized to perform tongue splitting may perform tongue splitting on an individual only if there is a therapeutic or clinical basis for performing the procedure on that individual. Makes a first offense a Class A misdemeanor and a second or subsequent offense a Class 4 felony.
Amends the Illinois Aeronautics Act. Makes a technical change in a Section regarding airports.
Amends the Illinois Underground Utility Facilities Damage Prevention Act. Excludes sewers from the scope of the Act. Makes technical changes. Effective immediately.
Amends the Illinois Public Labor Relations Act and the Illinois Educational Labor Relations Act. Provides that the Illinois Labor Relations Board or the Illinois Educational Labor Relations Board shall: designate a representative for purposes of collective bargaining when the representative demonstrates a showing of majority interest by employees in a unit; ascertain the employees' choice of employee organization in the case of a dispute on the basis of dues deduction authorization and other evidence, or, if necessary, by conducting an election; conduct an election if the dues deduction authorizations and other evidence are fraudulent or were obtained through coercion; and investigate and consider a party's allegations that the dues deduction authorizations and other evidence submitted in support of a designation of representative without an election were subsequently changed, altered, withdrawn, or withheld as a result of fraud, coercion, or unfair labor practice by the employer and designate the representative without conducting an election if it determines that a representative would have had a majority interest but for the employer's fraud, coercion, or unfair labor practice. Effective immediately.
Amends the Criminal Code of 1961. Makes a technical change in a Section concerning the definition of "felony".
Creates the Boards and Commissions Act of 2003. Contains only a short title provision.
Amends the Township Code. Provides that a trade-in of machinery or equipment on new or different machinery or equipment does not constitute a sale of township or road district property. Increases to $5,000 or less (now, $200 or less) the value of personal property which does not require the adoption of a resolution of the intent to sell or lease the property. Effective immediately.
