Creates the Inclusion of Women and Minorities in Clinical Research Act. Provides that in conducting or supporting a project of clinical research, a grantee receiving State funds must ensure that women and members of minority groups are included as subjects in research projects. Provides that a grantee must conduct or support outreach programs for the recruitment of women and members of minority groups as subjects in projects of clinical research. Provides for exceptions.
Amends the Drug Paraphernalia Control Act. Defines drug paraphernalia as equipment, products, and materials of any kind which are intended to be used unlawfully (rather than peculiar to and marketed for use) in violation of the Cannabis Control Act or the Illinois Controlled Substances Act. Makes conforming changes in other Sections of the Act. Effective immediately.
Creates the Structured Settlement Protection Act. Requires that certain disclosures be given to a payee before the payee enters into a structured settlement for the payment of a tort claim or a settlement of a workers' compensation claim. Provides that a payee may not transfer structured payment settlement rights without approval by a court or responsible administrative authority. Establishes a procedure for the approval of transfers of structured settlement payment rights.
Amends the Code of Civil Procedure. Authorizes an attachment against the property of a debtor who has been referred by the Department of Corrections to the Attorney General (instead of who is a defendant in a suit brought by the Attorney General) in connection with the reimbursement of the Department for the expenses of the debtor's incarceration.
Amends the School Code. Provides that parents are encouraged to have their children undergo vision examinations at the same points in time required for health examinations. Provides that the Department of Public Health shall require that individuals conducting vision screening tests give a child's parent or guardian written notification, before the vision screening is conducted, that states that vision screening is not a substitute for a complete eye and vision evaluation by an eye doctor and that the child is not required to undergo the vision screening if an optometrist or ophthalmologist has completed and signed a report form indicating that an examination has been administered within the previous 12 months.
Amends the Adoption Act. Provides that the exception to the requirement of consents or surrenders for adoption for a person found by the court to be the father of the child as a result of criminal sexual abuse or assault applies when the sexual abuse or assault results in (i) a founded, cleared, or suspended police report, (ii) an indicated report of child sexual abuse as defined in the Abused and Neglected Child Reporting Act that involved sexual penetration of the mother, or (iii) a sworn affidavit provided by a licensed psychologist or a licensed social worker.
Amends the Illinois Municipal Code concerning sewer systems, except in counties with more than 250,000 inhabitants where the majority of the municipal system users are located outside the municipality. Amends the Sanitary District Revenue Bond Act. Authorizes discontinuance of water service or sewerage service, or both, to a premises within a sanitary district when payment of the rate or charge for sewerage service to the premises has become delinquent. States that the provider of sewerage service shall not request discontinuation of water service before sending a notice of the delinquency to the sewer user and affording the user an opportunity to be heard. Provides that an investor-owned public utility providing water service within a municipality may contract with the municipality to discontinue water or sewer service to enforce delinquent sewer charges. Provides that a municipality or sanitary district shall reimburse a water service provider for any lost water service revenues and the costs of discontinuing water service and shall indemnify the water service provider for any judgment and related attorney's fees resulting from an action based on provisions authorizing discontinuance of water service. Makes the Sanitary District Revenue Bond Act applicable to the North Shore Sanitary District.
Amends the Wireless Emergency Telephone Safety Act. Defines "wireless enhanced 9-1-1" to mean the ability to relay the telephone number of the originator of a 9-1-1 call and location information from any mobile handset or text telephone device accessing the wireless system to the designated wireless public safety answering point as set forth by an order of the Federal Communications Commission. Removes a provision including in the definition of "wireless enhanced 9-1-1" the ability to relay the location of the cell site or base station receiving a 9-1-1 call.
Creates the Boards and Commissions Act of 2003. Contains only a short title provision.
Amends the Department of Human Services Act and the Mental Health and Developmental Disabilities Administrative Act. Requires the Department of Human Services to contract with an entity experienced in applied research to compile a cross-disability database of disabled Illinois residents who are potential beneficiaries under the "most integrated setting" requirement of the Americans with Disabilities Act as construed by the U.S. Supreme Court. Requires the Secretary of Human Services to appoint a panel to advise the Department on the compilation. Requires the Department to collect and maintain statistical information on developmentally disabled persons who have requested and are waiting for community based services financed by the Department. Effective immediately.
Amends the Metropolitan Water Reclamation District Act. Adds a Section concerning district enlargement. Contains only a Section caption. Effective immediately.
Amends the State Finance Act. Provides that, on March 31, 2003 or as soon as practicable thereafter, the amount of $300,000 shall be transferred from the Statistical Services Revolving Fund to the Illinois Military Family Relief Fund. Provides that, beginning on July 1, 2004, on the last day of each month, an amount equal to 50% of that day's beginning balance in the Illinois Military Family Relief Fund shall be transferred from the Illinois Military Family Relief Fund to the Statistical Services Revolving Fund. Provides that these transfers shall continue until the cumulative total of transfers executed from the Illinois Military Family Relief Fund to the Statistical Services Revolving Fund equals $300,000. Effective immediately.
