SB 78: NURSES-LIC BY ENDORSEMENT

Amends the Nursing and Advanced Practice Nursing Act. Provides that an applicant for licensure by endorsement who is a registered professional nurse or a licensed practical nurse under the laws of another state or territory of the United States may, in lieu of taking and passing the examination required by the Department, have passed a state, regional, or national examination that is substantially equivalent to or more stringent than the examination given by the Department, if the applicant has actively practiced nursing in another state or territory of the United States for 2 of the preceding 3 years without having his or her license acted against by the licensing authority of any jurisdiction. Effective immediately.

SB 630: HEARING INSTRUMT-CONTINUING ED

Amends the Hearing Instrument Consumer Protection Act. Provides that no more than 5 hours of continuing education credit per year can be obtained through programs sponsored by hearing instrument manufacturers. Effective immediately.

HB 3072: CRIM-CD-DANGEROUS PLACE

Amends the Criminal Code of 1961. Creates the offense of use of a dangerous place for the commission of a controlled substance or cannabis offense. Provides that a person commits the offense if: (i) the person knowingly exercises control over a place with the intent to commit a specified controlled substance or cannabis offense and (ii) the place presents a substantial risk of injury from fire, explosion, or exposure to toxic or noxious chemicals or gas or the place contains or is surrounded by devices, chemicals, or explosives in a manner creating a substantial risk of great bodily harm. Provides that violation is a Class 1 felony.

SB 64: MEDICAID-DISEASE MANAGMT PILOT

Amends the Illinois Public Aid Code. As part of the Medicaid program, provides that the Department of Public Aid may undertake a pilot project to study patient outcomes, for patients with certain chronic diseases, associated with the use of disease management programs and services for chronic condition management. Provides that these amendatory provisions are repealed 10 years after the effective date of the amendatory Act.

SB 884: TELCO CONTRACT FILING ICC

Amends the Telecommunications Article of the Public Utilities Act. Authorizes the filing of a tariff by a telecommunications carrier pursuant to which the carrier may enter into contracts with individual customers for the provision of competitive services. Provides that only notice of the contract need be filed with the Commission (now the contract must be filed). Effective immediately.

HB 136: VEH CD-POLICE VEHICLE SALES

Amends the Illinois Vehicle Code. Provides that, before ownership of a police vehicle is transferred to any person or entity other than a law enforcement agency, any marking identifying the vehicle as a police vehicle must be removed completely.

HB 1630: DHS-IDPA-TEENS-FAMILY PLANNING

Amends the Department of Human Services Act. Authorizes the Department to establish a Hispanic/Latino Teen Pregnancy Prevention and Intervention Initiative program. As a part of the program, authorizes the Department to award a grant to a qualified entity for the purpose of conducting research, education, and prevention activities to reduce pregnancy among Hispanic teenagers. Amends the Illinois Public Aid Code. Provides for Medicaid coverage of family planning services for persons whose income is less than 200% of the federal poverty level.

HB 264: AGRICULTR-PRODUCER PROTECT ACT

Creates the Agriculture Producer Protection Act. Requires agriculture production contracts to contain certain disclosures, meet readability guidelines, and include a summary sheet. Provides that the Director of Agriculture may review an agriculture production contract for compliance with the contract form and content requirements of the Act. Provides that provisions stating that information contained within an agricultural contract is confidential shall not prevent a producer from discussing all contract terms and details with specified persons. Places restrictions on a contractor's unilateral termination of certain contracts. Provides that it is unlawful for any contractor to interfere with the exercise of certain rights granted under the Act and establishes other unfair practices under the Act. Provides that any provision requiring the application of the law of any state other than Illinois, requiring any action to be filed in a state other than Illinois, or waiving a right or obligation under the Act, is void. Provides that the Attorney General shall enforce the Act by actions in the circuit court for equitable and monetary relief, including injunctive relief and criminal and civil fines and penalties. Provides a private cause of action to any producer aggrieved by a violation of the Act and includes as remedies contract reformation and other equitable relief for the purpose of avoiding unjust enrichment. Amends the Freedom of Information Act to exempt production contracts submitted for review to the Director of Agriculture under the Agriculture Producer Protection Act. Provides that the Department of Agriculture must adopt rules implementing the Agriculture Producer Protection Act not later than January 1, 2004 and gives this and the effective date provision an immediate effective date. Provides that the remainder of the Act takes effect on January 1, 2004.

SB 265: CRIM CD-MONEY LAUNDERING

Amends the Criminal Code of 1961. Provides that theft of property in excess of $500,000 is a Class X felony (rather than a Class 1 felony). In the money laundering statute, provides that any property expressly or impliedly represented to be property constituting or derived from proceeds obtained, directly or indirectly, pursuant to a violation of the Criminal Code of 1961, the Illinois Controlled Substances Act, or the Cannabis Control Act is criminally derived property. Provides that laundering criminally derived property in excess of $500,000 is a Class X felony (rather than a Class 1 felony). Effective immediately.

SB 15: VIDEOTAPED INTERROGATIONS

Amends the Criminal Code of 1961. Exempts from an eavesdropping violation, electronic recordings made of a custodial interrogation of an individual by a law enforcement officer at a police station or other place of detention in investigations for homicide and certain sex offenses. Amends the Code of Criminal Procedure of 1963 and the Juvenile Court Act of 1987. Provides that statements made by a suspect at a custodial interrogation at a police station or other place of detention in investigations for homicide and certain sex offenses are presumed inadmissible unless electronically recorded. Provides that the presumption may be overcome by a preponderance of the evidence that the statements were voluntary and reliable based upon the totality of the circumstances. Provides exceptions. Amends the Illinois Police Training Act. Provides that the Illinois Law Enforcement Training Standards Board must conduct a training program for police officers on the methods and technical aspects of electronic recording of interrogations. Amends the Illinois Criminal Justice Information Act. Provides that the Illinois Criminal Justice Information Authority, from appropriations made to it for that purpose, shall make grants to local law enforcement agencies for the purpose of purchasing equipment for electronic recording of interrogations. Amends the State Mandates Act. Exempts provisions of the bill from the reimbursement requirements of the State Mandates Act. Some provisions take effect immediately.

SB 1586: OPEN MEET-VERBATIM RECORD

Amends the Open Meetings Act. Requires public bodies to make and maintain audio or video recordings of their closed meetings. Provides procedures for (i) protecting privileged communication during a meeting between the public body and its attorney and (ii) summarizing and destroying the recordings. Extends the statute of limitations on meetings in violation of the Act to 180 days. Effective immediately.
