Amends the Criminal Code of 2012. Modifies the offense of unauthorized video recording and live video transmission to also include unauthorized photographing. Provides that it is unlawful for any person to knowingly make a video record or transmit live video of or photograph another person in a courtroom or any location inside of a State courthouse without that person's consent or judicial authorization. Provides that a violation is a Class 4 felony or a Class 3 felony if the victim is a person who is a victim or witness in a criminal case and is present in court in his or her capacity as a victim or witness. Provides that it is unlawful for any person to place or cause to be placed a device that makes a video record or transmits live video or photographs another person in a courtroom or any location inside of a State courthouse without that person's consent or judicial authorization. Provides that a violation is a Class A misdemeanor. Defines "courthouse".
Amends the Environmental Protection Act. In provisions regarding environmental laboratory certification assessment, repeals provisions establishing the Environmental Laboratory Certification Committee and deletes references to the Committee.
Amends the Code of Criminal Procedure of 1963 and the Illinois Domestic Violence Act of 1986. Provides that a person commits the crime of violation of an order of protection under the Criminal Code of 1961 or the Criminal Code of 2012 if the person, in violation of an order to surrender the person's firearms and firearm parts, knowingly transfers a firearm or firearm parts to the respondent or otherwise allows the respondent access to a firearm or firearm parts. Provides that, if the law enforcement agency seeks to correct or negate the warrant for the seizure of the respondent's firearms and firearm parts, it shall take reasonable steps to notify the petitioner before appearing before the court. Makes technical changes.
Amends the Adult Education Act and the Public Community College Act. With respect to the annual report on adult education for the preceding school year by the Illinois Community College Board, removes the requirement to include a summary of State reimbursement for adult basic education, adult secondary education, English language acquisition, high school credit, integrated English literacy and civics education, and bridge and integrated education and training programs in coordination with vocational skills training. Provides that any public community college district maintaining adult educations classes for the instruction of those persons who, among other requirements, are 17 (rather than 16) years of age or older are entitled to claim an apportionment of State reimbursement. Allows classes in adult education to include digital literacy. Removes language providing that the maximum generation rate for reimbursement per credit hour or per unit of instruction shall be equal to the community college system reimbursement rate for adult education divided by one-third. Provides that State adult education funds, other than matching funds, are not subject to the authorizing federal law. Removes language providing that approved programs for adult education may assess students up to $6 per credit hour or unit of instruction per semester per student. Removes language requiring an education plan to be established for each adult learning participating in the instructional programs. Requires each adult learner participating in the instructional programs to complete an assessment of foundational skills to appropriately place the adult learner in an instructional program. Makes other and conforming changes.
Amends the Recyclable Metal Purchase Registration Law. Provides that it is a violation of the Act for any person to possess, purchase, attempt to purchase, sell, or attempt to sell, or for any recyclable metal dealer to purchase or attempt to purchase, telecommunications wire in any amount unless the seller is an authorized agent, a representative or employee of a licensed contractor of a public utility, a provider of telecommunications services, as described in the Public Utilities Act, or a provider of broadband service, interconnected VoIP services, or wireless services, as described in the Public Utilities Act. Provides that the Recyclable Metal Theft Task Force shall review the effectiveness of its efforts in deterring and investigating the problem of recyclable metal theft specific to telecommunications wires, burned wire, and any other equipment used to provide (i) telecommunications services, as described in the Public Utilities Act, or (ii) broadband service, interconnected VoIP services, or wireless services, as described in the Public Utilities Act. Provides that the Task Force shall consider and develop long-term solutions, both legislative and enforcement-driven, for the rising problem of theft of these wires and equipment in this State. Provides that the Task Force shall be composed of one representative of a wireless telecommunications carrier. Provides that the Task Force shall, by October 31 of each year, report its findings and recommendations to the General Assembly and the Governor. Changes the definition of the term "recyclable metal". Defines the terms "burned wire" and "telecommunications wire".
Amends the Jury Act and the Jury Commission Act. Requires employers to compensate employees at the employee's regular rate of pay for time that the employee served on jury duty.
Repeals Public Act 103-653, which authorized the Adjutant General to convey certain real property in Franklin County, Illinois. Effective immediately.
Amends the Nurse Practice Act. Provides that, in order to protect the public and ensure safe and adequate health care services, if the Department of Financial and Professional Regulation finds that any person licensed or authorized to practice under the Act was not properly credentialed pursuant to the standards required at the time of application, the Department may temporarily suspend the person's license or authorization to practice without prior hearing until the Department receives satisfactory evidence of the licensee's overall qualifications. Provides that the Department shall notify the licensee of the temporary suspension at the licensee's address of record or email address of record. Provides that the licensee may request that the Board review the validity of the license within 30 days after the service of the notice and shall submit written evidence in support of the licensee's qualifications with the request for review. Provides that the licensee may seek an extension of time to provide such evidence, during which the suspension shall remain in effect. Provides that the Board, at its next regularly scheduled meeting, shall review the request and any written evidence provided by the licensee and make a final recommendation regarding the licensee's qualifications to the Director of the Division of Professional Regulation of the Department. Provides that, based upon the Board's final recommendation, the Director of the Division of Professional Regulation may issue an order withdrawing the license due to the licensee's lack of qualifications or lift the suspension of the license by stipulating terms and conditions of practice. Provides that withdrawal of the license alone shall not constitute discipline or be a bar to licensure if the licensee makes a subsequent reapplication that meets the qualifications under the Act. Provides that disciplinary proceedings may also be initiated pursuant to the Board's recommendation or Department findings and shall be conducted in the same manner as other disciplinary proceedings under the Act. Sets forth rulemaking authority for the Department.
Amends the Township Code. In a provision that authorizes a township board to provide for the cutting of weeds or grass, the trimming of trees or bushes, the removal of nuisance bushes or trees, or the maintenance of a retention pond or detention pond on any real estate in areas within the township, specifies that the required 7-day advance notice to the property owner may be served by certified mail, by personal service, or by posting the notice on the property in a prominent location.
Amends the Emergency Medical Services (EMS) Systems Act. In provisions concerning when EMS personnel may contact Online Medical Control or an EMS Medical Director or Emergency Communications Registered Nurse to request bypass or diversion of the closest emergency department and request transport to the closest or appropriate EMS System-approved mental health facility, removes the requirement that the patient must not be under the influence of drugs or alcohol.
Amends the Pharmacy Practice Act. Provides that every licensed pharmacy directly serving patients at a physical location shall conspicuously post a sign provided by the Department of Human Services that contains the following: (i) a statement that the Department of Human Services runs a Suicide and Crisis Lifeline; (ii) the Lifeline number; and (iii) any other information the Department of Human Services deems appropriate. Provides that the sign shall be printed in color ink or displayed electronically in color, measure at least 8.5 x 11 inches in size, and be posted at either a cashier counter or a waiting area that is clearly visible to patients. Requires licensed pharmacies that do not maintain a physical location that directly serves patients to include a copy of the sign with any dispensed prescriptions. Provides that the sign shall also be available to download on the Department of Human Services's website.
Amends the Unified Code of Corrections. Provides that the rules and regulations of the Department of Corrections shall also provide that sentence credit may be provided to an inmate who was held in pretrial detention prior to his or her current commitment to the Department of Corrections and successfully completed a substance abuse program (rather than a full-time, 60-day or longer substance abuse program), county jail or detention facility work assignments, or parenting program, or re-entry planning facilitated (rather than provided) by the county department of corrections, county jail, or other provider. Provides that the rules and regulations shall also provide that sentence credit may be provided to a committed person who participated in supervised community work or activities in accordance with the Code prior to his or her commitment to the Department of Corrections.
