ACCESSORY DWELLING UNITS – Amends and adds to existing law to revise provisions regarding prohibitions against restrictive covenants banning accessory dwelling units and to establish provisions regarding accessory dwelling units in the Local Land Use Planning Act.
What changed between versions
The deadline for cities to amend comprehensive plans and land use regulations was extended from October 1, 2026, to February 1, 2027.
The exemption from mandatory ADU rules was expanded to include properties designated as historic properties pursuant to section 67-4614, Idaho Code.
Parking restrictions for accessory dwelling units now include exceptions if the primary dwelling lacks off-street parking, the street is unpaved, or the dwelling is within 1/4 mile of transit, employment, or commercial services.
The rule allowing one internal or one detached ADU was clarified to permit detached units in the rear yard or subject to the primary dwelling's setbacks.
Rules governing internal accessory dwelling units were updated to require architectural design consistent with the primary dwelling.
