CRISIS RESPONSE FOR PERSONS WITH A NEUROCOGNITIVE DISORDER – Amends existing law to revise provisions regarding placing certain persons in protective custody without a hearing.

This Idaho bill (S 1120) changes rules for temporarily placing people with neurocognitive disorders (such as dementia) in protective custody without a court order. It allows police or hospitals to detain someone only if they pose an immediate danger to themselves or others due to their condition, but requires a court review within 24 hours. The person must be examined by a healthcare provider within 24 hours, and if not dangerous, they must be released. A court hearing must occur within 5 days, and they cannot be held in facilities used for criminal detention. The law takes effect July 1, 2025.
