Idaho's H 244 creates a state-managed list of electronic smoking device brands prohibited from sale in the state, based on federal FDA actions like warning letters or seizures. The list, published by July 1, 2025, includes brands where FDA identified products as adulterated or misbranded, excluding exempted products like FDA-approved devices or older nicotine-containing products. Starting September 1, 2025, retailers cannot sell listed brands, with penalties including $5,000 fines per violation and permit suspensions for repeat offenses. The law also allows seizure of prohibited devices without a warrant and mandates monthly updates to the list and exemption rules.
