HB 1741: RELATING TO HOUSING.

Deems a county inclusionary mandate as a form of development exaction and treats the mandate as a housing affordability impact fee. Provides parameters for a county's adoption or amendment of an inclusionary mandate for residential or mixed-use development. Establishes additional components for a needs assessment study for a county-imposed inclusionary mandate. Conditions the adoption or amendment of a county inclusionary mandate for residential or mixed-use development on written findings of essential nexus and rough proportionality and a determination of financial feasibility. HB 1870: RELATING TO PROTECTED COMMUNITY LOCATIONS.

By 1/1/2027, requires all state and county agencies that operate protected community locations to adopt and post written policies that identify nonpublic areas, establish procedures for warrant verification and staff response, prohibit the collection of certain immigration-status data, and require annual staff training and certain multilingual notices. HB 2049: RELATING TO HOUSING.

Restructures the conveyance tax to a marginal rate system for the sale of properties with residential use, adjusts the tax for multifamily properties to reflect value on a per-unit basis, and applies a cost-of-living adjustment to conveyance tax rates. Allocates revenues from conveyance tax collections. Allocates a portion of conveyance tax collections to the Dwelling Unit Revolving Fund to fund infrastructure programs in areas that meet minimum standards of transit-supportive density. Allocates a portion of conveyance tax revenues to the Hawaii Agricultural Development Revolving Fund, Special Land and Development Fund, and Hawaiian Home Lands Infrastructure and Housing Special Fund. Establishes and appropriates funds out of the Hawaiian Home Lands Infrastructure and Housing Special Fund. Authorizes the Hawaii Agricultural Development Revolving Fund to be used to acquire land. SB 3011: RELATING TO PUBLIC HOUSING.

Requires the Hawaii Public Housing Authority to allow any resident of a public housing project or state low-income housing project to keep one or more pet animals in the resident's unit, subject to applicable state laws, county ordinances, and any reasonable conditions. Prohibits pet animals from being at-large on public housing premises. Provides that the Hawaii Public Housing Authority may charge a refundable deposit for each pet animal but shall not impose a monthly pet fee or pet rent. Allows the Hawaii Public Housing Authority to remove a vicious animal to protect persons or property. Establishes positions. Appropriates funds. Effective 7/1/3000. (HD1)

SB 3231: RELATING TO AGRICULTURAL DISTRICTS.

Requires condominium maps for lands within an agricultural district to include a letter signed by an appropriate county official or agency certifying that the condominium property regime will conform to county zoning laws. Requires an application for registration of a project in an agricultural district larger than ten acres to include certain additional information. Effective 7/1/2050. (SD1)

SB 534: RELATING TO THE HAWAII COMMUNITY DEVELOPMENT AUTHORITY.

Clarifies the process by which the Hawaii Community Development Authority may approve residential development on certain parcels of Kakaako Makai. Raises the building height limit and the maximum floor area ratio on certain parcels in the area. Requires a certain percentage of the residential units developed on certain parcels to be allocated to households at or below a certain income level in perpetuity, with priority given to certain essential workforce in the area. Limits the sale of residential units developed in certain residential developments to prospective owner-occupants. Requires the Office of Hawaiian Affairs to determine a Kakaako Makai association fee to be collected from residents, tenants, and lessees of certain parcels to be deposited into a special account in the Office of Hawaiian Affairs Special Fund to fund various services and projects in the Kakaako Makai area.
