Expands workers' compensation medical benefits for firefighters to include coverage for adenocarcinoma or mesothelioma of the respiratory system; cancer of the buccal cavity, colon, pharynx, and thyroid; and malignant melanoma. Specifies that an employer may prove that the cancer or disease was not associated with the firefighting duties to deny medical benefits under workers' compensation law. Effective 7/1/3000. (HD1)
Expands the scopes of practice for occupational therapists, physical therapists, and speech pathologists to allow those professionals working for or contracted by the Department of Education to diagnose medical conditions that can be treated with their respective services.
Requires the Department of Health to establish and implement a program to improve and increase support for emergency medical services in the State. Requires the Department of Health to submit reports to the Legislature. Appropriates funds.
Requires any person applying to the Department of Health to contract or extend or renew a contract to operate certain residential treatment programs to, as a condition of the contract, obtain and maintain a general liability insurance policy with a certain minimum coverage amount; submit to the Department for review and approval a community safety action plan; and provide to the community association or neighborhood board in the community in which the program will operate a written notice of the program's establishment and location and the community safety action plan.
Appropriates funds to the Department of Human Services to achieve full funding status, including estimated payment increases, of Medicaid home- and community-based services.
For policies, contracts, plans, and agreements issued or renewed after 12/31/2026, requires insurers, mutual benefit societies, and health maintenance organizations to provide coverage for standard fertility preservation services for persons undergoing medically necessary treatment that may cause iatrogenic infertility. Authorizes a physician, upon consultation with a minor patient who indicates that the minor was the victim of a sexual offense, with the consent of the minor patient, to perform customary and necessary examinations to obtain evidence of the sexual offense and may prescribe for and treat the patient for any immediate condition caused by the sexual offense. Provides that the consent of the parent, parents, or legal guardian of a minor offender who has been committed to the Hawaii youth correctional facilities is not necessary in order to authorize hospital, medical, mental health, dental, emergency health, or emergency surgical care.
Ensures the protection and promotion of the health and well-being of all infants born alive in the State. Mandates medically appropriate and reasonable life-saving and life-sustaining medical care and treatment to all born alive infants. Establishes civil and criminal penalties.
Authorizes the Hawaii Medical Board to issue an active retired clinician license to retired physicians, osteopathic physicians, and surgeons with inactive Hawaii medical licenses to provide volunteer clinical work through community-based health care or public health organizations.
Requires the Hawaii Employer-Union Health Benefits Trust Fund Board of Trustees to negotiate with health insurance carriers to ensure that 12% of monthly premium payments are paid directly to primary care providers. Requires the Department of Human Services Med-QUEST Division to allocate 12% of monthly premium payments directly to primary care providers.
