Proposes a constitutional amendment to ensure that the inherent and inalienable right of the people, including future generations, to clean water and air, a healthful environment and climate, healthy native ecosystems, and beaches, shall be protected and shall not be infringed.
Beginning 7/1/2027, requires newly installed or modified individual wastewater systems that are near the shoreline or on highly porous soils to include denitrification capacity. Requires the Department of Health to reduce requirements for disposal systems connected to wastewater systems with denitrification capacity. Effective 7/1/3000. (HD1)
Preserves, as state law, water quality, permitting, and aquatic resource protections that are at least as protective as federal Clean Water Act regulations and standards in effect as of January 1, 2026, and ensures their continued applicability regardless of subsequent federal amendments, repeals, or reductions.
Defines "isolated wetlands" and "wetlands". Clarifies the definition of "state waters" to include wetlands and isolated wetlands. Requires the Director of Health to determine all wetlands in the State, including whether a wetland is an isolated wetland or is included in the waters of the United States. Prohibit persons from discharging any water pollutant into or at any location that enters state waters.

Expands the duties and powers of the Department of Health that relate to water quality and water quality testing to ensure the safety and health of Hawaii's residents. Appropriates funds.
Requires newly installed or modified individual wastewater systems that are near the shoreline, or likely to pollute groundwater, to include denitrification capacity.
Requires a landowner in possession of ten thousand or more acres in the State to be liable for damages and fines arising from runoff originating on the land and entering into state waters. Requires the Department of Health to prioritize enforcement of water pollution control regulations in rural areas where there are existing reports of runoff and other terms of water pollution. Requires the Department of Education to establish a statewide Environmental Stewardship Curricula Plan for public schools for certain students. Beginning with the 2027-2028 school year, requires public schools to offer an environmental stewardship course for certain students. Requires the Department of Education to establish and administer sustainability programs, including recycling and composting programs, to be implemented at public schools. Beginning 7/1/27, prohibits the use or distribution of single-use plastic utensils, trays, straws, and other disposable plastic food service products in public school cafeterias. Beginning 7/1/28, requires each public school to have at least one operational refillable water bottle filling station accessible to students and staff. Requires reports to the Board of Education and the Legislature. Appropriates funds.
