Appropriates moneys to the Department of Health for the development and implementation of the Comprehensive Watershed-based Water Quality Monitoring Pilot Program for the Waikele Watershed. Requires report to the Legislature. Appropriates moneys to the Division of Aquatic Resources of the Department of Land and Natural Resources for mangrove removal and shoreline and stream maintenance in the Nineteenth Senatorial District and nearby areas, including the West Loch and Middle Loch shorelines. Authorizes the Attorney General to bring a civil action in the name of the people of the State as parens patriae against any responsible party to recover certain costs or obtain certain relief, including costs and losses incurred by the Hawaii Hurricane Relief Fund, or other state entities, resulting from climate attributable harm or costs for risk of future climate attributable harm. Authorizes the Hawaii Property Insurance Association and Hawaii Hurricane Relief Fund, or any private insurer licensed in the State to bring a civil cause of action against a responsible party to recover its costs and losses resulting from climate attributable harm. Establishes the Climate Disaster Special Fund to collect and disperse funds collected from certain civil actions to be distributed in a certain order of priority. Effective 7/1/2050. (SD1)
Beginning 1/1/2027, prohibits the sale, possession, or use of a pesticide containing one or more neonicotinoid pesticides, under certain conditions. Requires the Department of Agriculture and Biosecurity to evaluate the potential impacts of and adopt any necessary control measures for neonicotinoid pesticide use on pollinating insects, native migratory and resident birds, aquatic organisms, and human health. Reestablishes the Agricultural Development and Food Security Special Fund. Establishes the Carbon Emissions Tax and Dividend Special Fund. Gradually increases the Environmental Response, Energy, Carbon Emissions, and Food Security tax rates and establishes a refundable carbon cashback tax credit to offset increases for most taxpayers. Requires reports to the Legislature. Appropriates funds.
Recognizes watersheds and coral reef ecosystems as legal persons with inherent and inalienable rights to exist, flourish, and naturally evolve. Establishes enforceable ecosystem rights grounded in public trust doctrine and Native Hawaiian customary stewardship. Authorizes citizen enforcement, restorative and injunctive remedies, civil penalties, and continuing duties of ecological repair, including for historic harms. Provides for open representation, community consultation, co-governance, and supremacy over conflicting laws.
Classifies neonicotinoid pesticides as restricted use pesticides and establishes a list of chemicals that shall belong to the neonicotinoid class of chemicals. Prohibits the sale or use of seeds coated or treated with neonicotinoid pesticides. Requires the Department of Agriculture to adopt rules that identify and regulate the most harmful neonicotinoid pesticide formulations and develop guidelines for safer alternatives.
