SB 2047: RELATING TO PHARMACY BENEFIT MANAGERS.

Establishes certain requirements for pharmacy benefit managers, other than health maintenance organizations that own and operate their own pharmacies, that reimburse contracting pharmacies for drugs on a maximum allowable cost basis. Allows contracting pharmacies to reverse and rebill claims if a maximum allowable cost is denied on appeal. Authorizes the Insurance Commissioner to assess fines for violations. Appropriates funds. HB 1645: RELATING TO LIABILITY.

Provides certain liability protections for nonprofit child welfare service organizations that are under contract with the Department of Human Services to provide child welfare services to children and families. Prohibits contracts between nonprofit child welfare service organizations and the State from including indemnification and hold harmless provisions and from requiring either party to name the other as an additional insured in their respective liability insurance policies. Prohibits pre- and post-judgment interest and punitive damages for nonprofit child welfare service organizations. Requires actions against nonprofit child welfare service organizations to be tried by the court, except in certain circumstances. Removes joint and several liability for nonprofit child welfare service organizations. Specifies that no bond shall be required from a nonprofit child welfare service organization on appeal. Effective 1/30/2050. (SD1)

HB 1590: RELATING TO VACATION RENTALS.

Part I: Allows counties to use time-stamped screenshots as evidence for the enforcement of transient accommodations. Requires the Hawaii Tourism Authority's plans, practices, and efforts involving destination management to include promotion of use of traditional or lawful transient accommodations. Clarifies that the counties may use revenue from the County Transient Accommodations Tax for the enforcement of transient accommodations. Appropriates funds. Part II: Requires hosting platforms that earn service fees for providing booking services for transient accommodations to register with the Department of Taxation as tax collection agents and report, collect, and remit general excise and transient accommodations taxes on behalf of operators. SB 2948: RELATING TO INSURANCE FRAUD.

Prohibits certain solicitation and inducement practices relating to insurance claims. Establishes disaster-related insurance fraud offenses. Broadens the scope of the offense of insurance fraud and the acts that constitute insurance fraud. Clarifies the penalties for the offense of insurance fraud and the capabilities and operations of the Insurance Fraud Investigations Branch, including the annual report to the Legislature and the use of fraud analytics. Reiterates protections for insurance fraud whistleblowers. Appropriates funds. Effective 7/1/3000. (HD2)

SB 2944: RELATING TO CONSERVATION.

Requires the Board of Land and Natural Resources to adopt rules that implement wildlife viewing guidelines that substantially conform to the wildlife viewing guidelines issued by the National Oceanic and Atmospheric Administration. Requires annual reports to the Legislature until rules are adopted. Effective 7/1/3000. (HD1)
