HB 1087: RELATING TO INSURANCE.

Updates Hawaii Revised Statutes title 24 by: changing the dollar amount of the benefits, recovery, or compensation obtained or attempted to be obtained for a class C felony, and misdemeanor; requiring insurers seeking a certificate of authority to submit a Uniform Certificate of Authority Application to the Insurance Division and to clarify that the insurer's name must comply with sections 431:3-202(b) and 431:4-104(d)(1); including application and service fees charged to motor vehicle self-insurers; allowing the Insurance Commissioner to issue a declaration before an event that may require the use of nonresident adjusters; complying with the National Association of Insurance Commissioners' Producer Licensing Model Act; allowing third-party claimants to claim the general excise tax and certificate of ownership fee in total loss claims; requiring that certain costs and expenses incurred by the Insurance Commissioner during supervisory proceedings be paid or reimbursed by the assets of the insurer; and making technical, nonsubstantive amendments for clarity and consistency. SB 1169: RELATING TO THE LOW-INCOME HOUSING TAX CREDIT.

Specifies that certain provisions of the Internal Revenue Code related to at-risk rules and deductions and to passive activity loss do not apply with respect to claims for the state low-income housing tax credit. Appropriates funds to establish one position in the Hawaii Housing Finance and Development Corporation to oversee the Low-Income Housing Tax Credit Program.

SB 1297: RELATING TO AWARDED FEDERAL EMERGENCY MANAGEMENT AGENCY HAZARD MITIGATION GRANT.

Appropriates $75,000 to DAGS for the State Building Code Council to update the state building code. Requires the reimbursement from the Federal Emergency Management Agency hazard mitigation grant for the appropriated funds. (SD1)

HB 1549: RELATING TO INCLUSIONARY ZONING.

Provides that a county shall not impose an inclusionary zoning requirement on a housing development offered exclusively for sale to buyers earning 120% or less of the area median income. (HB1549 HD1)

HB 1241: RELATING TO MORTGAGE SERVICERS.

Reduces mortgage loan servicer licensing fees and relicensing fees for nonprofit organizations. Exempts nonprofit organizations and their employees, who are already exempt from licensure and registration as mortgage loan originators, from regulation as mortgage loan servicers. Requires a report to the Legislature. (HB1241 HD1)

SB 153: RELATING TO POLICE REPORTS.

Allows surviving immediate family members of murder or manslaughter victims to access a copy of the closing report prepared by the investigating police department, upon the conclusion of all criminal and civil proceedings that arose from the offense. (SD1)

SB 1159: RELATING TO MEDICAL MARIJUANA.

Establishes the Office of Medical Marijuana Administration in DOH to administer marijuana dispensary licensing and regulation, and patient registration. Limits each location used to cultivate marijuana to use by five qualifying patients. Authorizes primary caregivers to cultivate marijuana for qualifying patients until December 31, 2020. Extends civil service exemptions. Extends interim rulemaking authority. Authorizes an alternate medical marijuana dispensary tracking system for use when the DOH computer tracking system in nonfunctional and requires DOH to report to the legislative oversight working group. Adds considerations for establishing marijuana testing standards and selecting additional dispensary licensees. Allows DOH to consider whether existing dispensary licensees shall be allowed to increase plant count, increase the number of production centers, or increase the number of retail dispensing locations. Requires retention of video security recordings of production centers and dispensaries for not less than 45 days. Effective 7/1/2050. (SD1)

SB 466: RELATING TO THE PER-PUPIL FUNDING SYSTEM FOR PUBLIC CHARTER SCHOOLS.

Requires the Legislative Reference Bureau to conduct a study on the non-facility general fund per-pupil funding system for public charter schools, to determine whether the system fulfills its statutory purpose of equalizing operational funding among the State's public schools. Authorizes the Legislative Reference Bureau to enter contracts for services to conduct the study. Makes an appropriation. (SD1)

HB 246: RELATING TO CHAPTER 245, HAWAII REVISED STATUTES.

Imposes an excise tax on e-liquid sold by a wholesaler or dealer. Requires retailers engaged in the retail sale of cigarettes, tobacco products, electronic smoking devices, or eliquid to obtain a retail tobacco permit. Increases the license fee for wholesalers or dealers of these products. Increases the retail tobacco permit fee for retailers of these products. Effective January 1, 2018. (HB246 HD1)
