Adds an exception to the department of health home care agency licensing requirements for medicaid waiver provider agencies providing services to medicaid waiver participants. (CD1)
Amends the false claims statute, section 661-21(a), Hawaii Revised Statutes, to increase civil monetary penalty minimum and maximum amounts to maintain consistency with federal law so that the State can continue to maximize its recoveries in cases where state money is taken illegally and False Claims Act prosecution is successful. Amends various portions of the Hawaii Insurance Code under title 24, Hawaii Revised Statutes, to update and improve existing Insurance Code provisions. Establishes requirements for proposed name changes and use of a trade name or assumed name, effective 10/1/2019. Until 7/1/2024, allows the Insurance Division to create stopgap measures to implement the NAIC Health Benefit Plan Network Access and Adequacy Model Act. (CD1)
Amends the definitions of "dependent-beneficiary" and "employee-beneficiary" as used in the Hawaii Employer-Union Health Benefits Trust Fund, chapter 87A, Hawaii Revised Statutes. Clarifies the eligibilities of surviving children to receive benefits. Updates references related to marriage to account for civil unions in interpreting who is a "dependent-beneficiary" and "employee-beneficiary". (CD1)
