Protecting American Energy Production Act This bill prohibits the President from declaring a moratorium on the use of hydraulic fracturing unless Congress authorizes the moratorium. The bill also expresses the sense of Congress that states should maintain primacy for the regulation of hydraulic fracturing for oil and natural gas production on state and private lands.
Coronavirus Containment Corps Act This bill requires the Centers for Disease Control and Prevention (CDC) to develop, within 21 days, a nationwide contact tracing strategy for COVID-19 (i.e., coronavirus disease 2019) that addresses issues including workforce needs. To implement that strategy, the bill establishes grant programs in the CDC and the Indian Health Service (IHS). It also expands programs in the Department of Labor. The CDC must award grants to state and local health departments to, among other purposes, hire and train individuals for contact tracing positions and related roles. The IHS must award similar grants to tribes and tribal organizations. Additionally, Labor must award grants for states and other jurisdictions to support recruitment and employment of dislocated workers and other individuals in public health roles. Grants and contracts that include contact tracing in their scope of work must comply with prevailing wage requirements that apply to federal service contracts. Employees who work under such grants or contracts must receive similar compensation to that prevailing in the locality where work is performed. The CDC and Labor must report certain information on specified timelines, and the Government Accountability Office must evaluate the activities of grantees.
Voter Integrity Protection Act This bill imposes additional immigration-related penalties for aliens who vote in an election for federal office. It shall be an aggravated felony for an alien who is unlawfully present to violate an existing prohibition against an alien voting in a federal election. (An aggravated felony conviction carries various immigration consequences, such as rendering the alien inadmissible, deportable, and barred from establishing good moral character for naturalization.) An alien who is unlawfully present and who knowingly violates the prohibition against voting in a federal election shall be deportable.
Thin Blue Line Act This bill expands the list of statutory aggravating factors in death penalty determinations to also include killing or targeting a law enforcement officer, firefighter, or other first responder.
Fund and Complete the Border Wall Act This bill establishes funding for a U.S.-Mexico border barrier and revises how border patrol agents are compensated for overtime. The Department of the Treasury shall set up an account for funding the design, construction, and maintenance of the barrier. The funds in the account are appropriated only for that purpose and for vehicles and equipment for border patrol agents. For each fiscal year, financial assistance to a country shall be reduced by $2,000 for each citizen or national of that country apprehended for illegally entering the United States through its southern border. The reduced amount shall be transferred to the border barrier account. The Department of State may opt not to reduce amounts appropriated to Mexico for various military and law enforcement-related activities. This bill establishes a 5% fee on foreign remittance transfers and increases the fee for the arrival/departure I-94 form for various aliens entering the United States, with part of the fees to go into the border barrier account. By December 31, 2021, DHS shall (1) take all actions necessary, including constructing barriers, to prevent illegal crossings along the U.S.-Mexico barrier; and (2) achieve operational control over all U.S. international borders. The bill changes how border patrol agents receive overtime pay when working up to 100 hours in a two-week period. For hours worked above 80, an agent shall receive at least 150% of the agent's regular hourly rate.
Grant's Law This bill requires the Department of Justice to detain any alien found to be unlawfully present in the United States and arrested for various crimes that would render the alien deportable or inadmissible. The Department of Homeland Security (DHS) may release the alien to an appropriate authority for proceedings related to the arrest, but DHS must resume custody for any period that the alien is not in such authority's custody. If the alien is not convicted of crimes for which the alien was arrested, DHS must continue to detain the alien until removal proceedings are completed. DHS must complete such removal proceedings within 90 days.
Gun Trafficking Prohibition Act This bill establishes stand-alone criminal offenses for trafficking in firearms and straw purchasing of firearms. The bill expands the categories of prohibited persons (i.e., persons barred from receiving or possessing a firearm or ammunition) to include persons who intend (1) to sell or transfer a firearm or ammunition to a prohibited person, (2) to sell or transfer a firearm to further a crime of violence or drug trafficking offense, or (3) to unlawfully export. It increases the maximum prison term for the (1) sale or transfer of a firearm to a prohibited person, or (2) receipt or possession of a firearm by a prohibited person. The bill revises the existing prohibition on transferring a firearm knowing that it will be used to commit a crime of violence or drug trafficking offense. Specifically, it broadens the scope of unlawful conduct covered by the prohibition and increases the maximum prison term for a violator. Similarly, the bill revises the existing prohibition on smuggling a firearm into the United States with the intent to unlawfully import or to promote a crime of violence or drug trafficking offense. It broadens the scope of unlawful conduct and increases the maximum prison term for a violator. Finally, the bill makes it a crime to smuggle a firearm or ammunition out of the United States, or conspire or attempt to do so, with the intent to unlawfully export or to promote a crime of violence or drug trafficking offense.
Birthright Citizenship Act of 2021 This bill limits birthright citizenship by redefining what it means to be subject to the jurisdiction of the United States. Currently, a person born in the United States and subject to U.S. jurisdiction is entitled to citizenship. Under the bill, a person is subject to U.S. jurisdiction if he or she is born to a parent who is (1) a U.S. citizen or national, (2) a lawful permanent resident residing in the United States, or (3) an alien performing active service in the Armed Forces. The bill does not affect the citizenship or nationality status of any person born before the bill's enactment date.
Mental Health Access and Gun Violence Prevention Act of 2021 This bill authorizes FY2022 appropriations for the Department of Justice, the Department of Health and Human Services, and the Social Security Administration to (1) increase access to mental health care treatment and services, and (2) promote reporting of mental health information to the National Instant Criminal Background Check System.
Federal Death Penalty Abolition Act of 2021 This bill prohibits the imposition of a death penalty sentence for a violation of federal law. It eliminates statutory authority for the death penalty as a sentencing option for federal offenses. It also requires a person who was sentenced to death before enactment of this bill to be resentenced.
Jurists United to Stop Trafficking Imitation Child Exploitation Act of 2021 or the JUSTICE Act of 2021 This bill broadens the prohibition on importation or transportation of obscene materials. Specifically, the bill makes it a crime to import, or knowingly use a common carrier or interactive computer service to transport, a child sex doll.
Hearing Protection Act This bill removes silencers from the definition of firearms for purposes of the National Firearms Act. It also treats persons acquiring or possessing a firearm silencer as meeting any registration and licensing requirements of such Act. The Department of Justice must destroy certain records relating to the registration, transfer, or making of a silencer. The bill also revises the definitions of firearm silencer and firearm muffler under the federal criminal code and includes such items in the 10% excise tax category.
