HIV Prevention Justice Act; Citing this act as the “HIV Prevention Justice Act”; reducing the degree of criminal penalty for certain persons who are infected with human immunodeficiency virus (HIV) and who donate blood, plasma, organs, skin, or other human tissue for use in another person; revising prohibitions relating to the intentional transmission of certain diseases through sexual conduct; revising requirements for HIV testing in cases involving criminal transmission of HIV, etc.
Gift Certificates; Revises definition of term "gift certificate"; removes provisions authorizing expiration of gift certificates under specified circumstances.
Bingo Games; Revises requirements to manufacture, issue, & operate instant bingo tickets; requires that instant bingo ticket dispensers have certain features.
Condominium Structural Integrity Reserve Studies; Defining the term “structural integrity reserve study”; requiring condominium associations that govern a building of a specified height to conduct a structural integrity reserve study for a specified purpose; providing that condominium associations that govern a building that does not meet such specified height requirement are not required to conduct a structural integrity reserve study; authorizing certain condominium associations to elect, by a majority vote of their members, to waive or reduce reserve contributions; providing construction, etc.
Interactions with Artificial Intelligence; Requires operators of companion chatbot platforms to display specified information on any application, browser, or format used to access companion chatbots on platform & to prevent such chatbots from engaging with users unless specified protocols are maintained; requires such operators to verify age of users & to take specified actions for users who are minors; requires such operators to file specified reports with DLA; provides that violation constitutes unfair or deceptive act or practice; provides for civil actions.
Gift Certificates; Revising the definition of the term “gift certificate”; deleting provisions authorizing the expiration of a gift certificate under specified circumstances, etc.
Civil Remedies Pertaining to Abortions; Defines "clawback provision" & "family member"; creates cause of action for certain violations relating to induction or performance of abortion; provides applicability; authorizes injunctive relief, recovery of damages, & reasonable costs & attorney fees; provides limitation; creates separate cause of action against person who has initiated certain foreign state proceedings; provides that court may protect privacy of certain persons.
Compounded Drugs; Defining the term “compounded medication”; prohibiting any person or entity from engaging in the sale, transfer, or distribution of compounded medications for weight loss unless they provide specified documentation to the Department of Business and Professional Regulation; providing administrative penalties, etc.
Medical Use of Marijuana; Authorizes patient prescribed certain opioid drugs to qualify to receive marijuana or marijuana delivery device; requires qualified physician to conduct in-person or telehealth examination before issuing or renewing certification; requires qualified physician to submit certain documentation to Board of Medicine or Board of Osteopathic Medicine for patients prescribed certain opioid drugs; revises supply limits qualified physician may issue & frequency of patient evaluations required for issuance of new physician certification; revises penalties; requires medical marijuana use registry ID cards to be renewed biennially rather than annually; requires DOH to establish processes & procedures for issuance & registration of medical marijuana use registry ID cards for certain nonresidents; authorizes visiting qualified patients to engage in in all conduct authorized for qualified patient; requires waiver of certain fees for honorably discharged veterans.
Landscape Irrigation; Prohibits certain actions regarding landscape irrigation systems unless such actions are taken by licensed irrigation contractors or property owners; authorizes local governments or water management districts to adopt certain requirements for property owners who install such systems; provides requirements for permits, plans, equipment & capacity, maintenance, & water schedules relating to such systems; provides fines & penalties; prohibits local governments from adopting or enforcing certain laws, rules, or regulations; authorizes DEP to adopt rules; revises membership of Construction Industry Licensing Board.
Community Association Management; Requiring certain community associations to contract with a community association management firm or a community association manager certified by the Community Association Managers International Certification Board as a Certified Manager of Community Associations or by the Community Associations Institute as an Association Management Specialist or a Professional Community Association Manager; requiring the community association management firm or certified community association manager to possess all applicable licenses, etc.
Water Management; Prohibiting counties and municipalities from adopting laws, regulations, rules, or policies relating to water quality or quantity, pollution control, pollutant discharge prevention or removal, or wetlands; preempting such regulation to the state; repealing a provision relating to land management review teams, etc.
