Health Care; Terminates Welfare Transition Trust Fund within DOH; revises provision relating to contribution by residents of certain health care facilities; revises certain provisions & dates relating to AHCA's responsibilities under Medicaid program; requires nursing homes to annually submit to AHCA financial data; authorizes agency to receive certain funds to make Low Income Pool Program payments; requires certain providers to contract with managed care plans as condition of receiving certain funding; requires Secretary of Health Care Administration to make certain certifications to Governor & Legislature; provides for type two transfer of Florida Correctional Medical Authority to DOH.
Community Associations; Exempting certain property association pools from Department of Health regulations; providing requirements for a parcel owner to remove a discriminatory restriction from a covenant or restriction; revising requirements relating to the posting of digital copies of certain documents by certain condominium associations, etc.
Public Records and Public Meetings/Applicants for President/State University or Florida College System Institution; Providing an exemption from public records requirements for any personal identifying information of an applicant for president of a state university or Florida College System institution; providing an exemption from public meeting requirements for any portion of a meeting held for the purpose of identifying or vetting applicants for president of a state university or Florida College System institution, including any portion of a meeting that would disclose identifying information of such applicants; providing for future legislative review and repeal of the exemptions; providing a statement of public necessity, etc.
Public Accountancy; Requiring certain applicants to not be licensed in any state or territory in order to be licensed by endorsement; providing license renewal requirements for nonresident licensees; requiring that a majority of the hours required for continuing education include specific content; authorizing certain Florida certified public accountants to apply to the Department of Business and Professional Regulation to have their license placed in a retired status; providing that retired licensees are not required to maintain continuing education requirements, etc.
Practice of Pharmacy; Creates collaborative pharmacy practice agreement between pharmacist & physician; requires agreements to be appropriate to training & scope of practice of pharmacist & physician; requires maintenance of records & specified pharmacists to report certain diseases of public health significance to DOH; authorizes pharmacists to test for & treat influenza & streptococcus; provides requirements for written protocol between pharmacist & supervising physician.
Coverage for Air Ambulance Services; Requires health insurers & health maintenance organizations to provide reasonable reimbursement to air ambulance services for certain covered services; provides that such reimbursement may be reduced only by certain amounts; provides that payment in full of copayments, coinsurance, & deductibles by insureds & subscribers constitutes accord & satisfaction & release of specified claims in connection with air ambulance services.
Deregulation of Professions and Occupations; Citing this act as the “Occupational Freedom and Opportunity Act”; requiring the Department of Highway Safety and Motor Vehicles to waive the requirement to pass the Commercial Driver License Skills Tests for certain servicemembers and veterans; deleting the requirement that a yacht broker maintain a separate license for each branch office; specifying that the failure to repay certain student loans is not considered a failure to perform a statutory or legal obligation for which certain disciplinary action can be taken; revising licensure requirements for engineers who hold specified licenses in another state, etc.
Direct Care Workers; Requiring a licensed home health agency that authorizes a registered nurse to delegate tasks to a certified nursing assistant or a home health aide to ensure that certain requirements are met; requiring home health aides to complete annual inservice training in medication administration and medication error prevention, in addition to existing annual inservice training requirements; creating the Excellence in Home Health Program and the Nurse Registry Excellence Program, respectively, within the agency for a specified purpose; requiring the agency to adopt rules establishing program criteria, etc. APPROPRIATION: $5,789,297
Brevard and Volusia Counties; Creates Deering Park Stewardship District; provides charter; requires referendum.
Probation Violations; Requiring a court to modify or continue a probationary term upon finding that a probationer has met all specified conditions, rather than any of the conditions, after a violation of probation, etc.
Lake County; Authorizes mobile home owner's association to assess capital contribution fee of specified amounts under certain circumstances; requires certain closing documents of a cooperative unit to include as a line item the capital contribution assessment.
Florida Commission on Human Relations; Revising quorum requirements for the Commission on Human Relations and its panels; revising the number of persons the commission must recommend for the Florida Civil Rights Hall of Fame; deleting a requirement that a facility or community that provides housing for older persons register with and submit a letter to the commission; deleting the requirement for the commission or Attorney General to investigate a complaint of discrimination in evaluating an application for club membership, etc.
