Prosecution of Defendants; Revising the qualifications for an insanity defense; updating reporting requirements for examining experts; revising requirements for dismissal of charges; requiring involuntary commitment for persons found not guilty by reason of insanity in certain circumstances; revising mitigating circumstances for sentencing, etc.
Clerks of the Court; Requiring the clerk to retain certain funds or deposit the funds into the fine and forfeiture fund; authorizing the Florida Clerks of Court Operations Corporation, on behalf of the clerks, to submit a request for reimbursement to reimburse the clerks for filing certain petitions, orders, appeals, and summons; authorizing the clerk to be reimbursed for certain fees and charges, etc.
Arrest and Search Warrants; Authorizing a judge to issue an arrest warrant or issue a summons or a notice to appear in lieu of an arrest warrant under specified circumstances if a complaint alleges only the commission of a misdemeanor offense; authorizing, rather than requiring, a trial court judge to issue a summons under specified circumstances when a complaint is for a misdemeanor that the trial court judge is not empowered to try summarily; expanding the circumstances under which an arrest by an officer without a warrant is lawful to include when there is probable cause to believe that a person has committed a criminal act in violation of an injunction for protection against stalking or cyberstalking or has committed an act that constitutes driving under the influence or boating under the influence, etc.
Big Cypress Basin ; Revises membership of Big Cypress Basin governing board; requires SFWMD to revise boundaries of Big Cypress Basin based on specified study & ensure that distribution of basin ad valorem taxes be used for specified projects & flood control operations & maintenance.
Complaints Against Law Enforcement and Correctional Officers; Requiring that a copy of a complaint, signed by the complainant under oath, be provided to law enforcement officers and correctional officers who are under investigation before any interrogation begins; providing that complainant names and signatures are not required if a complaint is accompanied by corroborating evidence; prohibiting certain personnel actions from being taken against a law enforcement officer or correctional officer unless such officer receives a copy of the complaint signed by the complainant under oath, etc.
Office of the Department of Corrections Ombudsperson; Creating the Office of the Department of Corrections Ombudsperson within the Department of Corrections; establishing the Corrections Oversight Committee; authorizing the office to subpoena department records, employees, or contractors; requiring the office to conduct periodic inspections of department facilities; requiring the office to create an electronic family form and make it available on the office’s public website for a specified purpose, etc. APPROPRIATION: $1,500,000
Enforcement of School Attendance; Requiring district school boards to implement a mandatory alert system within specified systems or platforms to notify certain persons when a student reaches the truancy threshold for absences, etc.
Information Technology Procurement and Contracting; Providing that the Bureau of Enterprise Project Management and Oversight is within the Florida Digital Service; requiring the Florida Digital Service to manage certain contracts, report certain information to specified parties annually, and adopt certain rules; creating the Bureau of Enterprise Project Management and Oversight within the Florida Digital Service; providing contract requirements for certain information technology commodities and services, etc.
Child Welfare; Revises definition of term "harm" to provide that exposure of child to controlled substance may be established by evidence of acute or chronic use of controlled substance by parent to specified extent; revises definition of term "neglect" to provide that neglect occurs when there is evidence of acute or chronic use of controlled substance by parent to specified extent.
Recovery Residence Accountability and Protection Act; Citing this act as the “Recovery Residence Accountability and Protection Act of 2025”; revising legislative findings; requiring any person, entity, or organization that owns, operates, or manages a recovery residence to obtain and maintain certification through the Department of Children and Families; deleting a requirement that the certification program is voluntary; deleting obsolete language; specifying the criteria for active management of a recovery residence, etc.
Office of the Corrections Ombudsman; Creating the Office of the Corrections Ombudsman within the legislative branch; requiring the Legislature to establish a Corrections Oversight Committee on or before a certain date; requiring the Department of Corrections to provide the Ombudsman and committee members with access to certain department facilities and records; requiring confidentiality of in-person communications between incarcerated persons or facility staff members and the Ombudsman or a committee member, etc. APPROPRIATION: $250,000
Public Records/State Attorney’s Office and Office of Statewide Prosecution Nonlegal Support Staff; Defining the term “state attorney’s office or Office of Statewide Prosecution nonlegal support staff”; providing an exemption from public records requirements for the personal identifying and location information of current state attorney’s office and Office of Statewide Prosecution nonlegal support staff and the spouses and children of such staff; providing for future legislative review and repeal of the exemption; providing a statement of public necessity, etc.
