Gubernatorial Transition; Requires Governor to designate transition liaison within EOG within specified timeframe; provides duties of transition liaison; requires head of each state agency to designate agency transition liaison within specified timeframe; provides duties of agency transition liaisons; requires DMS & each state agency to provide certain temporary office facilities to certain persons during transition period; requires DMS, upon request, to provide Governor-elect & his or her staff with information technology & related services for such transition period; requires Governor-elect to designate in writing staff to be provided with such services; requires specified persons to sign certain memorandum of understanding; requires each state agency, upon request, to provide Governor-elect & his or her staff with access to agency leadership personnel during transition period; authorizes state agencies to assign limited personnel to assist Governor-elect & his or her staff; requires that Governor-elect & his or her staff be granted access to all state agency records upon request; requires that Governor-elect & persons designated by Governor-elect be granted access to confidential & exempt records under certain conditions; provides criminal penalties.
Use of Substances Affecting Cognitive Function; Requires medical examiners to take specified actions when performing autopsy on decedent who is violent offender; requires that autopsy reports for such individuals include certain findings & information; requires notification of certain findings & information to FDLE, DOH, & AHCA; authorizes release of certain patient records to law enforcement agencies without patient authorization; requires school safety specialists to provide school district staff with certain training on adverse effects of specified substances; specifies requirements for training; requires safe-school officers to complete certain training on adverse effects of specified substances; specifies requirements for training.
Admissibility of Evidence in Civil Cases ; Revises provisions relating to evidence that is admissible to demonstrate past & future medical expenses in personal injury & wrongful death actions.
Respiratory Care Interstate Compact; Creates Respiratory Care Interstate Compact; provides purpose & objectives; requires member states to meet certain requirements to join & participate in compact; provides criteria that licensee must satisfy to practice under compact; provides requirements for renewal of equivalent license in member state; authorizes active military member & his or her spouse to be deemed as having home state license; requires member states to report adverse actions taken against license of occupational therapist or occupational therapy assistant by other member states; establishes Respiratory Care Interstate Compact Commission; provides for jurisdiction & venue for court proceedings; provides membership, duties, & powers; requires member states to participate in exchange of specified information; authorizes commission to adopt rules & bylaws; provides for development, maintenance, & use of coordinated database & reporting system; requires member states to submit specified information to data system; provides requirements for information in data system; provides rulemaking procedures; provides for state enforcement of compact; provides for termination of compact membership; provides procedures for resolution of certain disputes.
Presumption Against Liability for Owners and Principal Operators of Multifamily Residential Properties; Prohibits owner or principal operator of multifamily residential property from receiving presumption against liability if certain number of specified crimes were reported to have occurred at property to owner or principal operator within specified timeframe.
Temporary Cash Assistance Eligibility; Provides that benefits may not be denied to certain individuals solely on basis of drug trafficking conviction.
Sexually Transmissible Diseases; Citing act as “HIV Prevention Justice Act”; reduces degree of criminal penalty for certain persons who are infected with human immunodeficiency virus (HIV) & who donate blood, plasma, organs, skin, or other human tissue for use in another person; revises prohibitions relating to intentional transmission of certain diseases through sexual conduct; provides that person’s failure to comply with behavioral recommendations does not de facto establish intent to transmit a disease; revises requirements for HIV testing in cases involving criminal transmission of HIV.
My Safe Florida Condominium Pilot Program; Revises eligibility requirements for My Safe Florida Condominium Pilot Program; requires DFS to adopt rules to verify household income; authorizes condominiums with mixed-income occupancies to participate in pilot program; requires application for mitigation grant to include documentation to verify household income; limits award of grant funds; requires association to complete certain percentage of opening protection improvements.
Health Insurance Claims; Expanding the scope of the statewide provider and health plan claim dispute resolution program to include resolution of denied prior authorization requests; providing that participation in the program is mandatory and prohibiting providers and health plans from opting out of the claim dispute resolution process; prohibiting contracts between certain physicians and health insurers and health maintenance organizations, respectively, from specifying credit card payments to physicians as the only acceptable method for payments; authorizing use of electronic funds transfers by health insurers and health maintenance organizations, respectively, for payments to physicians under certain circumstances, etc.
Charter Schools; Authorizing Florida College System institutions and state universities to sponsor job engine charter schools; requiring that specified tax funds be provided annually to the sponsor of a job engine charter school, etc.
Residential Living Arrangements; Provides purpose & duties of community residence; requires that community residence be licensed or certified, or operate pursuant to charter from entity recognized or sanctioned by Congress; authorizes local government to revoke or nullify siting approval of community residence; provides spacing distance requirements for siting of community residence; requires local government to authorize reasonable accommodation for certain proposed community residences if specified requirements are met; requires sponsoring entity to notify designated local government official or other applicable entity within specified timeframe that its license or certification has been revoked or denied; authorizes local government to require sponsoring entity of recovery community to immediately cease operations if continued operation poses immediate & significant threat to health & safety of residents or community; requires local government to respond in writing within specified timeframe to requests regarding whether proposed community residence or recovery residence is within certain spacing distance from certain other residences.
Regulation of Public Swimming Pools and Bathing Places; Providing that, notwithstanding an exemption from supervision or regulation, certain pools are subject to annual inspections by the Department of Health to ensure compliance with specified standards; providing the Public Swimming Pool and Spa Technical Committee with the sole authority to review and approve certain variances; requiring certain department and county health department employees to obtain the Florida Public Pool Specialist Certification within a specified timeframe; deleting a certain advisory review board and replacing it with the Public Swimming Pool and Spa Technical Committee, etc.
