Health Care Services Jurisdiction and Reimbursement; Provides that health insurance, health maintenance organization coverage, health plan coverage, & travel insurance providers are subject to jurisdiction of courts of this state under certain circumstances; prohibits health care providers from collecting & attempting to collect from patients any sums owed by insurers & HMOs for emergency services rendered; authorizes nonparticipating health care providers to pursue causes of action for quantum meruit for specified purpose.
Housing; Removes preemption provisions relating to rent control; authorizes municipalities & counties to create community land bank programs & provides requirements for such programs; authorizes tax credit for certain projects; provides maximum value of such credit; authorizes FHFC to allocate tax credit among certain projects; requires certain agencies to provide report to Legislature relating to use of specified funds; requires DFS to adopt home resiliency grading scale with certain requirements; provides requirements for creation of certain program; establishes Innovation Mitigation Solutions Pilot Program within DFS; allows mortgage lenders & property insurers to submit certain proposals; authorizes DFS to waive or develop certain rules; creates Retail-to-residence Tax Credit Program & provides requirements for such program; creates Affordable Housing Construction Loan Program & provides requirements for such program; provides that certain actions are violation of Florida Antitrust Act of 1980; revises powers of consumer advocate appointed by CFO; specifies that failure to obey certain court orders may be punished as contempt; prohibits OIR from approving certain rate filings; prohibits certain business entities from purchasing, acquiring, or otherwise obtaining certain property & subsequently leasing or renting such property; requires certain property be listed for sale for specified timeframe; requires specified notice; authorizes civil actions by OAG.
Educational Facilities; Revises provisions related to educational facilities, including duties of DOE relating to educational facilities of school districts & Florida College System institutions; school district educational facilities plan performance & productivity standards; State Requirements for Educational Facilities; inspection of specified educational & ancillary plants; district school board requirements; requirements related to state uniform building code for public educational facilities construction; remodeling projects; & Special Facility Construction Committee..
Pharmacy Audits; Revises requirements for audits of licensed pharmacies conducted by or on behalf of pharmacy benefit plans or programs; revises audit procedures, documentation requirements, recoupment limits, & reporting & appeal requirements; provides procedures for conducting audits of fraud, waste, or abuse; provides for enforcement; authorizes OIR to impose fines & other administrative penalties; authorizes suspension or revocation of pharmacy benefit manager's registration; requires FSC to adopt rules.
Business Development Incentives for Veterans and Military Spouses; Authorizing the Department of Revenue to provide specified state tax information to the Department of Veterans’ Affairs and the Department of State under a specified condition; creating the “Florida Veterans and Military Spouses Business Development Act”; requiring the Department of State to waive all fees for certain businesses; requiring the Department of Veterans’ Affairs to establish registration requirements for businesses seeking certain fee waivers and tax exemptions; providing annual reporting requirements, beginning on a specified date, etc.
Guardianship; Requires that order appointing guardian identify persons entitled to certain information upon incapacitated person's death; authorizes that order appointing guardian identify persons entitled to notice if incapacitated person is transferred to medical facility & persons entitled to visit incapacitated person; authorizes guardian to restrict ability of minor ward to maintain certain contacts in certain circumstances; authorizes guardian to restrict ability of adult ward to maintain contact with person in certain circumstances; requires guardian to provide ward with notice of change in residential setting in certain circumstances; requires guardian to provide notice to any person identified in order of appointment.
Surrogacy and Assisted Reproduction; Provides & revises requirements for preplanned adoption agreements, surrogacy contracts, & informed consent; requires security background investigations of specified parties; requires donor banks, fertility clinics, & surrogacy agencies to be licensed or certified; requires certain entities & persons to develop best practice policies & submit such policies to specified entity; requires specified material be labeled & records maintained for specified timeframe; requires AHCA & DCF to conduct annual inspections; provides for administrative penalties & corrective action plans; requires certain parties undergo mental & medical evaluations; requires surrogacy agencies maintain escrow accounts & provides requirements for such accounts & escrow agents; requires DCF maintain list of certified surrogacy agencies; authorizes certain parties to petition court to validate surrogacy contract & for expedited affirmation of parental status; authorizes deletion of certain names from certain court documents; requires certain notice; provides requirements if court denies affirmation of parentage; requires AHCA, DOH, & DCF to adopt rules.
Building Permit Requirements; Provides that certain residential manufactured buildings may not be denied building permit for placement of such building; prohibits local government from adopting certain technical amendments to FBC; prohibits local enforcement agency from requiring building permit for work valued at specified amount; prohibits project from being divided into multiple projects; requires building permit for certain work regardless of value of work; requires contractor to maintain certain written records; prohibits local enforcement agency from requiring building permit for specified work on backup power system installed by certain persons or entities; requires local enforcement agencies to establish specified process to submit certain notice before installation of backup power system; prohibits local governments from adopting or enforcing certain ordinances, rules, or other measures; authorizes local enforcement agency to conduct one inspection, either in person or virtually; authorizes use of private provider for certain inspections; requires local enforcement agency to provide certain persons written notice of correction; authorizes stop-work order under specific circumstances; requires local enforcement agency to offer reinspection date within certain time period; provides that private provider inspection report constitutes acceptance; prohibits local enforcement agency from withholding or revoking certificate of occupancy based solely on failed inspection report.
Pub. Rec./State Attorney and Office of Statewide Prosecution Nonlegal Support Staff; Provides exemption from public records requirements for personal identifying & location information of current state attorney & Office of Statewide Prosecution nonlegal support staff & spouses & children of such nonlegal support staff; provides for legislative review & repeal of exemption; provides for retroactive application of exemption; provides statement of public necessity.
Big Cypress Basin ; Revises membership of Big Cypress Basin governing board; requires SFWMD to revise boundaries of Big Cypress Basin based on specified study & ensure that distribution of basin ad valorem taxes be used for specified projects & flood control operations & maintenance.
Child Welfare; Revises definition of term "harm" to provide that exposure of child to controlled substance may be established by evidence of acute or chronic use of controlled substance by parent to specified extent; revises definition of term "neglect" to provide that neglect occurs when there is evidence of acute or chronic use of controlled substance by parent to specified extent.
HB 1353 revises Florida's legal definitions of "harass" and "cyberstalk" to clarify what constitutes these offenses. The bill defines "harass" as repeated actions causing serious emotional harm with no legitimate purpose, and "cyberstalk" as using electronic communication or unauthorized access to online accounts to cause such harm. These updated definitions will apply to existing laws banning religious/ethnic harassment and school bullying, ensuring consistent terminology. The changes take effect on July 1, 2026.
