Liability of Advanced Driving System Manufacturers and Developers; Defining the term “advanced driving system”; providing a limitation on the liability of a manufacturer or developer of an advanced driving system for certain damages, injuries, claims, or losses; authorizing punitive damages only under certain circumstances, etc.
Electronic Payment Processing Fees for Motor Vehicle Purchases; Authorizes holders of retail installment contracts & their agents to collect fees for processing payments made by motor vehicle retail buyers under certain circumstances.
Property Insurance Affiliates ; Requires insurers to provide to OIR documentation demonstrating that financial considerations & payments to affiliates are fair & reasonable; requires office to consider certain factors to determine whether such considerations & payments are fair & reasonable; requires compensation arrangements between insurers & affiliates to be structured as fees for service; requires insurers to submit, & office to review, audited financial statements; requires contracts between insurers & affiliates to contain certain provisions; authorizes office to issue orders restricting fund transfers from insurers to affiliates under certain circumstances; requires affiliates to make certain refunds under certain circumstances; provides authority of office over affiliate dividends; requires affiliates to register with office.
Insurer Disclosures on Prescription Drug Coverage; Requiring individual and group health insurers to provide notice of prescription drug formulary changes within a certain timeframe to current and prospective insureds and the insureds’ treating physicians; requiring insurers to maintain a record of formulary changes; defining the term “cost-sharing requirement”; providing an exception to requirements relating to changes in a health maintenance organization’s group contract, etc.
Expenditure of Public Funds by Local Governments; Prohibits local governments from expending public funds for specified purposes; prohibits acceptance of public funds from local governments for lobbying; authorizes filing of complaints with Commission on Ethics alleging violations; requires commission to investigate & provide report of its findings to certain entities; requires commission to adopt rules.
Security of State Information Technology Systems; Requiring state agencies to deploy certain cloud-native cybersecurity platforms; requiring the state chief information officer to brief legislative committees on specified information by a specified date, etc.
Insurance Claims Payments to Health Care Providers; Prohibits payment adjudicators from downcoding health care services under certain circumstances; requires health insurers to ensure that their downcoding policies are updated & to ensure compliance with specified provisions on downcoding; authorizes investigations & actions against noncompliance; provides certain presumption in favor of physicians' determination regarding patients' diagnoses & service orders; provides calculations of interests on health insurers' nonpayment & underpayment due to downcoding; provides causes of action for health care providers; prohibits utilization review entities from implementing new requirements, restrictions, & changes on prior authorizations under certain circumstances; provides requirements for adverse determinations made by such entities on health care providers' claims; revises requirements & timeframes for responses from health insurers & HMOs to submitted claims.
State Economic Development Contracts; Provides short title; defines; requires employer to sign agreement with Department of Commerce before becoming eligible for economic development incentive; specifies provisions of agreement; provides applicability; authorizes persons & entities to report suspected violation to department within specified timeframe; requires department to determine whether violation has occurred; requires department to deliver written notice to Attorney General; requires Attorney General to request certain information from employer alleged to be in violation; requires Attorney General to initiate proceedings to recover funds awarded to employer if employer is found to have violated agreement; provides that department's findings are final; requires department to execute separate written agreement with recipient of economic development incentive before department awards incentive; specifies contents of separate agreement; provides effective periods of separate agreement.
Coverage for Orthotics and Prosthetics Services; Authorizing the Agency for Health Care Administration to authorize and pay for specified orthotics and prosthetics services for Medicaid recipients who are eligible individuals; requiring the agency to seek federal approval and amend contracts as necessary to implement the act; requiring individual health insurance policies; group, blanket, and franchise health insurance policies; and health maintenance contracts, respectively, to provide coverage for specified orthotics and prosthetics services for eligible individuals, etc.
Experimental Treatments for Terminal Conditions and Life-threatening Rare Diseases; Authorizes licensed physicians to prescribe & eligible facilities to administer experimental treatments; requires approval of specified platform or master protocol by institutional review board; requires DOH to establish & maintain patient registry; requires DOH to annually publish specified report; encourages health insurers & health maintenance organizations to provide specified insurance coverage for experimental treatments; authorizes licensed physicians & eligible facilities to receive reimbursement for experimental treatments; requires manufacturers of experimental treatments to provide for specified temporary price concession; requires DOH to adopt by rule certain procedures for licensing of experimental treatment centers.
Homeowners’ Insurance Premium Discounts; Requiring residential property insurers to provide specified premium reductions for claim-free periods and mitigation improvements; prohibiting the use of storm-related claims to deny eligibility for a premium reduction; requiring the Office of Insurance Regulation to adopt rules relating to mitigation upgrades; prohibiting certain claims that are the result of an act of God from being used as a cause for premium discount ineligibility, etc.
