Impact Fees; Provides requirements for coordination mechanisms that are required for certain agreements required as part of intergovernmental coordination element of comprehensive plan; requires that plan-based methodology used for certain interlocal agreements be consistent with certain comprehensive plan requirements; requires that demonstrated-need study use plan-based methodology; prohibits local governments, school districts, & special districts from including certain deductions in certain impact fee increases & from increasing impact fee rates beyond certain phase-in limitations by more than specified percentage; provides that prevailing petitioner is entitled to impact fee overpayment refund, with interest; provides that certain prevailing petitioners are entitled to reasonable attorney fees & costs.
Structure and Legislative Oversight of Executive Agencies; Providing that divisions, offices, bureaus, sections, and subsections in an executive department may be established only by specific statutory enactment; providing that certain appointments made by the Secretary of Business and Professional Regulation are subject to review and approval by the Legislature; providing that certain appointments made by the Secretary of Transportation are subject to review and approval by the Legislature; providing that certain appointments made by the heads of departments are subject to review and approval by the Legislature, etc.
Pharmacy; Revising the definition of the term “health care facility” to include health care clinics owned by a hospital or physicians who work for a hospital; defining the term “covered prescription drug”; revising requirements for provider contracts between pharmacy benefit managers and certain licensed pharmacies to allow for the administration and dispensing of covered prescription drugs offsite, as well as onsite, as part of outpatient care, etc.
HB 4097 repeals three specific chapters of Florida law (71-760, 79-504, and 81-429) that previously governed the Manatee County Free Public Library Act. This procedural bill removes the existing legal framework for the library system without creating new policies or affecting library operations directly.
Perfluoroalkyl and Polyfluoroalkyl Substances; Providing for the ratification of certain rules for cleanup target levels for perfluoroalkyl and polyfluoroalkyl substances (PFAS); requiring the department to adopt interim screening values until the United States Environmental Protection Agency establishes final standards for additional PFAS compounds; prohibiting fire service providers from using certain Class B firefighting foam after a specified date except under certain circumstances, etc.
Pharmacy Audits; Revising requirements for audits of licensed pharmacies conducted by or on behalf of pharmacy benefit plans or programs; revising audit procedures, documentation requirements, reporting and appeal requirements, and recoupment limits and procedures; authorizing the Office of Insurance Regulation to investigate complaints of violations, issue cease and desist orders, impose fines and other administrative penalties, order restitution for improper recoupments, prohibit any person or entity from conducting audits for a specified timeframe upon certain findings, and suspend or revoke a pharmacy benefit manager’s registration under certain circumstances, etc.
Fleet Management; Repealing a provision relating to the purchase or lease of motor vehicles, watercraft, or aircraft and prior approval of the Department of Management Services; authorizing state agencies to purchase vehicles from nonstate term contract vendors under a specified condition; deleting the requirement that the Department of Management Services approve the purchase of motor vehicles for certain departments and agencies; requiring that certain moneys designated or appropriated to agencies be transferred to the department upon services rendered, etc.

Prohibitions Against Discriminatory Practices relating to 340B Entities and 340B Drugs; Prohibits drug manufacturers from engaging in certain acts against acquisitions of 340B drugs by & delivery of such drugs to specified pharmacies & from interfering with pharmacies' rights to contract with 340B entities; prohibits health insurance issuers, PBMs & other third-party payors, & agents, from engaging in discriminatory acts relating to reimbursement to 340B entities for 340B drugs; prohibits health insurers & HMOs from engaging in discriminatory acts relating to reimbursement to 340B entities for 340B drugs; provides that each commission of certain acts constitutes violation of Florida Deceptive & Unfair Trade Practices Act & subjects violator to certain actions & penalties.
Battery Collection and Disposal; Repeals provisions relating to battery requirements for consumers, manufacturers, & sellers; prohibits producers or retailers from selling, offering, or distributing any battery or battery containing product unless certain conditions are met; provides requirements for battery stewardship organizations regarding collection & disposal of batteries & battery containing products; requires DEP to take certain actions regarding plans & data for such collection & disposal; prohibits certain point-of-sale fees; authorizes fee-based battery collection & mail-back service for covered batteries; provides requirements for disposal of batteries beginning on specified date; provides exemption from liability for producers, retailers, & battery stewardship organizations; provides for penalties & civil actions.
Housing; Citing this act as the “Real Affordable Housing Relief Act”; deleting provisions prohibiting municipalities, counties, or other entities of local government from adopting or maintaining certain laws relating to rent control; authorizing counties and municipalities to create community land bank programs for a certain purpose; providing requirements for the sale of certain property to land banks; providing conditions for the subsequent resale of property acquired by land banks; requiring the Department of Financial Services to adopt a home resiliency grading scale for a specified purpose; creating the Affordable Housing Construction Loan Program for a certain purpose, etc.
Joint Resolution/Fish and Wildlife Conservation Commission; Proposing amendments to the State Constitution to declare collective responsibility for certain animal life and to revise the composition of the Fish and Wildlife Conservation Commission and appointments thereto, etc.
