Law Enforcement, Correctional, and Correctional Probation Officer Benefits; Provides that law enforcement, correctional, or correctional probation officer & his or her spouse & dependent children are eligible for certain insurance coverage if officer is injured in line of duty or while engaged in official training exercise.
Removal of Altered Sexual Depictions Posted without Consent ; Defines "covered platform"; requires covered platforms to establish process for removal of altered sexual depictions posted without consent of identifiable person; provides requirements for such process; requires notice; provides immunity for good faith compliance; prohibits unreasonable failure to comply; provides remedies; provides exceptions.
Offenses Involving Children; Provides that ignorance of victim's age, misrepresentation of victim's age, & bona fide belief concerning victim's age are not defenses to certain offenses in which victim's age is an element of offense; provides an exception; revises age of victim involved in luring or enticing offenses; prohibits a person from luring or enticing victim out of a structure, dwelling, or conveyance for other than a lawful purpose, etc.
Services for Individuals with Developmental Disabilities ; Requires Agency for Person with Disabilities to provide list of all qualified organizations located within region where client resides & to post its quarterly reconciliation reports on its website within specified timeframes; requires agency to participate in transition planning activities & to post total number of individuals in each priority category on its website; establishes Statewide Family Care Council; provides duties of agency relating to statewide council & local councils; provides for method of voluntarily choosing to enroll in Medicaid managed care; revises implementation & eligibility requirements of pilot program for individuals with developmental disabilities; provides for method of voluntarily choosing to enroll in pilot program.
Purchase and Possession of Firearms by Law Enforcement Officers, Correctional Officers, Correctional Probation Officers, and Servicemembers; Specifies that correctional probation officers have right to carry concealed firearms during off-duty hours at discretion of superiors; authorizes correctional probation officers to perform certain law enforcement functions under limited circumstances; specifies that correctional probation officer's appointing or employing agency or department may limit officer from carrying concealed firearms during off-duty hours; revises exemptions from mandatory waiting period between purchase & delivery of firearm.
Home Health Care Services ; Revises provisions relating to administrator management; authorizes individuals under contract with home health agency to provide specified services; revises Excellence in Home Health Program criteria requirements.
Veteran and Spouse Nursing Home Beds; Authorizes certain licensed skilled nursing facilities to request to designate or alter designation of certain beds as veteran & spouse nursing home beds if specific criteria are met; authorizes executive director of DVA to approve such requests if specific criteria are met; authorizes DVA to adopt rules; specifies conditions under which certain state veterans' nursing homes or certain licensed skilled nursing facilities are exempt from having to receive certificate of need from AHCA.
Utility Relocation; Requiring that a specified amount of communications services tax remittances be distributed by the Department of Revenue by a nonoperating transfer to the Department of Commerce in monthly installments to the Grants and Donations Trust Fund within the Department of Commerce for the Utility Relocation Reimbursement Grant Program; revising the percentage by which a certain amount transferred into the Local Government Half-cent Sales Tax Clearing Trust Fund must be reduced, beginning on a certain date; authorizing a service provider to apply to the Utility Relocation Reimbursement Grant Program for reimbursement of relocation expenses; creating the Utility Relocation Reimbursement Grant Program within the Department of Commerce; providing the purpose of the program; requiring the Department of Revenue to deposit certain proceeds into a specified trust fund to fund the program beginning on a certain date; providing an appropriation, etc. APPROPRIATION: $50,000,000
Tampering with, Harassing, or Retaliating against Court Officials; Provides criminal penalties for persons who knowingly & willfully threaten specified court personnel, knowingly & willfully harass specified court personnel with certain intent, knowingly with certain intent tamper with court officials, intentionally harass court officials when such harassment has specified outcome, or retaliate against court officials for their participation in official investigations or proceedings.
Spectrum Alert; Requires FDLE, in cooperation with specified agencies, to establish & implement Spectrum Alert; develop training program & alert system for missing children with autism spectrum disorder which is compatible with existing alert systems; specifies requirements for training program. APPROPRIATION: $190,000
Vexatious Litigants; Expands actions subject to Florida Vexatious Litigant Law; revises eligibility for designation as vexatious litigant; revises sanctions & remedies for vexatious litigation; prohibits clerks of court from accepting certain filings from vexatious litigant; specifies duration of automatic stay imposed against vexatious litigation.
Driving and Boating Offenses; Provides enhanced penalties for DUI & BUI manslaughter & vehicular & vessel homicide if person has prior conviction for specified offenses; requires that a person be told that his or her failure to submit to lawful test of breath or urine subsequent to a DUI arrest is either a second degree misdemeanor or a first degree misdemeanor; creates a criminal penalty for a first refusal to submit to a breath or urine test subsequent to a DUI arrest; ranks offenses on offense severity ranking chart of Criminal Punishment Code.
