Fees/Government-Facilitated Purchases and Sales of Individual and Small Employer Health and Dental Plans; Authorizes Florida Health Insurance Exchange to charge assessments & user fees to health carriers & generate funding for specified purpose; requires exchange to publish certain financial information on Internet website.
State Lotteries; Revises information required to be provided to Department of Lottery by persons who submit bid, proposal, or offer to negotiate contract for major procurement; revises bond amount retailer may be required to post for period within which retailer is required to remit lottery funds to department; authorizes division's sworn law enforcement officers to purchase & present lottery tickets to lottery retailer to claim prize; revises certain prohibitions & penalties relating to presenting counterfeit or altered state lottery ticket; prohibits certain false claims relating to state lottery tickets; prohibits lottery retailer from using such position to knowingly facilitate, participate in, or otherwise assist in theft of lottery ticket from retail establishment, patron, or customer; provides criminal penalties.
Trust Funds/Creation/Historic Cemeteries Trust Fund/Department of State; Creates Historic Cemeteries Trust Fund within Division of Historical Resources of DOS; provides purpose of trust fund; requires that moneys be deposited into trust fund & disbursed by division as provided in specified provision; requires that any balance at end of fiscal year remain in trust fund for specified purpose; provides for future review & termination or re-creation of trust fund.
Detection of Developmental Delays and Autism Spectrum Disorder; Requires DOH, in collaboration with school districts throughout this state, to develop informational materials for detection of developmental delays & autism spectrum disorder for parents & guardians of certain students; provides requirements for such informational materials; requires early learning coalitions to notify parents & guardians of availability of such informational materials.
Senate Confirmation of Gubernatorial Appointments and Legislative Approval of Extended States of Emergency; Proposes amendment to State Constitution to require that Senate confirm appointments & removals made by Governor & to require that Legislature authorize extension of state of emergency declared by Governor.
Prohibition on Levying Ad Valorem Taxes on Tangible Personal Property ; Conforms provisions to proposed amendments made to State Constitution which prohibit levying ad valorem taxes on tangible personal property by counties, school districts, & municipalities; removes provisions relating to property appraiser's assessments & effect of determinations by value adjustment boards; repeals provisions relating to extending date for filing tangible personal property tax returns; repeals provisions relating to erroneous returns & estimates of assessment when no return is filed; repeals provisions relating to tax returns to show all exemptions & claims; repeals provisions relating to exemption of renewable energy source devices; repeals provisions relating to exemption for tangible personal property; repeals provisions relating to uncollectible personal property taxes & correction of tax roll; repeals provisions relating to attachment of tangible personal property in case of removal; provides transitional provision.
Food Waste Reduction; Requires DOE to develop specified policy relating to food waste reduction in K-12 schools; provides policy requirements, adoption rates for such policy, & school district requirements.
Protection of the Eastern Gulf Test and Training Range; Prohibits construction, installation, operation, maintenance, or expansion of specified oil & gas facilities on, in, over, or across certain waters & sovereignty submerged lands; prohibits Board of Trustees of Internal Trust Fund, state agencies, water management districts, port authorities, & local governments from issuing leases, easements, rights-of-way, authorizations, & permits for such activities; prohibits award of state grants or financial assistance for such activities; provides for enforcement; provides duties of DEP; provides for injunctive relief & civil penalties.
Local Government Salaries and Benefits ; Revises requirements for board of county commissioners salary formula to apply to noncharter counties; provides for determination of salaries of members of boards of county commissioners of certain counties; requires referendum for board of county commissioners to increase salary, retirement benefits, or other compensation paid to its members; requires referendum election costs to be paid by county; requires referendum for governing body of municipality to increase salary, retirement benefits, or other compensation paid to its members; requires referendum election costs to be paid by municipality; requires referendum for governing body of special district to increase salary, retirement benefits, or other compensation paid to its members; requires referendum election costs to be paid by special district.
Hands-free Driving; Prohibits person who violates careless driving provisions from operating vehicle while using wireless communications device in handheld manner; provides additional penalties for person who violates such provisions & operates vehicle while using such device in handheld manner; authorizes first-time offenders to participate in wireless communications device driving safety program in lieu of imposition of additional penalties; provides exceptions to such prohibition; requires law enforcement officer who stops vehicle for violation of such provisions & finds that operator of vehicle is also using such device in handheld manner to inform vehicle operator of his or her right to decline search of his or her wireless communications device; prohibits such officer from taking certain actions without warrant or consent from vehicle operator; provides that user's billing records for such device or testimony of or written statements from certain authorities are admissible as evidence in crashes resulting in death or serious bodily injury for certain purposes; provides additional fine for person who commits careless driving while using such device in handheld manner; requires deposit of such fine into EMS Trust Fund of DOH.
Preemption to the State; Prohibits counties, municipalities, & special districts, respectively, from substantially burdening free exercise of religion by adopting or enforcing certain ordinances, regulations, resolutions, rules, or other policies; prohibits local enforcement agency from denying issuance of certificate of occupancy to owner of residential or commercial property based on noncompliance with Florida-friendly landscaping ordinances; prohibits local enforcement agency from denying issuance of building permit for alteration, modification, or repair of single-family residential structure; prohibits local enforcement agency from requiring building permit for construction of playground equipment or fence on certain property; prohibits local governments from adopting or enforcing certain ordinances, regulations, resolutions, rules, charter provisions, or other policies or from taking any action to license or otherwise regulate mutual benefit corporations; revises criteria for business to be considered home-based business as it relates to local government regulation of parking.
Restrictions on Local Government Regulations After a Hurricane; Revises circumstances under which certain land use regulations may be enforced; revising persons authorized to bring certain civil actions; requires certain pending applications to be processed in a specified manner.
