Protecting our Students in Schools Act of 2021 This bill prohibits the use of corporal punishment in schools that receive federal funding. Specifically, the bill authorizes the Department of Education (ED) to take specified actions (e.g., withholding funds and issuing cease-and-desist orders) for schools that allow school personnel, law enforcement officers, or school security guards to subject students to corporal punishment. The bill also establishes enforcement provisions, including a private right of action for a student who has been subjected to corporal punishment. Each state educational agency (SEA) that receives federal funding must submit specified information to ED, including a school climate report that describes the SEA's policies and procedures related to exclusionary and aversive discipline practices in schools. Additionally, the bill authorizes ED to award three-year grants to SEAs and, through them, subgrants to local educational agencies to implement positive behavioral interventions and supports to address student behavior and reduce exclusionary and aversive discipline practices. ED must promulgate regulations as necessary to ensure compliance with the bill. The Department of Defense and the Department of the Interior must ensure that the schools they operate or fund also comply with these regulations.

State Accountability, Flexibility, and Equity for Hospitals Act of 2021 or the SAFE Hospitals Act of 2021 This bill alters Medicaid requirements relating to payment for inpatient hospital services that are provided by disproportionate share hospitals (DSHs). (DSHs are hospitals that receive additional payment under Medicaid for treating a large share of low-income patients.) Among other changes, the bill requires state Medicaid programs to adopt a payment methodology that meets certain criteria, including by prioritizing payments based on the DSH tier for which the hospital qualifies; tiers are determined based on factors such as the hospital's Medicaid inpatient utilization rate. The bill also incorporates state poverty ratios (i.e., the number of qualifying low-income individuals in a state compared to all states) into the formula for determining state DSH allotments under Medicaid. The bill phases in application of the revised formula over the course of 10 to 15 years.

At least 15 days before entering a compact, the State Department must submit to Congress a copy of the proposed agreement and related materials. Authority to enter a compact terminates on September 30, 2023, and a compact may last no more than six years. To support the objectives outlined in a compact, the State Department may provide assistance to international organizations, civil society, or other private entities for programs and activities to prevent and respond to domestic and gender-based violence in a compact country. The bill bars the provision of assistance to the government of a compact country as direct budgetary support. The State Department may suspend or terminate the assistance if a compact country or entity receiving the assistance engaged in conduct contrary to U.S. national security interests or inconsistent with the objectives of the compact. The State Department must notify Congress at least 15 days before suspending or terminating assistance. The bill also requires the State Department to annually report on progress made under each compact, including its effect on reported violence against women and children and other domestic and gender-based violence indicators.
