Interagency Committee on Women's Business Enterprise Act of 2021 This bill revises the duties, membership, and reporting requirements of the Interagency Committee on Women's Business Enterprise. These changes include striking a requirement that the committee develop and promote new public sector programs and plans to foster women's business enterprise and, instead, requiring it to monitor the plans, programs, and operations of federal government departments and agencies to identify barriers to new business formation by women entrepreneurs.
State Accountability, Flexibility, and Equity for Hospitals Act of 2021 or the SAFE Hospitals Act of 2021 This bill alters Medicaid requirements relating to payment for inpatient hospital services that are provided by disproportionate share hospitals (DSHs). (DSHs are hospitals that receive additional payment under Medicaid for treating a large share of low-income patients.) Among other changes, the bill requires state Medicaid programs to adopt a payment methodology that meets certain criteria, including by prioritizing payments based on the DSH tier for which the hospital qualifies; tiers are determined based on factors such as the hospital's Medicaid inpatient utilization rate. The bill also incorporates state poverty ratios (i.e., the number of qualifying low-income individuals in a state compared to all states) into the formula for determining state DSH allotments under Medicaid. The bill phases in application of the revised formula over the course of 10 to 15 years.
Critical Supply Chains Commission Act This bill establishes a National Commission on Critical Supply Chains to identify and investigate the dependencies, limitations, and risks associated with critical supply chains. The commission may hold hearings as appropriate and obtain relevant information directly from federal, state, and local governmental bodies as needed. The commission must annually report its findings, conclusions, and recommendations for actions to mitigate the risks of future American supply chain disruptions.
LGBTQ Essential Data Act This bill directs the Centers for Disease Control and Prevention to more frequently collect information on the sexual orientation and gender identity of deceased individuals through the National Violent Death Reporting System.
Protect Speech Act This bill modifies the immunity from liability of a provider or user of an interactive computer service (e.g., a social media company) for screening and blocking offensive content on its platform. Specifically, the bill provides that this immunity shall not apply to any action taken to restrict access to or availability of material provided by another information content provider unless the action is taken in good faith based on an objectively reasonable belief that the material is (1) obscene, lewd, lascivious, filthy, excessively violent, promoting terrorism or violent extremism, harassing, promoting self-harm, or unlawful; or (2) violates the applicable terms of service or use. In order to avoid liability for taking action based on either belief, certain good faith requirements must be met, such as (1) making publicly available terms of service or use that plainly state the criteria for content moderation practices, and (2) not restricting access to or availability of material on deceptive grounds. Further, the bill specifies that being responsible in whole or in part for the creation or development of information includes instances in which a person or entity solicits, comments upon, funds, or affirmatively and substantively contributes to, modifies, or alters information provided by another person or entity.
Pink Tax Repeal Act This bill prohibits product manufacturers or service providers from selling substantially similar products at different prices based on the gender of the intended purchaser. If, for example, the only difference between two products is the color, they are substantially similar. The bill provides authority for the Federal Trade Commission and state attorneys general to enforce these requirements.
This resolution requires an analytical statement to be included in committee reports on whether, and the extent to which, the increased budget authority, outlays, or revenue produced by the enactment of a bill or joint resolution may have an inflationary impact on prices and costs in the operation of the national economy and the purchasing power of low- and middle-income families.
Special Needs Tax Credit Act This bill allows an income-based tax credit, up to $5,000 in a taxable year, for legal expenses paid to establish a legal guardianship of a disabled family member.
Basic Assistance for Students In College Act or the BASIC Act This bill directs the Department of Education (ED) to award planning and implementation grants to institutions of higher education in order to identify and meet the basic needs of students, including food, housing, transportation, and health care. ED must also implement an agreement to (1) share data with other federal agencies in order to identify students who may be eligible for certain federal benefits; and (2) coordinate efforts to enroll those students in federal benefits programs, including Medicaid and the Supplemental Nutrition Assistance Program.
Small Business Credit Protection Act of 2021 This bill establishes requirements related to breaches of data belonging to small businesses. Specifically, a consumer reporting agency must promptly report any breach of nonpublic small business data. In the event of a breach, a consumer reporting agency may not charge a small business for a credit report. Additionally, the Government Accountability Office must report on the economic harm to small businesses resulting from data breaches at consumer reporting agencies.
Saving American History Act of 2021 This bill prohibits the use of federal funds by an elementary or secondary school to teach the 1619 Project or by a local educational agency (LEA) to support its teaching in public schools. (The 1619 Project is an initiative that addresses the beginning of slavery in the United States.) Specified federal agencies must reduce federal funds in a prorated amount to an elementary or secondary school that teaches this project or an LEA that supports its teaching in public schools. However, federal funding shall not be reduced for programs for low-income students (e.g., free or reduced-price lunch) or students with disabilities.
Equal Dignity for Married Taxpayers Act of 2021 This bill modifies several tax provisions that refer to married couples to make the provisions equally applicable to legally married same-sex couples.
