SB 60: AN ACT TO AMEND TITLE 11 OF THE DELAWARE CODE RELATING TO ASSET FORFEITURE PROCESS AND PROVATE PROPERTY PROTECTION.

Civil forfeiture laws represent one of the most serious assaults on private property rights in the nation today. Under civil forfeiture, police and prosecutors can seize your car or other property, sell it and use the proceeds to fund agency budgets—often without so much as charging you with a crime. This Act protects individual liberty and property rights by standardizing forfeitures across all crimes, simplifying procedures, and addressing counterproductive incentives in the law that distort policing priorities. Importantly, this Act does not change the authority of law enforcement to seize property suspected of being associated with crime or limit in any way prosecutors’ ability to charge and prosecute suspected criminals. Moreover, it ensures that those individuals proven guilty of a crime do not keep the fruits of their crime. In doing so, it strikes the right balance between the individual property rights and public safety.

SB 58: AN ACT TO AMEND TITLE 11 OF THE DELAWARE CODE RELATING TO THE VICTIMS' BILL OF RIGHTS.

This Act ensures victims of crime are afforded as much information as is available to assist them through the trial, sentencing, and post-conviction phases of a criminal case.

HB 75: AN ACT TO AMEND TITLE 29 OF THE DELAWARE CODE RELATING TO THE FREEDOM OF INFORMATION ACT.

This Act requires that all public bodies that are subject to the requirements of the Freedom of Information Act ("FOIA") respond to requests for information from persons who are not residents of Delaware. In doing so, this Act does not change the purpose of FOIA, which is to further the accountability of State government to the citizens of this State, who, as taxpayers, are funding the work of the public bodies. As such, this Act allows state agencies and public bodies to create higher fees for responses to FOIA requests from persons who are not residents of Delaware. This Act also allows persons who are not residents of Delaware to challenge the validity of an action by a public body and extends the deadline by which to do so. It clarifies that a public body can go into executive session to discuss any individual's qualifications to hold a job or pursue training, not just to discuss the qualifications of a resident of Delaware.

HB 83: AN ACT TO AMEND TITLE 17 OF THE DELAWARE CODE RELATING TO DELDOT RIGHTS OF WAY.

This bill clarifies a county government authority to enact and enforce an ordinance affecting an area within a right of way and consistent with state code. Specifically, it enables a county government to enact an ordinance that concerns the maintenance of sidewalks in residential subdivisions.

This bill lowers the tax rate by .05%. Also, it creates a new tax bracket at $125,000 with a rate of 7.05%, and an additional bracket at $250,000 with a rate of 7.80%.

HB 58: AN ACT TO AMEND TITLE 25 OF THE DELAWARE CODE RELATING TO SOLAR PHOTOVOLTAIC SYSTEMS AND RESTRICTIVE COVENANTS.

This Bill enables the use of roof or ground mounted solar systems on privately owned residential dwellings by making covenants or other restrictions that effectively prohibit or unreasonably restrict the installation of solar photovoltaic systems in Delaware void and unenforceable, regardless of the date recorded. This Bill also explains that it is the policy of the State of Delaware to protect the public health, safety, and welfare by encouraging the development and use of renewable resources and to remove obstacles thereto. This Bill further provides for costs and reasonable attorneys' fees to be awarded to the prevailing party in any litigation arising under the provisions of this Section. This Bill does not render void and unenforceable reasonable restrictions on roof or ground mounted solar systems.

This Joint Resolution opposes the cost allocation of the Artificial Island Transmission Project as unfair and unduly burdensome to the ratepayers of Delaware and urges PJM to join with Delaware in contesting the cost allocation in the proceedings pending before FERC.
