HB 11: AN ACT TO AMEND TITLE 31 OF THE DELAWARE CODE RELATING TO ELIGIBILITY FOR PUBLIC ASSISTANCE.

This Act removes the prohibition against receipt of Temporary Assistance for Needy Families (“TANF” also referred to by the name Aid for Families with Dependent Children or “AFDC”) funds by persons convicted of a drug felony, so long as that person is otherwise eligible or TANF assistance. Even though federal laws such as PRWORA passed during the War on Drugs frequently prohibited access to public assistance for persons with drug felonies, these laws also gave states flexibility in determining eligibility for food aid and cash assistance for families with children when applicants had a criminal conviction. The majority of states have limited the federal bans in whole or in part. In 2011, Delaware opted out of restrictions on food aid, but it has not opted out of or limited federal restrictions on TANF—the cash assistance program that is the principal form of assistance available to most families in poverty to pay for things like electricity bills or school supplies. Under existing law, individuals convicted of any state or federal drug felony, including possession of marijuana (which can be a felony under federal law), are ineligible for TANF for life. Although the children of a parent convicted of a drug crime can still receive assistance, the family’s overall award is significantly reduced, and in practice this affects the well-being of families and children.

HB 109: AN ACT TO AMEND TITLE 30 OF THE DELAWARE CODE RELATING TO PERSONAL INCOME TAX.

This bill lowers the current tax rate by .05% for each bracket. The bill creates a new tax bracket at $125,000 with a rate of 7.05% and an additional bracket at $250,000 with a rate of 7.80%. The bill also provides a tiered reduction of the otherwise available itemized deduction based upon the individual's taxable income.

This Resolution designates the month of June as "Post-Traumatic Stress Injury Awareness Month" and June 27, 2017, as "Post-Traumatic Stress Injury Awareness Day" in order to bring awareness to those who suffer from post-traumatic stress and to help remove the stigma associated with it.

HB 264: AN ACT TO AMEND TITLE 18 OF THE DELAWARE CODE RELATING TO UNFAIR PRACTICES IN THE INSURANCE BUSINESS.

This Act requires insurance companies to pay the insured the amount of the insurance company's offer of settlement which was rejected by the insured party. However, the amount remains subject to both parties' reservation or rights, claims, and arguments for the ultimate outcome of the claim.

HB 262: AN ACT TO AMEND TITLE 18 OF THE DELAWARE CODE RELATING TO UNFAIR PRACTICES IN THE INSURANCE BUSINESS.

This Act prohibits insurance companies from revoking, or attempting to revoke, an offer of settlement made to an insured, except in circumstances where the insurer reasonably believes the insured has committed fraud against the insurer.

SB 112: AN ACT TO AMEND TITLE 29 OF THE DELAWARE CODE RELATING TO THE DELAWARE STUDENT ENTREPRENEUR PLATFORM.

This Act creates the Delaware Student Entrepreneur Program Fund. The primary purposes of the Act are as follows: (1) To attract and retain high-skilled, entrepreneurs, including immigrants to the United States, that graduated from Delaware higher education institutions (2) To help fund and develop new businesses in Delaware and create job opportunities in Delaware for Delaware’s young citizens in the areas of innovation and technology that are poised to grow in the 21st century economy; (3) To attract global entrepreneurs to Delaware higher education institutions, to grow businesses, create jobs in Delaware, and provide employment opportunities for the graduates from these institutions; and (4) To support entrepreneurship and innovation in Delaware.

SB 131: AN ACT TO AMEND TITLE 24 OF THE DELAWARE CODE RELATING TO REGULATORY REVIEW OF BOARDS AND COMMISSIONS.

This Act requires that a board or commission created after the effective date of this Act submit the initial adopted rules and regulations pertaining to the licensure, maintenance, and standards of the board or commission to the Joint Legislative Oversight and Sunset Committee, shall review the rules and regulations and make recommendations in accordance with § 10212 of Title 29.

HB 263: AN ACT TO AMEND TITLE 18 OF THE DELAWARE CODE RELATING TO UNFAIR PRACTICES IN THE INSURANCE BUSINESS

This Act prohibits insurance companies from frequently attempting to settle claims with their insureds for less than an amount a reasonable person would believe to be fair based on a common, verifiable compilation of valuation data, such as the NADA guides.

HB 148: AN ACT TO AMEND TITLE 30 OF THE DELAWARE CODE RELATING TO COLLEGE SAVINGS AND “ABLE” SAVINGS ACCOUNTS.

This bill would allow Delaware residents two new deductions from personal income tax. The first is a deduction from taxable income of up to $2,500 for contributions to a “529” College Savings Plan. The second is a deduction from taxable income of up to $2,500 for contributions to a “529A” Savings Account – a special account for meeting the needs of certain individuals with disabilities. Under this Act, a Delaware resident taxpayer would be eligible for the deduction regardless of whether they made a contribution to a 529 or 529A plan sponsored by the State of Delaware or another state or institution, so long as the plans met federal criterion.
