SB 186: AN ACT TO AMEND TITLE 7 OF THE DELAWARE CODE RELATING TO THE FUNDS FROM THE AUCTION OF THE REGIONAL GREENHOUSE GAS INITIATIVES' CO2 ALLOWANCES.

This Act requires the Secretary of the Department of Natural Resources and Environmental Control to direct 35% of the funds from the auction of the Regional Greenhouse Gas Initiative CO2 allowances to the Sustainable Energy Utility and 30% of the funds to the Water Infrastructure Advisory Council. This Act then requires the Water Infrastructure Advisory Council to develop and recommend projects to the General Assembly that are to be funded by these funds, consistent with § 8011(e) of Title 29. This Act further requires that these funds be expended only as authorized by the annual bond and capital improvement act or other act of the General Assembly. Finally, this Act makes technical corrections to conform existing law to the standards of the Delaware Legislative Drafting Manual.

HB 387: AN ACT TO AMEND TITLE 25 OF THE DELAWARE CODE RELATING TO MANUFACTURED HOME COMMUNITIES.

This bill changes the adjudication process from nonbinding arbitration to an administrative hearing. This change reflects the nature of the hearings that have occurred under this section. This bill also permits any party to request from Superior Court a stay of the hearing officer’s decision if an appeal has been filed.

HB 338: AN ACT TO AMEND TITLE 14 OF THE DELAWARE CODE RELATING TO EXCEPTIONAL CHILDREN.

This Act increases the eligibility for a child with a disability to be eligible for free appropriate public education from the end of the school year in which the child attains the age of 21 to the end of the school year in which the child attains the age of 22. This Act also makes a technical correction to conform existing law to the standards of the Delaware Legislative Drafting Manual.

SB 127: AN ACT TO AMEND TITLE 15 RELATING TO VOTER REGISTRATION.

This legislation corrects an inadvertent error in Delaware law that has permitted people younger than 18 years of age to vote in final-stage elections. People must be 18 years of age or older to be eligible to vote in a final-stage election such as general elections, special elections, school board elections, and school district referendums. However, people younger than 18 years of age can vote in any preliminary election, such as primary elections, if they will be 18 years of age at the time of the final-stage election.

HB 343: AN ACT TO AMEND TITLE 11 OF THE DELAWARE CODE RELATING TO THE POSSESSION OF DEADLY WEAPONS.

Modeled after legislation passed in New Jersey on August 8, 2013, this legislation prohibits a person named on the federal terrorist watchlist from purchasing, owning, possessing or controlling a deadly weapon or ammunition for a firearm within the State.

SB 152: AN ACT TO AMEND TITLE 26 OF THE DELAWARE CODE RELATING TO GENERATING SYSTEMS WITH THE NEW SAE ELECTRIC SAFETY STANDARD.

This Act would facilitate EV and grid-integrated electric vehicle interconnection by including the Society of Automotive Engineers industrial safety standard, J3072, which sets safety requirements for EVs that provide power from their batteries back to the electric grid.

HCR 76: APPROVING THE PROPOSED TRANSACTION TO LEASE DIAMOND STATE PORT CORPORATION PROPERTY UNDER CERTAIN TERMS AND CONDITIONS.

This Concurrent Resolution provides the General Assembly's approval of the proposed final agreement or transaction between the Diamond State Port Corporation and GT USA Wilmington, LLC, as required by § 8784(1) of Title 29 of the Delaware Code. This Concurrent Resolution authorizes the Diamond State Port Corporation Board of Directors to enter into a lease for an up to 50 year concession to operate the Port of Wilmington and Edgemoor under the terms outlined in the Resolution.

HB 385: AN ACT PROPOSING AN AMENDMENT TO ARTICLE VIII OF THE DELAWARE CONSTITUTION RELATING TO REVENUE AND TAXATION.

This Act places a constitutional limitation on base general fund operating appropriations. However, appropriations deemed as emergencies involving the health, safety, or welfare of the citizens of the State that are approved by three-fifths of the members elected to each House of the General Assembly are not included in the limitation.

HB 381: AN ACT TO AMEND TITLE 29 OF THE DELAWARE CODE RELATING TO THE DELAWARE VETERANS TRUST FUND.

This Act corrects the language regarding veterans who received a general discharge under honorable conditions to be consistent with federal law and makes the surviving spouses of eligible veterans eligible for assistance from the Delaware Veterans Trust Fund.

HB 171: AN ACT TO AMEND CHAPTER 37 OF TITLE 24 RELATING TO SPEECH/LANGUAGE PATHOLOGISTS, AUDIOLOGISTS AND HEARING AID DISPENSERS.

This Bill amends the Board composition to provide that a slot may be filled by an audiologist or by a hearing aid dispenser which shall address the challenge in locating a hearing aid dispenser to serve on the Board. Further, this Bill adds a definition for the “practice of hearing aid dispensing” to set forth the appropriate scope of practice for hearing aid dispensers, based on their training and qualifications, in the interest of public protection. This Bill also strikes references to audiology and speech pathology aides because the Board does not license or regulate these professions. The requirements for licensure and license renewal, for speech/language pathologists and audiologists, have been amended in the interests of clarity. Upon application, a speech/language pathologist must submit proof of current certification from the American Speech and Hearing Association (“ASHA”) and audiologists must submit proof of either current ASHA certification or board certification from the American Board of Audiology. Reciprocity applicants for speech/language pathology and audiology must meet this same requirement. Also, at the time of the first renewal only, speech/language pathologists and audiologists must show the appropriate current certification. Finally, references to “excessive use or abuse of drugs” have been amended to be consistent with the definition of this term.
