HR 26: RECOGNIZING THE GENOCIDE AND HUMANITARIAN CRISIS IN GAZA AND CALLING ON THE BIDEN ADMINSTRATION AND FEDERAL DELEGATION FROM DELAWARE TO SUPPORT A PERMANENT AND LASTING CEASEFIRE.

This House Resolution calls upon Delaware’s federal delegation, President Biden, and the President’s administration to work towards a permanent ceasefire between Israel and Hamas, including the release of all hostages and prisoners of war by both sides, delivery of immediate and sustained humanitarian aid to Gaza, and diplomatic action to facilitate long-term peace in the region.

HB 278: AN ACT TO AMEND TITLE 2 OF THE DELAWARE CODE RELATING TO RAILROADS.

This Act requires that a train or light engine used to move freight by railroad have a crew of at least 2 individuals. Violation of this statute subjects the railroad to a $500 fine for a first offense, and a $1,000 fine for a second or subsequent offense within 3 years of the first offense.

HCR 80: RECOGNIZING OUR COMMON HUMANITY AND OUR CONCERN REGARDING THE ISRAEL-HAMAS WAR.

This concurrent resolution expresses the State of Delaware General Assembly’s concern for the loss of life in the Israel-Hamas war and calls on the legislature and the citizens of Delaware to recognize our common humanity and the shared strength of our diversity.

HB 269: AN ACT PROPOSING AN AMENDMENT TO ARTICLE II OF THE DELAWARE CONSTITUTION RELATING TO THE GENERAL ASSEMBLY.

This is the first leg of a constitutional amendment creating a "Crossover Day" deadline for each House of the General Assembly to send legislation over to the other House. The annual budget appropriation act, grants-in-aid act, bond and capital improvements act, and resolutions are excluded from this deadline. Currently 26 states, including Maryland, have crossover day deadlines for passing legislation between their two legislative chambers.

HB 241: AN ACT TO AMEND TITLES 25 AND 31 OF THE DELAWARE CODE RELATING TO HOUSING AGREEMENT ADVISORS.

This Act makes clear that buyers and renters of residential real property have the right to be accompanied by advisors during all phases of the property transfer process, and requires sellers and landlords to provide written notice of this right to prospective buyers and tenants. This Act also provides for a civil penalty for landlords and their agents who fail to comply with this requirement.

HB 186: AN ACT TO AMEND TITLE 11 OF THE DELAWARE CODE RELATING TO INDIVIDUALS REQUIRED TO REGISTER AS SEX OFFENDERS FOR ACTS COMMITTED WHEN THEY WERE CHILDREN.

This Act makes changes to the requirements for placement on the sex offender registry of individuals who are adjudicated delinquent of certain offenses. First, it reduces the number of offenses for which placement on the sex offender registry is mandatory and the Family Court has no discretion to relieve a person adjudicated delinquent from the requirement or to reduce the tier assigned. Mandatory registration is still required for all degrees of rape (first through fourth) and conspiracy or attempt to commit any degree of rape. This Act will also allow an individual placed on the registry to petition the Family Court to be relieved from the registration or placed on a lower tier, either at the conclusion of any required treatment or after the passage of 2 years for most offenses, or after the passage of 5 years for those offenses that still require mandatory registration. The ability to petition for a registry review hearing after the mandated review period will apply to anyone placed on the registry because of a juvenile delinquency adjudication, regardless of the date of that adjudication.

HB 187: AN ACT TO AMEND TITLE 29 OF THE DELAWARE CODE RELATING TO CHILD SUPPORT.

This Act expands the Video Lottery Intercept Program by requiring an operator of a video lottery facility to submit an individual's winnings from sports betting and table games to the Division of Child Support Services to satisfy delinquent child support obligations. The Video Lottery Intercept Program currently only collects video lottery winnings.

HB 198: AN ACT TO AMEND THE TOWN CHARTER OF THE TOWN OF CLAYTON.

This Act is a comprehensive amendment of the Town Charter for the Town of Clayton. It sets forth detailed basis for removal from office of Mayor and Town Council and process for filling any vacancies on Town Council. The Amendment allows the Mayor and members of Town Council to participate and vote in Council meetings by remote electronic means, when unavoidable circumstances prohibit in person attendance, so long as all members can hear and speak with one another. The Act allows the Town to borrow up to an amount not to exceed 20% of the assessed value of assessable and taxable real property within the Town limits. The Act also allows the Town to purchase general obligation bonds not to exceed 20% of the assessed value of all real estate subject to taxation within the Town. The Act establishes the Town’s power to regulate orderly growth and development including subdivisions and site plans and procedures for securing financial guarantees to ensure satisfactory completion of new land development. The Act also allows the Town to adopt the assessment of Kent County in lieu of making its own independent assessment and valuation for purposes of levying town taxes. The Act specifies the Town Manager is the Town Tax Collector. The Act allows the Council, by ordinance, to impose impact fees and the purpose for such impact fees. The Act specifies the duties of the Police Chief and Town Manager. The Act specifies all appointments and promotions of Town employees shall be under the direction of the Mayor and the Town Council including hiring, termination, promotion or discipline of all employees. The Act specifies use of Town money by Town Council. The Act sets forth new election procedures, including voter qualifications, voter registration, and conduct of elections for Town elections.
