HB 53: AN ACT TO AMEND TITLE 24 OF THE DELAWARE CODE RELATING TO THE OFFER OF AN ULTRASOUND BEFORE TERMINATING A PREGNANCY.

This Act requires a physician to offer a patient ultrasound imaging and auscultation of fetal heart tone services before terminating a pregnancy and provides civil and criminal penalties for the failure of a physician to comply with this requirement. The patient is free to choose not to view the ultrasound or listen to the heartbeat. This Act is known as "The Woman's Ultrasound Right to Know Act."

HB 47: AN ACT TO AMEND TITLE 19 OF THE DELAWARE CODE RELATING TO MINIMUM WAGE.

This bill removes the training minimum wage, which takes effect 90 days after enactment, and youth minimum wage, which takes effect January 1, 2020.

HB 2: AN ACT TO AMEND TITLE 6 OF THE DELAWARE CODE RELATING TO PROTECTING FEDERAL WORKERS DURING A SHUTDOWN.

This Act creates the Delaware Federal Employees Civil Relief Act which provides the temporary suspension of judicial and administrative proceedings and transactions in Delaware that may adversely affect the civil rights of Federal workers during a shutdown. This Act only applies to Federal workers who reside in Delaware. The Act permits a Federal worker who is furloughed or required to work without pay during a shutdown to apply to a court or administrative agency for a temporary stay, postponement or suspension of any payment of rent, mortgage, tax, fine, penalty, insurance premium, or other civil obligation or liability. A court or administrative agency may grant such relief if it finds that the ability of the Federal worker to pay such obligation has been materially affected by the shutdown. The length of stay may be for the period of the shutdown and 90 days thereafter. This Act also prohibits landlords from evicting a federal worker from premises that are occupied or intended to be occupied primarily as a residence. This Act also prohibits the lapse, termination or forfeiture of the health, life, disability, or motor vehicle insurance policy of a Federal worker without a court order. This Act also places limits on the interest rate that can be imposed on a Federal worker during a shutdown. Finally, this Act empowers the Attorney General to enforce the provisions of the Act and permits a court to impose a civil penalty of not more than $10,000 for violations of the Act.

HB 42: AN ACT TO AMEND TITLE 24 OF THE DELAWARE CODE RELATING TO PROFESSIONS AND OCCUPATIONS.

This bill makes changes to the qualifications for professional land surveyors. This bill also makes clear that there is no civil or criminal trespass when a professional land surveyor enters upon land in the course of preparing a survey.

HB 3: AN ACT AUTHORIZING THE OFFICE OF MANAGEMENT AND BUDGET TO PARTNER WITH A FINANCIAL INSTITUTIONS AND COMMUNITY NON-PROFITS TO ESTABLISH A TEMPORARY LOAN PROGRAM FOR DELAWAREANS EMPLOYED BY THE FEDERAL GOVERNMENT WHO ARE AFFECTED BY THE PARTIAL FEDERAL GOVERNMENT SHUTDOWN.

This Act authorizes the Office of Management and Budget to partner with financial institutions and non-profit providers to establish a temporary loan program for furloughed and unpaid Federal employees as a result of the shutdown caused by a lapse in appropriations.

HB 26: AN ACT PROPOSING AN AMENDMENT TO ARTICLE II OF THE DELAWARE CONSTITUTION RELATING TO THE LEGISLATURE AND VOTING ON THE BUDGET APPROPRIATION ACT, BOND AND CAPITAL IMPROVEMENT ACT, AND ACT MAKING APPROPRIATIONS FOR CERTAIN GRANTS-IN-AID.

This Act is the first leg of a constitutional amendment that requires the General Assembly to wait 48 hours from the introduction of the budget appropriation bill, bond and capital improvement act, and act making appropriations for certain grants-in-aid bill, or any substantive amendment or substitute bill to such bills before voting on such legislation unless the General Assembly by a three-fourths vote waives this requirement. The purpose of this provision is to allow all interested persons, including legislators, a reasonable amount of time to review the three significant financial legislative acts before voting on such legislation. This restriction can be waived if three-fourths of each House of the General Assembly agrees to act in a shorter time period.

HB 33: AN ACT PROPOSING AN AMENDMENT TO THE DELAWARE CONSTITUTION RELATING TO THE TERMS OF SENATORS AND REPRESENTATIVES.

This proposed Constitutional Amendment establishes 20 year term limits for Representatives and Senators beginning with those terms of office elected during the general election of 2022. If a Representative or Senator serves 20 consecutive years in the same office, they would not be eligible for re-election at the next general election for that chamber. Any ineligible candidate would be able to run again for this seat in the general election that follows this term of ineligibility.

HB 14: AN ACT TO AMEND TITLE 30 OF THE DELAWARE CODE RELATING TO PERSONAL INCOME TAX.

This Act creates the following new tax brackets: 1. At $125,000, with a rate of 7.10%. 2. At $250,000, with a rate of 7.85%. This Act also creates a tiered reduction of the otherwise available itemized deduction based on the individual's taxable income.

HB 13: AN ACT TO AMEND TITLE 29 OF THE DELAWARE CODE RELATING TO THE DISPOSITION OF FUNDS RECEIVED BY THE STATE OR A STATE AGENCY FROM SETTLEMENTS OR OTHER FINAL ORDERS OR JUDGMENTS OF A COURT.

This Act reaffirms the Constitutional requirement that the General Assembly appropriate money belonging to the General Fund by making clear that funds received by the State or a State agency from settlements or other final orders or judgments, other than those funds awarded specifically to a party or consumer or as attorneys' fees, or explicitly directed otherwise by law, are to be deposited to the General Fund and may not be transferred or expended until the funds are appropriated by the General Assembly. Included in the exclusion, are all funds that exist in the Delaware Code where the law provides for the money that must go to the specific fund and how the money in that fund may be spent.

SB 269: AN ACT TO AMEND TITLE 29 OF THE DELAWARE CODE RELATING TO THE RIVERFRONT DEVELOPMENT CORPORATION.

The Riverfront Development Corporation was created by epilogue language in the Fiscal Year 1997 Bond Bill. The Board of Directors of the Riverfront Development Corporation is established by at least three separate provisions of Bond Bill epilogue language in Senate Bill No. 260 of the 138th General Assembly (70 Del. Laws, c. 210, § 41), House Bill No. 467 of the 139th General Assembly (71 Del. Laws, c. 227, § 8), and House Bill No. 550 of the 142nd General Assembly (74 Del. Laws, c. 308, § 40). This Act codifies the Board of Directors ("Board") of the Riverfront Development Corporation so that this information may more easily be located in the future. This Act also makes a change to the membership of the Board to add 2 directors to the Board. The 2 new directors will be elected by and serve at the pleasure of the Board.

HB 411: AN ACT TO AMEND TITLE 10 AND TITLE 29 OF THE DELAWARE CODE RELATING TO CONTINUITY OF GOVERNMENT OPERATIONS.

This Act amends Delaware's existing continuity of government laws as required in conjunction with the adoption of House Bill No. 410, which completes the process to amend Article II, § 5 and Article XVII, § 1 of the Delaware Constitution to adopt an "all hazards" approach to continuity of government planning. This Act also makes technical corrections to conform existing law to the standards of the Delaware Legislative Drafting Manual.

HB 382: AN ACT TO RENAME THE DELAWARE DEPARTMENT OF TRANSPORTATION WELCOME CENTER ON INTERSTATE 95 LOCATED AT 530 JFK MEMORIAL HIGHWAY NEWARK, DE 19702 IN HONOR OF THE BIDENS.

This Act has the effect of renaming the Delaware Department of Transportation Welcome Center on Interstate 95 at 530 JFK Memorial Highway, Newark, Delaware as the "Biden Welcome Center" in honor of the Biden family. This gesture is made because of the exemplary service to the State of Delaware the Bidens have provided, and because of their lifelong promotion of this State.
