HCR 77: ESTABLISHING THE GUN VIOLENCE PREVENTION TASK FORCE TO STUDY AND MAKE FINDINGS AND RECOMMENDATIONS REGARDING WHETHER DELAWARE SHOULD BECOME THE POINT OF CONTACT TO CONDUCT BACKGROUND CHECKS FOR FIREARMS TRANSFERS.

This Act creates the Gun Violence Prevention Task Force to study and make findings and recommendations regarding whether Delaware should become the point of contact to conduct background checks for firearms transfers.

SCR 67: EXTENDING THE DIVISION OF DEVELOPMENTAL DISABILITIES SERVICES TASK FORCE.

The Division of Developmental Disabilities Services Task Force was established under Senate Concurrent Resolution No. 62 of the 150th General Assembly. The Task Force has met regularly since August 2019, but needs additional time to complete its work. This Concurrent Resolution extends the due date of the Task Force's final report to July 31, 2020.

SB 79: AN ACT TO AMEND TITLE 11 AND TITLE 16 OF THE DELAWARE CODE RELATING TO THE ELIGIBILITY OF REGISTERED QUALIFYING PATIENTS UNDER THE DELAWARE MEDICAL MARIJUANA ACT TO PURCHASE OR POSSESS FIREARMS.

This Act clarifies existing law so that an individual is not disqualified from possessing or purchasing a firearm because the individual is a registered qualifying patient under the Delaware Medical Marijuana Act. This Act also makes technical corrections to conform existing law to the standards of the Delaware Legislative Drafting Manual.

SB 182: AN ACT TO AMEND TITLE 21 OF THE DELAWARE CODE RELATING TO TRAFFIC CONTROL DEVICES FOR SIZE AND WEIGHT OF VEHICLES AND LOADS.

This Act makes the following changes related to traffic control devices erected on order of the Secretary of the Department of Transportation (“Secretary”) limiting the size and weight of vehicles and loads permitted on a specific highway: (1) Requires the Secretary to submit the order to the Registrar of Regulations for publication in the Register of Regulations and publish the order on the Department’s website. (2) Clarifies that violation of a traffic control device erected by order of the Secretary is a specific offense. (3) Increases the monetary penalty for a violation of a traffic control device erected by order of the Secretary over the existing penalty in § 4508 of Title 21. (4) Makes a subsequent violation of a traffic control device erected by order of the Secretary a moving violation, which results in the Department assessing points on an individual’s license based on the violation.

SB 126: AN ACT TO AMEND TITLE 18 OF THE DELAWARE CODE RELATING TO LINE-OF-DUTY DISABILITY BENEFITS TO COVERED FIREFIGHTERS.

This Act expands eligibility for Line-of-Duty disability benefits to paid firefighters who work for municipal fire departments and to fire service instructors and fire marshals who work for the State and for nonphysical disabilities. This Act also creates a presumption that a covered firefighter who is permanently disabled from heart disease, lung disease, cancer, or post-traumatic stress injury developed the disabling condition because of and in the course of performing official duties. This Act also provides a list of reasons may be used to rebut this presumption and requires fire companies to keep records of each firefighter's exposure to carcinogens. This Act also makes technical corrections to conform existing law to the standards of the Delaware Legislative Drafting Manual.

SB 112: AN ACT TO AMEND TITLE 29 OF THE DELAWARE CODE RELATING TO THE COUNCIL ON DEVELOPMENT FINANCE.

The Joint Legislative Oversight and Sunset Committee approved a project to work with the Governor's Office throughout 2018 and 2019 to identify antiquated boards, commissions, and councils that need statutory updates or outright repeals. The Council on Development Finance was identified as needing to simplify the party balance requirement to make it easier to fill vacancies and update language regarding appointments and quorum. This Act also makes technical corrections to conform existing law to the standards of the Delaware Legislative Drafting Manual.

HB 144: AN ACT TO AMEND TITLE 11 OF THE DELAWARE CODE RELATING TO ASSAULT.

House Bill 212 enacted by the 148th General Assembly (80 Del. Laws c. 287) expanded the offense of Assault in the Second Degree to include the intentional assault of ambulance operators, rescue squad members, and nurses injured while performing work-related duties. As a result of increasing workplace violence directed against healthcare providers, this Act further defines Assault in the Second Degree to include other health care treatment providers and employees and hospital security personnel who are injured while performing their work related duties.
